WHEREAS, A criminal alle at ' on has been brought against
Saint Paul Police Officer Cha�les Lutchen for simple assault;
and �

WHEREAS, said complaint r se in the City of Saint Paul
and is therefore in the prose�u orial jurisdiction of the
City Attorney; and ,'

WHEREAS, The City Attorn�ey s Office cannot undertake the
prosecution of said complain� b reason of potential conflict;
and ;
WHEREAS, The City Counc�l as by virtue of City Charter
Section 5 . 02 the authority t� r tain a special prosecutor at
the request of the City Atto�ne and further has the authority
to fix or set the compensati n to be paid, now; therefore be it

RESOLVED, That Thomas R ughes is hereby appointed to be
the special prosecutor for s i case against Charles Lutchen,
and; be it
FURTHER RESOLVED, That �h fee for such services be $95 . 00
per hour.
