WHEREAS, that on Febr a y 19, 1957 , the Council of the City
of Saint Paul by resoluti n 181541 vacated land in the City of
Saint Paul described as fo 1 ws:

WHEREAS, condition n m er two of this resolution required
the petitioner, its succes o s and assigns to submit proper plans
and specifications fon c �onstruction of a conventional
shopping center over an ar a adjoining vacated Clarence which is
described as follows :
That said peti i ner or its succcessors and
assigns, shall , i hin the period of three years
from and after he effective date of this
resolution, subm ' t to the City architect proper
plans and specifi a ions prepared by a professional
architect duly e istered under the laws of the
State of Minneso a retained and paid therefor by
said petitioner o ' ts successors and assigns, for
the erection of a conventional shopping center
covering a land a ea of at least 60,000 square
feet, exclusive f automobile parking area, at a
cost of at least $ 50,000, and incorporating, in
addition to provi i ns for the requisite buildings,
facilities and ap u tenances, additional provisions
for the develo m nt and establishment of an
automobile parki g area for use in conjunction
therewith, all t e located in and upon and, to
constitute de e opments and improvements

above provided to be vacated, being real estate
situated in the ity of Saint Paul, County of
Ramsey, State o innesota; that said plans and
specifications sh 1 be subject to the approval of
said City arc i ect and shall be entirely
comformable to t e applicable requirements of the
Building Code an ther applicable ordinances of
the City of Saint P ul, and to all applicable State
and Federal stat tes and rules and regulations of
public authority ha ing cognizance; and that said
petitioner or its su cessors and assigns shall , at
its or their ow s parate costs and expense, in
strict accorda ce with said plans and
specifications, s he same shall be approved by
said City archite t, construct, erect and complete
said development nd improvements and said shopping
center and said a to obile parking area in and upon
said real estate wi hin the period of five years
next succeeding t e effective date of this
resolution.
WHEREAS, since the e fective date of this original
resolution, at the reque t of the owner and due to various
factors including the co s ruction of a 35,000 square foot
shopping center on the nor h 300 feet of the property adjoining
vacated Clarence, the Sain aul City Council has amended above
condition number two on th e separate occasions in resolutions
numbered 181930 , 270318 a d 204241, the last amendment taking
place on January 4, 1978 .
WHEREAS, as a resul o these amendments, the original
petitioner, Tobin-Smith, I c. its successors and assigns, was
obligated to construct a 25 00 square foot shopping center on or
before 1985, on the souther y 00 feet of the property adjoining
vacated Clarence; and
WHEREAS, Tobin-Smith, I c. has failed to construct the
25,000 square foot shopping ce ter as agreed in condition number
two; and
WHEREAS, the followin described property (hereinafter
referred to as the "Subjec roperty") , a portion of which is
subject to above referenced c ndition number two, is being sold
to a r9innesota general part e ship known as the I94 Highway 61
Eastview Center Partnershi . The legal description of the
Subject Property is as follo s:

Subject Property; and
WHEREAS , Title Insur n e Company of Minnesota has taken
egception to the title of h Subject Property due to condition
number two of resolution 81541 and amendments by resolutions
181930, 270318 and 204241 ; nd
WHEREAS , recognizing t at it has been more than thirty years
since the original vacation re olution, and there are now zoning
and land-use codes in e fe t that will assure reasonable
development and use of the Su ject Propert�, the �Taluation and
Assessment Division recomm nd the deletion of condition number
two as amended, to clear ti le to the Subject Propert�; and
THEREFORE BE IT RESOL ED that the Council of the City of
Saint Paul hereby deletes c nd tion number two in resolution
