WHEREAS, as a resul o these amendments, the original petitioner, Tobin-Smith, I c. its successors and assigns, was obligated to construct a 25 00 square foot shopping center on or before 1985, on the souther y 00 feet of the property adjoining vacated Clarence; and WHEREAS, Tobin-Smith, I c. has failed to construct the 25,000 square foot shopping ce ter as agreed in condition number two; and WHEREAS, the followin described property (hereinafter referred to as the "Subjec roperty") , a portion of which is subject to above referenced c ndition number two, is being sold to a r9innesota general part e ship known as the I94 Highway 61 Eastview Center Partnershi .
