WHEREAS, State Street Townhomes, LLC (zoning file #05-061-952) has submitted for City Council approval the
attached preliminary and final combined plat for subdivision of property at 560 State Street between Concord and
Oakdale, to create 20 townhome parcels and 1 outlot, and
WHEREAS, the appropriate City departments have reviewed the piat and fourYtl, subject to the recommended
conditions, that it meets the requirements of Chapter 69 of the Zoning Code; and
WHEREAS, notice of a public fiearing before the City Councit was duly published in the officiai newspaper of the
City and notices were mailed to each owner of affected property including ali property situated within 350 feet of the
subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat on June 1 and 15, 2005, where all
interested parties were given the opportunity to be heard and the Council considered all the facts and
recommendations concerning the piat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and
final plat for 560 State Street 7ownhomes between Concord and Oakdale, subject to the following condition:
1. The applicant shall file a copy of the Council Resolution approving the 560 State Street Townhomes
plat with the Ramsey County Recorder's Office.

E. ZONWG CODE CITATION: §69.301 states that platting is required when a subdivision (1)
creates five or more lots or parcels each of which is 2'/2 acres or less in size, or (2) requires
paved streets, alleys and other public improvements, or (3) is previously unplatted land. §69.304
lists conditions for lot splits and adjustments of common boundaries. §69.A06 provides criteria
for review of subdivision applications. These criteria are covered below under "Required
Findings."
F. HISTORY/DISCUSSION: Major variance requested and granted in 2004 to aliow 19.5 feet
between the two buildings on the southeast portion of the site, given the di�cult topography of
the site.
G. DISTRICT COUNCIL RECOMMENDATION: The West Side Citizens Organization has been
working with the Neighborhood Development Alliance and Riverview Economic Development
Association to get this project built.
H. REQUIRED FINDINGS: § 69.406 of the zoning Code requires that all of the following findings
shall be made prior to approval of a subdivision:
1. All the applicable provisions of the Legislative Code are complied with. City staff have
reviewed the proposed plat and have determined that ali applicable provisions of city codes
are met.
2. The proposed subdivision will not be detrimental to the present and potential surrounding
land uses. The proposed plat is consistent with the surrounding land uses, and wil! not be
detrimentai to present and future use of surrounding land.
3. The area surrounding the subdivision can be planned and developed in coordination and
compatibility with the proposed subdivision. The area surrounding the proposed plat is
already developed and compatible with the proposed plat.

4. The subdivision is in conformance with the comprehensive plan. The subdivision is in
conformance with the Housing chapter of the comprehensive plan, which cails for production
of 300-400 housing units a year that can be sold or rented to smaller households (Strategy
2, Policy 5.1, page 15). It also conforms with redevelopment plans for the area.
5. The subdivision preserves and incorporates the site's important existing natural features
whenever possible. Construction on the site is set back suffciently from the bluff on the
southern portion of the property.
6. All land intended for building sites can be used safely without endangering residents by peril
from floods, erosion, continuously high water table, severe soil conditions or other menace.
In the course of site plan review and City permit issuance, the development of the plan
related to floods and erosion has already been approved.
7. The subdivision can be economically served with public facilities and services. The
subdivision can be economically served with public facilities and services from surrounding
streets.
STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends
approval of the final plat for State Street 7ownhomes, LLC subject to the condition that the
applicant shall file a copy of the Council Resolution approving the plat with the Ramsey County
Recorder's Office.

E. ZONING CODE CITATION: §69.301 states that platting is required when a subdivision (1)
creates five or more lots or parcels each of which is 2'/ acres or less in size, or (2) requires
paved streets, alleys and other public improvements, or (3) is previously unplatted land. §69.304
lists conditions for lot splits and adjustments of common boundaries. §69.406 provides criteria
for review of subdivision applications. These criteria are covered below under "Required
Findings."
F. HISTORY/DISCUSSION: In June of 2004, Habitat Humanity submitted a combined plat for
Germain Landing to create 24 residential parceis and 5 outlots. A month latter, Habitat applied for
a rezoning from R2 single family to RT1 two family residential. After the rezoning was approved
they where granted a conditional use permit to construct a 30 unit residential cluster development
on the site.
G. DISTRICT COUNCIL RECOMMENDATION: District 2 had not commented at the time this staff
report was prepared.
H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the following findings
shall be made prior to approval of a subdivision:
1. All the applicable provisions of the Legislative Code are complied with. City staff have
reviewed the proposed plat and have determined that ail applicable provisions of city codes
are met subject to the condition that common wall agreements and deed restrictions be
recorded on the deeds for all six lots that the lots can only be developed for attached
houses. Freestanding singie-family houses would not be perrnitted because the lots are too
small.
� 2. The proposed subdivision will not be detrimental to the present and potential surrounding
land uses. The proposed plat is consistent with the surrounding land uses, and wifl not be
detrimental to present and future use of surrounding land.

3. The area surrounding the subdivision can be planned and developed in coordination and
compatibility with the proposed subdivision. The area surrounding the proposed plat is already
developed and compatible with the proposed plat.
4. The subdivision is in conformance with the comprehensive plan. The subdivision is in
conformance with the housing chapter of the comprehensive plan, which calls for providing a
range of fiousing types and values. The comprehensive plan encourages devetopments
which promote good design solutions on smaller development sites and that complement
existing neighborhoods. It also conforms with redevelopment plans for the area. '
5. The subdivision preserves and incorporates the site's important existing natural features
whenever possib/e. The site is in a fuliy-developed part of Saint Paul with no remaining
naturalfeatures.
6. All land intended for building sites can be used safe/y without endangering residents by peril
from floods, erosion, continuousty high water table, severe soil conditions or other menace.
The site is a flat, fully developed area with no flooding, erosion, high water table or soil
condition problems.
7. The subdivision can be economically served with public facilities and services. The
subdivision can be economically served with public facilities and services from surrounding
streets.
I. STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends
approval of the finai plat for Germain Landing 2nd Addition subject to the following conditions:
1. Common wall agreements and restrictions shall be recorded on deeds for all six lots that the •
lots can only be developed for attached houses, with copies of the deed restrictions and
recording numbers provided to the City.
2. The applicant shall file a copy of the Councii Resolution approving the plat with the Ramsey
County Recorder's Office.
