The meeting was called to order by Vice President Wilson at 5:00 P.M.
Present - 4- Councilmembers Guerin, Long, Rettman, Thune
Absent - 3- Councilmembers Grimm (arrived later in meeting), Maccabee, Wilson
(excused)
Councilmember Thune said items # 9, 10 and 11 do not need to go to Committee as
they are housekeeping items and moved approval.
Assistant City Clerk Swanson said items # 3 and 4 are on in error.
Councilmember Long moved approval as amended.

3. Letter of the City Attorney announcing a date of Public Hearing on July 20, 1993 before an
Administrative Law Judge pertaining to adverse action against licenses held by Michael

PUBLIC HEARINGS:
12. Third Reading - 93-869 - An ordinance amending Chapter 60 of the Legislative code
regarding rezoning of property at 270 Sherburne Avenue.
No one appeared in opposition.
Councilmember Thune moved to close the Public Hearing.

13. Public Hearing to consider an appeal by the Thomas Dale Block Ciub to a Planning
Commission decision granting reestablishment of a nonconforming use permit to allow a
grocery store at 440 Thomas Avenue.
Kady Dadlez, PED reviewed the staff report.
Liz Stevens, Legislative Aide to Council President Wilson said she was at Council today to
answer any questions of Councilmembers or address the concerns of neighborhood
residents.
Barbara Lammers, President of the Thomas Dale Block Club said they were opposed to the
decision as a grocery store was not an appropriate business for the area because it was
too close to the school and children would be running back and forth across the busy
street.
Ms. Cindrich, 595 Arundel said she has lived in her home for 25 years and she was
opposed to a grocery store being located next to her house. She said the previous owner
printed a Polish newspaper in the building and delivered it to churches and no extra traffic
was generated. Ms. Cindrich said a grocery store would create traffic and parking
problems and cause littering in the neighborhood.
Cheryl Nichols, a resident, said there is limited parking on the street in front of the proposed
store and locating the business here would cause parking problems for neighborhood
residents.
Pearl Marshall, 482 Thomas opposed the nonconforming use as she is concerned about
the safety of the children from the neighborhood and from the school if a grocery store
were allowed to locate in a residential neighborhood.
�cky Juaire, 477 Charles said there is no need for anymore grocery stores in this area.
as there are two grocery stores within a six block distance ftom the proposed store.
Sally Herbst, 391 Thomas Avenue added that a grocery store would add litter to the
neighborhood because of the number of children who would be buying candy bars, etc in
the store and throwing papers outside.
A resident from 589 Arundel reiterated the problems of traffic and litter that would be caused
by having a grocery store at the location. She encouraged Councilmembers to grant the
appeal of the Thomas Dale Block Club and help residents keep their neighborhoods clean.
John Kelnberger, Lentsch Realtors said there is no clear title at this point. He said there
are back taxes due and liens against the owner of the property. Mr. Kelnberger answered
questions of Councilmembers and said they have not had a lot of interest to purchase the
property besides the potential grocery store owner.
Johnny Howard, 689 N. Dale from the Thomas Dale Block Club spoke in opposition to
establishing a grocery store at this location.
After further questions among Councilmembers, Councilmember Long moved to close the
Public Hearing.

Terry Sullivan, City Attorney's Office reviewed the procedure to establish a Non Conforming
Use Permit and answered questions from Councilmembers.
After further discussion, Councilmember Long moved to lay over the item one week.
