PAUL COUNCIL NO. _ OFFICE OF THE CITY CLERK ___QO,UNCIL RESOLUTION — GENERAL FORM - PRESS' -=D BY C(:Lµk,.AIONER DATE WHEREAS, on October 10, 1961, certain electrical wiring, which was a part of a traffic signal, was damaged at Seventh Street and Lafayette Road in the City of Saint Paul as a result of the use of a post hole digger belonging to Kibbey Engineering and-Construction Company at this time and place; and WHEREAS, Registered Bill No. 3 -3782, in the amount of $96.06, has been issued to the aforementioned Kibbey Engineering and Construction Company covering the cost of repaiks to the traffic signal wiring; and WHEREAS, a dispute exists between the City of Saint Paul and Kibbey Engineering and Construction Company as to the responsibility for the damage to the City property,and it is in the interests of both parties that the matter be finally concluded; now, therefore, be it, RESOLVED, That the proper City officers are hereby authorized accept from Kibbey Engineering and Construction Company and /or its insurer, Employers Mutuals of Wausau, the sum of $75.00 and that upon receipt of,said amount, the proper City officers are hereby authorized and directed to-executec: releases, in a form approved by the Corporation Counsel, and are further directed to cancel the balance of the aforementioned Registered Bill No. 3 -3782• COUNCILMEN Yeas Nays DeCourcy Holland Loss Mortinson Peterson ­Rosen Mr. President, Vavoulis eM 6-61 Council File No. 206375 —By, Robert F.
