Minutes 09-16-1993 SUMMARY MINUTES OF THE SAtNT PAUL CITY COUNCIL Thursday, September 16, 1993 5:00 P.M. ROOM 330 CITY HALL (TEMPORARY COUNCIL) Third Fioor City Hail and Court House Saint Paul, Minnesota The meeting was called to order by President Wilson at 5:05 P.M. Present - 6- Councilmembers Grimm, Guerin, Long, Rettman, Thune, Wilson Absent - 1 - Councilmember Maccabee (excused) Councilmember Rettman moved approval of the Consent Agenda. Adopted Yeas - 6 Nays - 0 CONSENT AGENDA FOR ACTION 1. Claims of Rosemarie Anderson, Martin Dekker, Terry John Elert, Ann Elkhatib, Timothy L. Nett and Peter David Rieke. Referred to the City Attorney's Office. 2. Notice of Motion & Motion of the American Family Mutual Insurance Co. vs William Staeheli, � David Stahley, Grace W. Lai and Charles W. Lai. = Referred to the City Attorney's Office. 3. Resolution - 93-1364 - approving applications for renewal of various On Sale Wine and Supporting Licenses by: Mirror of Korea Restaurant, Tulips Restaurant, Phalen Park Hall and the Green Mi�l Inn. (To be laid over one week for adoption) Laid over until September 23rd. 4. Resolution - 93-1365 - approving payment of $15,000 from the Tort Liability Fund to Judith E. Resolution - 93-1366 - authorizing the Department of Fire & Safety Services to accept a donation of 40 smoke detectors from the Fire Marshal's Association of Minnesota. Adopted Yeas - 6 Nays - 0 6. Preliminary Order - 93-1367 - In the Matter of construction the Albert/Eleanor Area Storm -� Sewer Separation Project and setting date of Public Hearing for November 16, 1993. Preliminary Order - 93-1368 - In the Matter of constructing sanitary sewer, storm sewer and/or water service connections, if requested by the property owner, for the Albert/Eleanor Area Storm Sewer and Street Paving and Lighting Projects and setting date of Public Hearing for November 16, 1993. Preliminary Order - 93-1369 - In the Matter of improving streets with a new bituminous surfaced roadway, concrete curb & gutters, and a Iantern style street lighting system in conjunction with the Albert/Eleanor Area Street Paving and Lighting Project and setting date of Public Hearing for November 16, 1993. Adopted Yeas - 6 Nays - 0 COMMITTEE REFERRAL: 9. Resolution - 93-1370 - establishing a sales tax fund and providing for the use of sums therein to pay Civic Center costs. (Finance) Referred to the Finance Committee. 10. Resolution - 93-1371 - appointing Linda Camp Director of Finance and Management Services. (Finance) Referred to the Finance Committee. ORDINANCES 11. First Reading - 93-1372 - An ordinance amending ordinance # 13534, approved January 21, 1967, removing Dayton Avenue from Summit to Dale and Marshall Avenue from Western to Dale as "One-Way" streets pursuant to section 147.01 of the Legislative Code. (Public Works) Referred to the Public Works Committee. COMMITTEE REPORTS: 12. Administrative Order D-12521 - authorizing payment of $500 to pay various individuals for = services or supplies provided for the aging workshop being presented at the Jehovah Lutheran Church. (Finance Committee requested that the Director of Public Health amend the green sheet) Councilmember Rettman said the Public Health Director was reviewing the green sheet and would be submitting to the City Clerk's Office. Request adopted Yeas - 6 Nays - 0 529 September 16, 1993 13. Resolution - 93-1064 - approving the proposed wage and benefit package for non- represented Management Personnel. (Finance Committee submits to Council without recommendation)] Councilmember Rettman requested this item be laid over until the next meeting because Councilmember Maccabee was absent because of a religious holy day and had wanted to speak to the matter. Roll Call Yeas - 6 Nays - 0 Laid over until September 21 st. 14. Resolution -93-1174 - amending the 1993 Budget by transferring spending and financing authority from General Government Accounts Municipal memberships to Executive Administration for Sister Cities Project and to the Human Rights Department for development of a Bias Crimes Prevention Campaign. (Finance Committee recommends approval) Adopted Yeas - 6 Nays - 0 15. Resolution - 93-1205 - requesting financial data and a recommendation from the Mayor regarding granting of pension benefits to Saint Paul firefighters who were hired prior to July i, 1980. (Finance Committee recommends approval as amended) Councilmember Rettman requested this item be laid over week because Councilmember Maccabee was absent because of a religious holiday and had wanted to speak on the matter. Councilmember Guerin said if they were going to lay matters over because of a Councilmember's absence, the meeting should have been cancelled. Council President �Ison said he checked with representatives of the Council of Rabbis and that cancellation of City meetings should come at the request of religious leaders not elected officials. He recommended the Council seek the advise of religious leaders to determine if City meetings should be cancelled and for what religious holy days. Councilmember Long spoke in favor of cancelling the meeting on Rosh Hashanah and agreed further investigation was appropriate. After a brief discussion among Councilmembers on this issue moved to lay over the item until Tuesday. Roll Call Yeas - 6 Nays - 0 Laid over until September 21 st. Councilmember Guerin left the meeting at this point and did not return. Councilmember Thune moved to suspend the rules to introduce the following resolutions. Adopted Yeas - 5 Nays - 0 Resolution - 93-1392 - approving an application for an Off Sale Liquor (a), Sunday on Sale Liquor, Entertainment-III, and Restaurant(D) License by F& B Services Inc. dba Heartthrob Cafe as 30 E. 8th Street. Councilmember Thune moved approval. Adopted Yeas - 5 Nays - 0 530 September 16, 1993 Resolution Approving Assessment - 93-1393 - In the Matter of the Goodrich/Smith Area Storm Sewer Project and setting date of Public Hearing for October 12, 1993. Councilmember Thune moved approval. Adopted Yeas - 5 Nays - 0 Resolution Approving Assessment - 93-1394 - In the Matter of the Goodrich Smith Area Street Paving and Lighting Project and setting date of Public Hearing for October 12, 1993. Councilmember Thune moved approval. Adopted Yeas - 5 Nays - 0 Resolution Approving Assessment - 93-1395 - In the Matter of the City Hall Court House Streetscape Project and setting date of Public Hearing for October 12, 1993. Councilmember Thune moved approval. Adopted Yeas - 5 Nays - 0 Councilmembers announced various locations and dates of neighborhood festivals and events this weekend.
