incorporated as part of this s lution by this reference. This order was
served in accordance with the r isions of Chapter 45 of the Saint Paul

inforn►ed these parties that the t story, wood frame, single family house
located on the Subject Property is an abandoned building and a nuisance
pursuant to Sections 45.01, S . and 45.02, Subd. 11 of the Saint Paul
Legislative Code. The August 3 , 988 order also had attached to it a list of
deficiencies regarding the hous o the Subject Property, said list is attached
and incorporated as part of th' r solution; and
WHEREAS, the December 1 , 1 88 order infornied all owners, interested
parties and responsible partie t t they must either repair the structure on
the Subject Property by correc in the list of deficiencies or demolish the
structure, either action to ta e lace by Febru,ary 8, 1989.
WHEREAS, no action has e taken regarding compliance with the December
13, 1988 notice and order, and as a result the Division of Public Health
requested that a �xzblic hearin scheduled to take place on Tuesday, April
25, 1989 for the City Council o onsider the advisability and necessity of
ordering the correction of the nu sance condition or in the alternative
consider the demolition and r v 1 of this house; and
Hlf-IEREAS, the above refe en ed owners, interested parties and responsible
parties have been served in ac or ance with the provisions of Chapter 45 of the
Saint Paul Legislative Code of th notice of the time and purpose of the April
25, 19$9 hearing before the Co nc l;
WHEREAS, a hearing was el before the Saint Paul City Council on April
25, 1989 and all testimony and ev'dence was considered by the Council.
NOW THEREFORE, BE IT R D, that based upon all of the testimony and
evidence presented at the Apr' 2 , 1989 hearing, the Saint Paul City Council
hereby adopts the following F' d' gs and Order cancerning the house at 398
Banf il Street:
1. That the house loc t on the Subject Property has been vacant since
May of 1978. The house has r �ned vacant and has been either open or boarded
since May of 1978.
2. That since June of 19 7 the City of Saint Paul has on several
occasions issued orders to th o ers to make this house secure and not
accessible.
3. That the owners of th Subject Property have repeatedly failed to
register and pay the vacant b il ing fee for this house as required by City
ordinance.
4. That the Division f lic Health of the City of Saint Paul
condemned this structure as " nf t for Human Habitation under Chapter 34 of the
Saint Paul Legislative Code" �n y, 1977. The building is still subject to
this condemnation order.
5. That the one and e- alf story single family, wood frame house
located on the Subject Prope y �s an abandoned building under Section 45.01,
Subd. 1, of the Saint Paul i. lative Code in that it is "a building or
portion thereof which has st occupied for longer than one (1) year" and
during that period of tin� i h been either "unsecured", "boarded", or has
had "multiple exterior Housi g e or Building Code violations" or has been
"placarded as "Unfit for H n bitation" pursuant to Chapter 34 of the St.
Paul Legislative Code." �

6. That there are now and v been since June of 1987, multiple exterior
Housing Code or Building Code vi la ions in existence at the Subject Property.
7. That the owners, intere t parties and responsible parties of this
house are as previously stated ' t is resolution. These individuals have been
properly served notice of the il 25, 1989 hearing concerning this house.
8. That on December 13, 1 88 n Abandoned Building Notice was sent to the
owners, interested parties and es nsible parties ordering these persons to
either demolish the house or ma e epairs and correct the list of deficiencies
by February 8, 1989.
9. That the order of Dec 13, 1988 has been disregarded by the
owners, interested parties and es nsible parties.
10. That the two story, w rame, single family house located on the
Subject Property is a nuisance s efined under Saint Paul Legislative Code
Section 45.02, Subd. 11, in tha i is an abandoned building located in the
City of Saint Paul that has cr t a dangerous or unhealthy condition or which
threatens the public peace, hea th safety or sanitary condition of the City or
which is offensive or has a bli ht'ng influence on the conmunity.
11. That the costs of aba t of this nuisance are estim�ated to exceed
two thousand dollars ($2,000.0 ) the abatement involves demolition of a
building other than a structur a essory to a residential building.
ORDER
The Saint Paul City Counc 1 ereby makes the following order:
1. The above referenced rs, interested parties and responsible
parties and their assigns shal ke the Subject Property safe and not
detrimental to the public peac , ealth, safety, and welfare and remove its
blighting influence on the c ty by rehabilitating this house and
correcting those deficiencies et forth in the list previously referenced in
accordance with all a�licable c es and ordinances, or in the alternative by
demolishing the house and fill�ng the site in accordance with all a�licable
codes and ordinances. The re bi itation or demolition of the house must be
completed within thirty (30) ys of the date of mailing of this resolution.
2. If the above correct' e ction is not completed within the thirty (30)
day time period, the proper C� y fficials of the City of Saint Paul are hereby
authorized to take whatever s e are necessary to demolish this house and fill
the site and charge the costs in red against the S�.ibject Property p�zrsuant to
the provisions of Section 45. 8 f the Saint Paul Legislative Code.

and potential hazard to the neig hood, it is the recomnendation of the
Division that the City Council ss a resolution ordering the owners,
interested parties and responsib e rties to either repair or demolish the
building in a ti.mely manner to t e atisfaction of the City.
In the event the owners, interes ed parties or responsible parties fail to
comply with the Council Resoluti n, the Division of Public Health should be
authorized to demolish the build'ng and assess all costs incurred in the
demolition against the real esta s a special assessment to be collected in
the same manner as taxes.
