Minutes 08-26-1993 SUMMARY MINUTES OF THE SAINT PAUL CITY COUNCIL Thursday, August 26, 1993 . . 5:00 P.M. Councii Chambers Third Floor City Hail and Court House Saint Paul, Minnesota The meeting was called to order by President �Ison at 5:05 P. M. Present - 4- Councilmembers Guerin, Maccabee, Rettman, Wilson Absent - 3- Councilmembers Grimm, Thune (both arrived during discussion of the Conserrt Agenda), Long (arrived during Award Ceremony and left before the Consent Agenda vote to attend a Charter Commission meeting) MISCELLANEOUS: 14. Youth Volunteer of the Month Award Ceremony. Councilmembers Rettman, Guerin, Maccabee and Grimm introduced youth volurrteers from North Dale, Margaret, Merriam Park and Phalen Recreation Centers and presented each with a gift certficate and a Parks & Recreation T Shirt. Councilmembers c:ongratulated the youth and their parents for the hours of volunteer - work they have corrtributed to the City Recxeation Cerrters. 13.�=: Discussion of Mayor Scheibel's vetoes of C.F. 93-1014, 93-1088 and 93-1089 regarding appeals concerning Saint Paul's Church Home expansion. (Laid over from August 19th) Council Presiderrt wlson summarized the Mayor's vetoes of the three appeals. After a brief discussion, Councilmember Thune moved to override the vetoes. ;- Adopted Yeas - 5 Nays - 1(Guerin) (Long absent) ADDITIONAL ITEM: 2. Letter from Mayor Scheibel vetoing C.F. 93-1027 regarding the retiree insurance plan for the Saint Paul Police Federation. (laid over from August 24, 1993) Councilmember Guerin moved to override the Mayor's veto. Adopted Yeas - 6 Nays - 0(Long absent) 12. Report of the Administrative Law Judge including Findings of Fact, Conctusions and recommendations in the matter of the application of Sairrt Paul Firearms Company for a Firearms Dealer's Ucense at 634 N. Snelling Avenue. (Laid over from August 19th) Council Presiderrt Wilson reviewed the past week of negotiations. Councilmember Maccabee asked for an extension of lay over to allow negotiations to be completed. Claims of Custard Insurance Adjusters, Inc. (Timothy & Marie Sandell), Dennis Cahill, and Maria Food Market Corporation. Referred to the City Attorney's Office. 2. : Appeal of Jeffrey Boston dba BHCS Inc, to a Summary Abatement Order for property at 144 N. Lexington Parkway. (City Clerk's Office recommends date of Public Hearing before the Neighborhood Services Committee for September 15th and before the City Council on September 23, 1993). ;; 3. Resolution - 93-1203 - approving an application for an On Sale Wine, On Sale Male (3.2), and Restaurant-B License by Mama's Pizza at 961 Rice Street. (Laid over from August 19th for adoption) Adopted Yeas - 6 Nays - 0 4. Resolution - 93-1204 -. approving applications for renewal of various Class III Licenses by: Murray's Motorcar Co. Ltd., Apcoa, Inc., Payne Avenue Auto Sales, American Auto Radiator, T& L Custom, Watergate Marina, Donald Keefe and Lloyd's Automotive. (Laid over from August 19th for adoption) Adopted Yeas - 6 Nays - 0 5. Resolution Approving Assessment - 93-1247 - In the Matter of improving Hazel Street from Jessamine to Magnolia by constructing a sanitary sewer and senrice connections and setting date of Public Hearing for October 12, 1993. Adopted Yeas - 6 Nays - 0 6. a Resolution Approving Assessment - 93-1248 - In the Matter of the installation of a sanitary sewer and connections in Winthrop Street from Larpenteur to Idaho and setting date of Public Hearing for October 12, 1993. Resolution Approving Assessment - 93-1249 - in the Matter of the installation of a water main and connections in �nthrop Street from Larperrteur to Idaho and setting date of Pubiic Hearing for October 12, 1993. Adopted Yeas - 6 Nays - 0 ORDINANCES 8. Second Reading - 93-1208 - An ordinance regarding Chapter 33 of the Administrative Code entitled "Reimbursement for Car Expenses" to provide reimbursemerrt to oificers and employees for the use of their motorcydes while on official City business. (For Action) Laid over until August 31 st for Third Reading/Public Hearing. PUBLIC HEARINGS: 9. Resolution - 93-1250 - approving the transfer of a General Repair Garage License from Robert Larson dba Precision Tune at 874 E. Maryland Avenue to Palen Automotive Inc. dba Precision Tune at the same address. No one appeared in opposition. Councilmember Thune moved approval. Adopted Yeas - 6 Nays - 0 - Councilmember Guerin left the meeting at this time and returned later. 10. Public Hearing to consider the modification of Parking Requirements for Michael Egi dba African Errtertainment Center at 1058 University Avenue. "�`Frank Staffenson, License Division said the applicarrt has withdrawn his application for a license because of neighborhood opposition. Uz Stevens, Aide to Council PresideM Wilson said the neighborhood residents were in opposition and the applicant said he did not want to locate his business where there was so much neighborhood opposition. After a brief discussion, Councilmember Maccabee moved approval to withdraw items # 10 and # 11. Roll Call Yeas - 5 Nays - 0 WITHDRAWN 11. Resolution - 93-1178 - approving an application for an On Sale Liquor-C, and Entertainment I11 Ucense by Richard Olawole & Michael Egi dba African Entertainment Cerrter at 1058 W. University Avenue. (Laid over following recall from indefinite lay over on August 19th) (See discussion with item # 10) Roll Call Yeas - 5 Nays - 0 WITHDRAWN 491 August 26, 1993 Councilmember Guerin returned to the meeting at this point. ADDITIONAL ITEMS: PUBLIC HEARING: 1. Continuation of Third Reading Ordinance - 93-1177 - approving amendments to the Human Rights Ordinance - Chapter 183 of the Legislative Code. (For Action - referred to the Human Services, Health & Business Regulations Committee on August 12th with readings to continue - laid over from August 24, 1993) Councilmember Maccabee moved to suspend the rules to recall from Committee the substitute ordinance. Adopted Substitute Yeas - 6 Nays - 0 Laid over until September 2nd for Final Adoption. Councilmember Thune moved to suspend the rules to irrtroduce the following resolution. Adopted Yeas - 6 Nays - 0 ,� Resolution - 93-1289 - approving an application for the renewal of a Class III gambling premise permit by Rumour's Bar, 490 N. Adopted Yeas - 6 Nays - 0 Resolution - 93-1288 - approving an application for a new State Class B Gambling Premise Permit by Charles Buzicky on behalf of Catholic Parents Club at Kelly Inn/Legends, 161 St. Anthony Avenue.
