Ms. Hill denied any authority over the property. She further stated her mother, Betty Heinl, had an attorney named Ma.rie Hitchcock to handle her affairs; and WHEREAS, on March 1, 1991, the Division of Public Health contacted Ma.rie Hitchcock by telephone. Ms. Hitchcock stated that Betty Heinl was dead and that she (Ms. Hitchcock) was holding the deed and abstract for 104 York Avenue because back taxes are owed, the deed cannot be filed; and WHEREA3, on March 4, 1991, the Division of Public Health reinspected the structure at 104 York Avenue after receiving a complaint of a second and more Severe fire. The structure was open to trespass, severely fire damaged throughout and an imminent hazard; and WHEREA$, Richard A. Thompson, Senior Building Inspector with the Building • Inspection and Design Division, City of Saint Paul, inspected the structure on Ma.r�h 4, 1991 with Steven Roy and Dennis Senty of the Division of Public Health. Said structure constitutes an immediate danger and if not imn�ediately abated will endanger the health and safety of the public. All costts for the removal of the dangerous structure shall be assessed agains� the property taxes pursuant to the Saint Paul Legislative Code Sectiou 45.12 Emergency Abatement Procedure; and WHEREAS, the fee owners listed on the Ramsey County Property Taxation Record are Gerald J. and Betty J. Heinl, 104 York Avenue, Saint Paul, MN; and WHEREAS, on September 13, 1990, the Division of Public Health contacted Suzanne Hill by telephone at 739-5561. Ms. Hill confirmed that she was Betty Heinl's daughter and further stated that Betty Heinl is deceased and left no will; and • WHEREAS, on November 29, 1990, the Division of Public Health contacted, by telephone, the Ramsey County Probate Court and was told by that court that no attempt to probate Betty Heinl's estate had been made as of that day; and WHEREAS, on February 22, 1991, 104 York was inspected by the Division of Public Health because of a complaint filed on February 21, 1991 that a fire had occurred at the property. The inspection found the property to be open to trespass and some fire damage to the second floor. WHEREAS, on February 26, 1991, the Division of Public Health was contacted by telephone by Ms. Suzanne Hill. The photographs show a very dangerous condit�on which immediately threatens the safety of the public; and WHEREAS, Section 45.12 of the Saint Paul Legislative Code grants the City the au�hority to immediately abate any nuisance which exists on a property and co�stitutes an immediate danger or hazard which if not immediately abated will endanger the health or safety of the public and there does not exist �ufficient time to follow the procedures of Sections 45.10 or 45.11; therefqre be it ORDEREl�, that the City of Saint Paul through it's Mayor approves the immedi�te wrecking and removal of the dangerous structure at 104 York • Avenue.
