the north side of St. Paul Avenue between Davern Avenue -and Edgcumbe Road,
described as the West 37.6 feet of Lot 1F -and -all of Lots, 5, 6, ' 7, 82 9,
and 10, Block 3, Granport .Addition, and all of the vacated alley adjacent
to the south line thereof, and all that part of the vacated alley adjacent
to the west line of said Lot 10, which accrued to said Lot 10 by reason
of the vacation of said alley, pursuant to the Zoning Code, that, for the
accommodation of the establishment and maintenance thereon of-an off - street
vehicular parking facility of 40 car spaces in conjunction with one 17 -unit
apartment building and another 23 -unit apartment building to be constructed
thereon, the general provisions of said Zoning Code hereby are determined
and varied so as to permit the relaxation and dispensation of the 8 -foot
side yard buffer requirement for said off - street parking facility and,
accordingly, permit therefor hereby is granted; land that the general
provisions of said Zoning Code hereby are further determined and varied so
as to establish for said premises a building setback line of 2l+ feet from
Morgan Avenue and a building setback line of 1/+ feet from St. Paul Avenue,
and, accordingly, said setback lines hereby-am established in respect
of said premises owned by said Bisanz Bros. Realty Company.
RESOLVED FURI*HER, that the application of said applicant for
4a permit for the establishment and maintenance of such off - street
vehicular parking facility with a capacity for the parking of 40 vehicles,
without any aforesaid 8-foot side yard parking lot buffer requirement
therefor, hereby is granted.

This is in the matter of Bisanz Bros. Realty Company's 1) appeal to relax the
required 8 foot side yard buffer for parking lots and 2) application for a per-
mit for a 40 car off- street parking lot on property located on the north side
of St. Paul Avenue between Edgcumbe Road and Davern Street and described as
the west 37.6 feet of Lot 4 and all of Lots 5, 6, 7, 8, 9, 10, Block 3, Granport
Addition and all of vacated alley adjacent to the south line thereof, and all that
part of vacated alley adjacent to the west line of said Lot 10 which accrued to
said lot by reason of vacation of said alley. This property was rezoned to "C"
residence on November 10, 1960 as part of a larger tract.
The property under consideration is vacant and the applicant proposes to develop
it with two apartment buildings, one 17 -unit and one 23 -unit building with 40
off - street parking spaces accessory thereto. The site has a frontage of 296.2
feet along both St. Paul and Morgan Avenues and a depth of 138.75 feet running
between said streets resulting in an area of approxima -bly 41,142 square .
The applicant is requesting a relaxation of the required 8 ffer

We wish to make an appeal for relaxation of a regulation in the Zoning Code
under Section 64.03, Par. I. The section of the Legislative Zoning Code
which we ask to be relaxed is Section 8(5d)which requires an 8 ft. side
yard set back between property line and parking lot.

We are asking that this provision of the Zoning Code be relaxed in order to
permit us to park directly adjacent to the east property line and to relax
the 8 ft* side yard restriction on the west property line from 8 ft. to
4.2 ft. We are enclosing a plot plan which shows this layout.
All other provisions of the Zoning Code and set backs are relating to off -
street parking lots will be met.
