THIS IS AN EMERGENCY ORDINANCE RENDERED NECES SARY FOR THE PRESERVATION OF THE PUBLIC PEACE, HEALTH, AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertain- ing to Use Districts, Height,Districts, and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "B" Residence Dis_tri_ct to Commercial District: Lot 17, Block 4, "Milton" Addition, on the north side of St. Anthony Ave.. between Milton and Victoria Streets, subject to the following express exceptions and conditions: 1. The property is described as Lot 17, Block 4, Milton Addition. - 4 , On April 3, 1961, the Commissioner of Finance reported the petition sufficient with the owners of 12 of a possible 14 (85.7°x,) tracts of land within the required 100 foot radius having signed the petition. This property is presently developed with a two - family residence. The applicant proposes to continue this use and, in addition, operate a beauty parlor in the residence. The property has a frontage of 40 feet on St.Anthony,Avenue and extends to a depth of 122 feet, result- ing in an area of 4,880 square feet. South and across St. Anthony Avenue is the Interstate Freeway # 94, all the other uses within the area are single - family residences. The Board of Zoning considered this matter at their regular meeting on April 20, 1961 and it is their opinion that to rezone this pro- perty as requested would result in a "spot zone" and would not be in keeping with good city planning and zoning.
