This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 61+1 inclusive, of the Saint Paul Legislative Code, pertaining'to Use Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "A" Residence District to Commercial District, to -wit: Lots 2 through 8 and Lot 9, except Parkway, Block 2 Kavanagh and Dawson's Addition to the City of Saint Paul, Ramsey County situate on property located at the Northwest corner of Sloan Street and Wheelock Parkway, between Wheelock Parkway and Highway #35 E. Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3. 'k 'd This is in reply to the referral of t e petition o o er c nei er to rezone from "A" residence to commercial district property located at the northwest corner of+Sloan Street and Wheelock Parkway described as Lot 2 thru 8 and Lot 9 except Parkway, -Block 2, Kavanagh 6 Dawson's Addition. On August 19, 1965, the Commissioner of Finance reported the petition sufficient with the owners of 8 of a possible 8 (100 %) tracts of land within the prescribed 100' radius having signed the petition. The Board of Zoning considered this matter at its regular meeting on August 19, 1965. It was pointed out that the subject property is presently developed with-a single- family residence and two car garage which will be removed for the purpose of developing the site with a gasoline filling station. It was the finding of the Board, that because of the proximity of right- ;. a -way of Highway # 35E which adjoins the subject property on the west, that the proposed gasoline filling station would be a proper use of subject property.
