WE�REAS, the Division of Publ c ealth has requested the City Council
to hold a public hearing to consi r the advisability and necessity of the
correction or wrecking and re�nova o a two-story single family, fire
damaged, wood frame house which i 1 ated on property hereafter referred
to as the "Subject Property" c nl �own as 896 Marshall Avenue, Saint
Paul, Minnesota and legally descr as:
Lot 2 and the East /2 of Lot 3, Block 1, Brown's First
Addition to the Cit o St. Paul, Ramsey County, Minnesota.
Abstract property.

WE�EREAS, the Division of Publ c ealth has issued an order identified
as an "Abandoned Building Notice" da ed August 30, 1988 which is attached
and incorporated as part of this es lution by this reference. This order
was served on all owners, interes ed parties and responsible parties of
the Subject Property l�own to the e orcement officer. The notice and
order informed these parties that th two-story single family, fire
clarc�aged, wood frame house located on the Subject Property is an abandoned
building and a nuisance pursuant o ections 45.01, Subd. 1 and 45.02,
Subd. 11 of the Saint Paul Legisl ti e Code. The August 30, 1988 order
also had attached to it a list of de iciencies regarding the house on the
Subject Property, said list is at c ed and incorporated as part of this
resolution; and i

WHEREAS, the August 30, 19881or er infornied all owners, interested parties
and responsible parties that they' t either repair the structure on the
Subject Property by correcting th� 1 st of deficiencies or demolish the
structure, either action to take �la e by September 20, 1988.
WHEREAS, no action has been tak regarding com�liance with the August 30,
1988 notice and order, and as a r su t the Division of Public Health requested
that a public hearing be schedul� take place on Tuesday, February 28, 1989
for the City Council to consider e advisability and necessity of ordering the
correction of the nuisance condit on or in the alternative consider the
de�nolition and removal of this ho�.se and
WHE,REAS, the above reference� ers, interested parties and responsible
parties have been personally serv$d otice of the time and purpose of the
February 28, 1989 hearing before �he Council;
WHEREAS, a hearing was held f re the Saint Paul City Council on February
28, 1989 and all testimony and ev�de e was considered by the Council.
NOW THEREFORE, BE IT RESOLVEL�, t based t�c�n all of the testimony and
evidence presented at the Februaryl 28, 1989 hearing, the Saint Paul City
Council hereby adopts the followir�g 'ndings and Order concerning the house at
896 Marshall Avenwe:
1. That in October of 1985 t�e ouse located on the Subject Property was
determined to be vacant and open tp a cess. The house has remained vacant and
has been either open or boarded si�ce October of 1985.
2. That since October of 198� t e City of Saint Paul has on nim►erous
occasions issued orders to the own rs to make this house secure and not
accessible. On many occasions, be�au e of the inaction on the part of the
owners, the City has had to hire aipr vate contractor to make the house secure
and not open to access.
3. That the owners of the Sul�j t Property have repeatedly failed to
register and pay the vacant buildi�g ee for this structure as required by City
ordinance.
4. That there are now and haVe n since October of 1985, multiple
exterior Housing Code or Building (�od violations in existence at the Subject
Property. '
5. That the owners, interest�d rties and responsible parties of this
house are as previously stated in t}hi resolution. These individuals have been
properly served notice of the Febn�a 28, 1989 hearing concerning this house.
6. That on August 30, 1988 ar� ndoned Building Notice was sent to the
owners, interested parties or re si le parties ordering these persons to
either demolish the house or make pa�rs and cure the list of deficiencies by
September 20, 1988. ',

8. That the twoo-story single�, f 'ly, fire damaged, wood frame house
located on the Subject Property isian abandoned building under Section 45.01,
Subd. l, of the Saint Paul Legisla�iv Code in that it is "a building or
portion thereof which has stood unpcc ied for longer than one (1) year" and
during that period of time it has �ee either "unsecured", "boarded", or has
had "m�ltiple exterior Housing Cod� o Building Code violations".
9. That the two-story single�� f ' ly, fire damaged, wood frame house
located on the Subject Property isia uisance as defined under Saint Paul
Legislative Code Section 45.02, Sulbd. 11, in that it is an abandoned building
located in the City of Saint Paul i�ha has created a dangerous or unhealthy
condition or which threatens the p�bl c peace, health, safety or sanitary
condition of the City or which is �ff nsive or has a blighting influence on the
cammznity. �
10. That the costs of abatemer�t f this nuisance are estimated to exceed
two thousand dollars ($2,000.00) oN t abatement involves demolition of a
building other than a structure acc#es ry to a residential building.

The Saint Paul City Council he4r makes the follawing order:
1. The above referenced owner , 'nterested parties and responsible
parties and their assigns shall mak� t e Subject Property safe and not
detrimental to the public peace, he�lt , safety, and welfare and resnove its
blighting influence on the com�x�nit�� b rehabilitating this house and
correcting those deficiencies set f�rt in the list previously referenced in
accorclance with all applicable code$ a d ordinances, or in the alternative by
demolishing the house and filling t�e ite in accordance with all applicable
codes and ordinances. The rehabili�t on or demolition of the house must be
co�leted within thirty (30) days o t e date of mailing of this resolution.
2. If the above corrective aci��'io is not com�leted within the thirty t30)
day t�me period, the proper City of$ic'als of the City of Saint Paul are hereby
authorized to take whatever steps a�e ecessary to d�lish this house and fill
the site and charge the costs incur�ted gainst the Subject Property pursuant to
the provisions of Section 45.08 of i$he Saint Paul Legislative Code.
3. In the event the building s be d�nolished by the City of Saint
Paul, all personal property or fixt�e of any kind which shall unreasonably
interfere with the demolition and re�no 1 shall be removed from the building by
the owners, interested garties and rle nsible parties by the end of the thirty
(30> day t�me period. If the person�al roperty is not so removed, the City of
Saint Paul shall remove and dispose bf uch property and fixtures as is
provided by law.

one (1) year and which meet o e or more of the following criteria;
ta) unsecured, or (b) boar or tc) having multiple exterior
Housing Code or Building iolations, or !d) placarded as "Unfit
for Hiunan Habitation" pur t to Chapter 34 of the Saint Paul
Legislative Code."
The ordinance further states t t abandoned building is a nuisance and
it may be ordered torn dawn by he City.
NOTE: If you do not want to hav e City begin action to have the
building torn dawn, then the at c ed list of deficiencies must be
repaired or yau nuast tear the '1 ing down on or before SeptelnUer 20,
1988. �
Any repair or de�nolition must c leted in aocordance with all
applicable laws.

If the work is not ccxnpleted or if you have not torn the building dawn by
the above date, the Division of lic Health will refer this matter to
