RESOLVED, upon the appeal therefor by Milton Leafman and
Lillian E. Leafman, owners of the subject premises, under Section
61+.03 of the Zoning Code, Chapters 60 to 61+ inclusive of the Saint
Paul Legislative Code, the provisions of said Zoning Code, as
necessary therefor, hereby are determined and varied so as to permit
the erection and maintenance of .a. 23 -unit apartment building on
Lots 9, 10, and 11, Block 5, St. Clair St. -and Short Line Addition
to the City of St. Paul, Plat 2, classified in an "A" Residence
District, immediately ,adjoining Lot 12, Block 5, St. Clair St. and
Short Line - Addition to the City of St. Paul, Plat 2, classified in a
Commercial. District under said Zoning Code, said last mentioned lot
to be used in conjunction with said apartment house project for
off - street motor vehicle parking, and accordingly such permit hereby
is granted; and, further, pursuant to said appeal, there is hereby
established a building setback line in relation to the west line of
Dunlap Street in respect of said proposed apartment building a
distance of 15 feet across said lots westerly therefrom and
parallel to said west line of Dunlap Street.

The property is vacant and at the street grade of Dunlap Street. Over
a period of years these lots have bad a substantial amount-of fill to
bring them to the present street grade of Dunlap Street. This is•an,
irregularly shaped tract of..land having street frontage on Dunlap Street
of 271.82 feet, 21.87 feet on St.Clair Avenue, and 166.55 feet on the
north boundary line, resulting in an area of approximately 27,258 square

Field investigation discloses that the three platted lots in the . "A" resi-
dence district are suitable for single - family residences, or they could be
divided in such a manner that it would be possible to develop tbem with two
two - family residences. The immediate area is developed predominantly with
single and two - family residences with the exception of an existing apart-
ment building at the northeast corner of St.Clair Avenue and Dunlap Street.
Nest of the site is the Short Line Railway right -of -pay which islapproxi-
mately 20 feet below the grade of the property under consideration. The
applicant's plan, received November 29 1961, indicates that the Iproposed
