An Ordinance amending the Zoning Code,
Chapters 60 to 64, inclusive, of the Saint
Paul Legislative Code, pertaining to Use
Districts, Height Districts and Rezoning of
certain properties in the City of Saint Paul,
as amended. This is an.emergency ordinance
rendered necessary for the preservation of
the public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64,
inclusive, of the Saint Paul Legislative Code, pertaining to Use
Districts, Height Districts, And Rezoning of certain properties
in�the City of Saint Paul, as amended, be and the same is hereby
further amended so as to rezone the following described property
from' "B" Residence District to Commercial District. to -wit:
Lots P 5 and 16, Block 5, University Subdivision of
Hyde ark Addition to the City of Saint Paul,
Ramsey County
situate on property located at the southeast corner of Fuller
Avenue and Oxford Street.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be in
force upon its passage, approval and publication.

Dear Sir:
This is in reply to the referral of the petition of Benjamin L.
Alexander to rezone from "B" residence to commercial property
located at the southeast corner of- Fuller Avenue and Oxford-Street-
which is described as Lots 15 and 16, Block 5', University Sub. of i"IF
Hyde Park Addition for the purpose of constructing a Mortuary on
the site.
On July 27, 1965, the Commissioner of Finance reported the,petition
sufficient with the owners of 11 of a possible 15 (73.33 %) tracts
of land within the prescribed 100 foot radius having signed the
petition.
The Board of Zoning considered this matter at its regular meeting
on September 2, 1965. The staff reported'that the subject property
consists of two lots, one vacant and the other developed with a
building formerly occupied as a legal non - conforming use but which
is now vacant. The surrounding area uses are predominantly residen-
tial and the Comprehensive Land Use Plan indicates the highest and
best use of the property is for residential purposes._ It was
pointed "out that a reclassification of this property would constitute

spot zoning and would permit a use which is incompatible with the
area uses. In consideration of these factors, the Board of Zoning
recommends the denial of the petition to rezone the above described
property to a commercial district.
