THIS IS AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR THE PRESERVATION OF THE PUBLIC PEACE, HEALTH, AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul legislative Code, pertaining to Use District, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the followi,nd cbscribed property from "A" Residence District to "C" Residence District, sto -wit: Lots 1, 2, 3, 4, 5, Block 2, Birminghams Park, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, being located at the southwest corner of Sims and White Bear Avenues. Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preserva- tion of the public peace, health and safety. Section 3. This ordinance shall take effect and be in force upon its passage, approval and publication. O'Connell City Clerk Building Dear Madam: This is in the matter of the petition of "A" to "C" residence property located at and White Bear Avenues. The property is 4, 5, Block 2, Birmingham Park Addition. fied "A" residence since the enactment o June 6, 1961 Roy W. Baber to rezone from the southwest corner of Sims described as Lots 1, 2, 3, The property has been classi- f the Zoning Ordinance in 1922. On April 19, 1961, the Commissioner of Finance reported the petition sufficient with the owners of 15 of a possible '19 (78.9 %) tracts of land within the prescribed 100 foot radius having signed the petition. The site is presently vacant and recently has been filled to the grade of Sims and White Bear Avenues. The proposed use as indicated by the petitioner is multi - family dwelling with offices. At the time of the Board of Zoning meeting, the petitioner indicated the building would have 17 units with off-street parking accessory thereto. This property has a frontage on Sims Avenue of 197.26 feet and a front- age along White Bear Avenue of 100 feet, resulting in an area of 19,726 square feet. Directly north across Sims Avenue is a lot which is vacant except for a bill board and is classified commercial. Adjoining to the west in this same block are three single - family residences recently moved on to these lots by the petitioner; northeasterly across the inter- section of White Bear and Sims Avenues, east and southeast across White Bear Avenue and directly south across a public alley and fronting on York Avenue are single - family residences. The Board of Zoning considered this matter at their meeting on May 18, 1961, and it is their opinion that the proposeduse would benefit White Bear Avenue and the immediate area. Consequently,*the Board of Zoning recommends the granting of the petition to rezone from "A" to "C}' resi- dence the above described property. Sincerely, H. C.
