WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before March 2, 2009, the
following are the now known interested or responsible parties for the Subject Property:
Deutsche Bank Nat Trust c/o Citi Residential Lending, 6801 Colwell Blvd, Irving, TX 75039-
3198; Usset, Weingarden & Liebo, PLLP, 4500 Park Glen Road, #12Q Minneapolis, MN 55416;
Citi (Kyle White) 13875 Hwy 13 S, Ste 100, Savage, MN 55378; Thomas Dale District 7
Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated June 8, 2009; and
WHEREAS, this order informed the then lrnown interested ar responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by July 8, 2009; and
WHEREAS, the enforcement officer has posted a placazd on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, September 8, 2009 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subj ect Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
demolition of the structure to be completed within fifteen (15) days after the date of the Counci]
Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
October 7, 2009 and the tesrimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 647 BLAIR AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
InspecUOns, V acantJl�TUisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the norification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within fifteen (1S� days after the date of the Council
Hearing.
If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subj ect Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

as defined by Legislative Code, Chapter 45. The Depaztment of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisance condition by
correcring the deficiencies or by razing and removing trris building(s).
The property was re-inspected on July 10, 2009. There was no compliance and the nuisance
condition remains unabated, the community conrinues to suffer the blighting influence of fhis
property. It is the recommendation of the Department of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove Yhis building in a timely manner, and failing that, authorize the Department of Safety and

The building is a one story, wood frame, single-family dwelling with a detached one-stall, wood
frame, gara�e on a lot of 4,792 square feet.
According to our files, it has been a vacant building since July 21, 2008.
The cunent property owner is Deutsche Bank Nat Trust/Co Citi Residential Lending, par
AMANDA and Ramsey County property records.
The city has had to board this buiiding to secure it from trespass.
There have been nine (9) SUMMARY ABATEMENT NOTICE(S) since 2008.
There have been seven (7) WORK ORDERS issued for:
- Boarding/securing
- Improperly stored refuse, garbage and misc debris
- Removal of snow and ice
On April 22, 2009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO

On April 22, 2009, a Building Deficiency Inspecfion Report was compiled anfl the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

lhis building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy un�i] such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a one story, wood frame, sin�le family d�velling, and its one stall detached
wood frame garage.
A Code Compliance Inspection report was completed on February 2, 2009 by Jim
Seeger. Details of this report are as follows:

1. Provide handrail, guardrail and risers at basement stairs.
2. Provide raised landing at base of basement stairs matching riser height.
3. Place plastic sheeting on soil in crawl space area.
4. Remove dead squirrel from bathroom.
5. Provide floor coverings at front and rear entrances.
6. Provide egress window for base�nent bedroom or remove.
7. Infill floor in upstairs bedrooin.
8. Provide egess windows in bedrooms as necessary.
9. Provide attic access and insulate attic to code.
10. Provide handrail, guardrails, steps and risers to code at rear deck.
I I. Rehabilitate garage in its entirety or remove.
12. Remove and replace front entry steps to code.
13. Insure basement ceilar floor is even, is cleanable, and a11 holes aze fiiled.
14. Install handrails and guardrails at all stairways, including basement stairways, per
attachment.
15. Strap or support top of stair stringers.
16. Tuck Point interior/exterior of foundation.
17. Install tempered or safety glass in window over stair landing to Code.
18. Provide thumb type dead bolts for all entry doars. Remove any surface bolts.
19. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc.
as necessary.
20. Provide complete sYonns and screens, in good repair, for all door and window openings.
21. Repair walls, ceilings and floors throughout, as necessary.
22. Re-leve] structure as much as is pra�crical.
23. Prepare and paint interior and exterior as necessary. Observe necessary abatement
procedure if lead base paint is present (See St. Pau1 Legislative Code, Chap. 34 for
additional information).
24. Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly, doar
and window openings that are not headered, etc.) are to be reconstructed as per code.
25. Habitable rooms with new usage and replaced windows shall have glass area equal to
8% of floor area, or a miniinum of 8 sq. ft., one-half of which shall operate; and all
bedroom windows shall meet emergency egress requirements (20" minimtun width, 24"
minimum height, but not less than 5.7 sq. ft. overall openable area; minimum 5.0 sq. ft.
openable area if sill height is within 44 inches of gade).

3. Ordering the owner to remove or repair the building(s) at 647 Blair Avenue within fifteen
(15) days from adoption of resolution.
The property owner of record, Deutsche Bank Nat TrusUco Citi Residential Lending, dad not
appear. No other parties of interest appeared.
Mr. Magner stated the building was a one story, wood frame, single-family dwelling with a
detached one-stall gazage on a lot of 4,792 squaze feet and had been vacant since 7uly 21, 2008. A
code compliance inspection had been done on January 27, 2009, the vacant building registration
fees in the amount of $1,000 went to assessment on July 21, 2009, and the $5,000 performance
bond had not been posted. On Apri122, 2009, an inspection of the building was done and a list of
deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance
building was posted on June 8, 2009 with a compliance date of July 8, 2009. To date, the property
remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey
County Tasation estimated the market value of the land to be approximately $20,400 and the
building to be $62,400. Real estate taxes were. Code Enforcement estimates the cost to repair the
building to be approximately $75,000 to $85,000. The cost for demolition was estimated to be
approximately $10,000 to $12,000. There had also been nine summary abatements issued to this
property since 2008, seven of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse and debris,
boarding/securing, and remove snow and ice. Code Enforcement recommends the building be
repaired or removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a copy of the demolition bids. Mr. Magner stated that he did not have
them as he believed Purchasing was putting through the demolition requisitions to obtain bids.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1889 and was a warker's cottage-style building. The building had good integrity with "mildly
shingled" clapboard, the windows were original; however, the siding was in need of repair. The
property had not been surveyed and was located outside the potential Frogtown historic district.
Since the block face was intact and the building had good integrity, she encouraged.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.
