Councilmember Long moved approval of the Consent Agenda as amended. Adopted Yeas - 7 Nays - 0 CONSENT AGENDA FOR ACTION 1. Approval of minutes from the October 5 and 7, 1993 Council meetings. Resolution - 93-1653 - amending the 1993 Budget of Parks and Recreation by accepting a two year grant of $91,000 from the State of Minnesota for the continuation of a program at Crosby Farm Park. . Preliminary Order - 93-1654 - In the Matter of installation of a public water main and water service connections in �nthrop Lane from Burlington Road to approximately 400' north of Burlington Road and in �nthrop Court from Winthrop Lane to the cul-de-sac and setting date of Public Hearing for December 14, 1993. Resolution Approving Assessment - 93-1655 - In the Matter of boarding up of vacant buildings for July and August, 1993; demolition of vacant buildings for July, August & September,1993; collecting administrative charges incurred by Health Department nat�fying _ properly owner to repair or demolish buildings; and Summary Abatements (property clean- up) for Summer and Fall of 1993 and setting d�te of Public Hearing for December 7, 1993. (Public Works) Referred to the Public Works Committee. ********************�*********************************************************** MISCELLANEOUS: 19. Youth Volunteer of the Month Award Ceremony. Councilmembers Rettman, Long and Grimm made presentations to volunteers from North End, Mac-Groveland, Hazel Park Recreation Center and the Youth Fund Advisory Board. Each Councilmember thanked the volunteers from their Wards and presented them with a gift. Councilmember Maccabee left the meeting at this point. 4. Resolution - 93-1651 - approving settlemerrt of $105,000 ftom the Tort Liability Fund to Mark A. Baloga in settlement of his claim against the City and Paula Maccabee. Sharon Anderson spoke against paying the claim and denounced Councilmembers who were supporting the payment. Ms. Anderson alleged the Council has no capacity or legal authority to pay this claim from taxpayers funds. Councilmember Thune moved approvaL Adopted Yeas - 5 Nays - 1(Rettman) 635 November 4, 1993 Council President �Ison said the Council needs to amend the process for reporting and investigating harassment cases. Councilmember Long said settlement was the least expensive alternative at this time and suggested State Law be amended to provide for mediation in cases like this. A brief discussion ensued among Councilmembers regarding harassment claims against the City. Councilmember Grimm left the meeting and retumed during discussion of the fotlowing item. Councilmember Maccabee returned to the meeting at this point. ORDINANCES: 11. Final Adoption - 93-906 - An ordinance amending the Zoning Code governing infectious waste uses. (substitute submitted October 26th - Public Hearing held October 28th) Councilmember Maccabee moved approval. Adopted Yeas - 7 Nays - 0 12. Second Reading - 93-1650 - An ordinance to amend the license fee schedule in Chapter 310 of the Legislative Code increasing license fees by 29� in conjunction with an estimates 2% increase in enforcement costs for 1994. (For Action) Laid over until November 9th for Third Reading/Public Hearing. 13. Second Reading - 93-1436 - An ordinance amending Chapter 331 of the Legislative Code relating to the operation of food shelves. (Human Services, Health and Business Regulation Committee recommends approval as amended) Laid over until November 9th for Third Reading/Public Hearing. COMMITTEE REPORTS: 14. Resolution - 93-1658 - supporting recommendations of the Ramsey Cour�ty League of Local Governments as outlined in its Action Plan for Gun �oience Preverrtion and inctuding these recommendations in the City's 1994 Legislative Package. (Intergovernmerrtal Refation and Public Safety Committee recommends approval - origina#ed in Committee - to be laid over one week for adoption) Councilmember Rettman questioned the impact of items on page 3. Resolution - 93-1659 - approving an application for renewal of a State Currency Exchange License at 981 Payne Avenue. No one appeared in opposition. Councilmember Grimm moved approval. Adopted Yeas - 7 Nays - 0 16. Resolution - 93-1660 - approving an application for a Massage Therapist License by Kathryn D. Erickson at 400 Selby Avenue. No one appeared in opposition. Councilmember Thune moved approval. Adopted Yeas - 7 Nays - 0 17. Resolution - 93-1661 - approving an application for a Massage Therapist License by DeeAnna Langley at 2221 Ford Parkway. No one appeared in opposition. Councilmember Long moved approval. . Adopted Yeas - 7 Nays - 0 18. Resolution - 93-1662 - approving an application for a Massage Therapist License by Carol A. Rendahl at 400 Selby Avenue. No one appeared in opposition. Councilmember Thune moved approval. Adopted Yeas - 7 Nays - 0 ADDITIONAL ITEM: 1. Resolution - 93-1663 - approving an agresment between the Saint Paul Police Department, the City of Minneapolis and the Minnesota Department of Public Safety to create an after- hire professional police officer academic/skills training program. (laid over from November 2, 1993) Chief of Police �Iliam Finney reviewed the program and answered questions of Councilmembers. A brief discussion ensued among Councilmembers regarding trainees and the salaries paid for these positions in relation to neighboring communities. Councilmember Maccabee moved to amend the resolution to include a review period at the end of one year as suggested by the Budget Director and moved approval as amended. Adopted Yeas - 7 Nays - 0 637 November 4, 1993 Councilmember Thune moved to suspend the rules to recali C.F. 93-1587 from the Public � Works Committee. Resolution - 93-1587 - Replacing the policy of charging the market value of the City's interest in vacations of street and alley rights-of-way with a policy of charging only an administrative fee to cover the administrative costs of such vacations. Councilmember Thune moved approval. Adopted Yeas - 7 Nays - 0 Councilmember Long moved to suspend the rules to reca0 the following resolution from the Public Works Committee for adoption. Adopted Yeas - 7 Nays - 0 Resolution - 93-1183 - considering the petition of HaLu and tCeu Dang to vacate Theresa Place between St. Paul Avenue and Howell Avenue. Councilmember Long moved approval as amended. Adopted Yeas - 7 Nays - 0 Councilmember Thune moved to suspend the rules to introduce the following resolution. Adopted Yeas - 7 Nays - 0 Resolution - 93-1687 - approving an application for a Sunday On Sale Liquor License by McColl Limited P�artnership & Rudolph's St. Pauf Inc. dba Rudolph's Bar-B-Que at 366 Jackson .Street. Councilmember Thune moved approval. Adopted Yeas - 7 Nays - 0 Resolution - 93-1688 - establishing the rate of pay and benefits for the unclassified Councilmember-Secretary positions. Councilmember Rettman moved to lay over this item until the Third Reading/Pubtic Hearing -:of the two ordinances. Roll Call Yeas - 7 Nays - 0 Laid over until November 18th. First Reading - 93-1689 - An ordinance establishing seven positions entitled Councilmember Secretary as specfied by Chapter 12 of the Charter of the City of Saint Paul, Section 12.03.2(H) thereof. Laid over until November 16th for Second Reading. 638 November 4, 1993 First Reading - 93-1690 - An ordinance amending section 32.01 of the Administrative Code defining compensation and benefits provided to Councilmembers and the Mayor. Laid over until November 16th for Second Reading. Councilmember Long moved to suspend the rules to introduce the following resolution. Adopted Yeas - 7 Nays - 0 Resolution - 93-1691 - granting approval to continue the process of considering consolidation of the Saint Paul Police Department Relief Association with Public Employees Retirement Association. Council President Wilson criticized the administration for making commitments, which could have affected the consolidation vote without Council approval. He asked the City Attorney's Office to present any written opinions regarding the premium pay. Councilmember Long moved to lay over the item until the next meeting. Roll Call Yeas - 7 Nays - 0 Laid over until November 9th. � Council President Wilson asked if Chuck Votel, Health Department, was present with a :>. resolution regarding 769-71 University Avenue. President Wilson gave a brief summary of n the issue and said this may have to come before the Council at their next meeting. Councilmember Rettman moved to suspend the rules to introduce the following resolution. Adopted Yeas - 7 Nays - 0 Resolution - 93-1692 - approving an amendment to the Joint Powers Agreement between the City and County authorizing the County to appropriate interest income to reduce the County's debt service tax levy in 1994. Councilmember Rettman moved to lay over the item until the next meeting. Roll Call Yeas - 7 Nays - 0 Laid over until November 9th. Councilmembers Grimm and Long left the meeting at this point and did not return. Councifinember Guerin moved to suspend the rules to introduce the following ordinance. Adopted Yeas - 5 Nays - 0 First Reading - 93-1693 - An ordinance amending Ordinance No. 13534 approved January 31, 1967 which designated Dayton Avenue from Dale to Victoria and Marshall Avenue from Dale to Victoria as one way streets and which will allow the streets to revert to two way.
