Minutes 11-18-1993 SUMMARY MINUTES OF THE SAINT PAUL CITY COUNCIL Thursday, November 18, 1993 5:00 P.M. City Hall and Court House (Temporary Council Chambers) Third Floor City Hall and Court House Saint Paul, Minnesota The meeting was called to order by President Wilson at 5:05 P.M. Present - 4- Councilmembers Guerin, Rettman, Thune, Wilson Absent - 3- Councilmember Grimm (arrived later), Long (arrived later), Maccabee Councilmember Rettman moved approval of the Conserrt Agenda. Adopted Yeas - 4 Nays - 0 CONSENT AGENDA FOR ACTION 1. �Letter of the Ramsey County Department of Taxation transmitting application AY-93-0957 for reduction of assessed valuation of real estate at 965 Arcade Street. (Real Estate Division recommends approval) c c# 13794 2. Appeal of Earline Coleman to a Summary Abatement Order for property at 721 St. Anthony. (City Clerk's OfFce recommends date of Public Hearing before the Neighborhood Services Committee for December 1 st and before the City Council on December 9, 1993) 3. Appeal of Jay J. Reiling to a Summary Abatement Order for property at 585 Sherburne Avenue. (City Clerk's Office recommends date of Public Hearing before the Neighborhood Services Committee for December 1 st and before the City Council on December 9, 1993) ORDINANCES 4. Second Reading - 93-1591 - An ordinance to amend Sections 409.22 and 409.24 concerning allowable compensation for charitable gambling employees and managers. (Human Services Committee referred to Council without recommendation due to lack of a quorum) �•.Councilmember Thune moved approval of a substitute ordinance and explained the changes where needed to conform to Federal Law. Adopted Yeas - 4 Nays - 0 Laid over until November 23rd for Third Reading/Public Hearing. 665 November 18, 1993 5. First Reading - 93-1733 - An ordinance to enact Chapter 380 of the Legislative Code ' establishing the licensure of tanning facilities. (Human Senrices Committee recommended approval - Originated in Committee) Laid over until November 30th for Second Reading. Councilmembers Grimm and Long arrived at the meeting at this point. COMMITTEE REPORTS: 6. Discussion of enforcement regarding sales of guns to jweniles. (Human Services, Health & Business Regulations Committee requested staff conduct enforcement measures to prevent gun sales in minors) c c# 13795 Councilmember Rettman moved to lay over the discussion for one week. Roll Call Yeas - 6 Nays - 0 Laid over until November 30th. . Councilmember Maccabee arrived at this meeting at this point. 7. Resolution - 93-1734 - approving a grant application to the Saint Paul Foundation errtitled "Asian Food Handler's Training Initiative". (Human Services, Health & Business Regulation Committee recommends approval - Originated in Committee) = Councilmember Long asked if all training monies were coming from grants and was � answered in the affirmative. Councilmember Rettman moved approval. }Adopted Yeas - 7 Nays - 0 8. :� Resolution - 93-1422 - appropriating general fund money for 1993 Neighborhood Crime ; Prevention Grant Program. (Human Services, Health 8� Business Regulation Committee recommends approval as amended) Councilmember Maccabee reviewed the technical amendmerrt recommended from the Human Services Committee and moved approval. Adopted Yeas - 7 Nays - 0 9. Resolution - 93-1586 - approving grant allocations for the 1993 Child Care Partnership Program. (Human Services, Health & Business Regulation Committee recommends approval as amended) Councilmember Maccabee moved approval as amended. Adopted Yeas - 7 Nays - 0 Councilmember Grimm left the meeting and retumed during the discussion of the following item. 666 November 18, 1993 � PUBLIC HEARINGS: 10. Third Reading - 93-1690 - An ordinance amending section 32.01 of the Administrative Code defining=compensation and benefits provided to the Mayor and City Council members. Jerry Strathman, CounciF Research submitted a substitute ordinance to Councilmembers and reviewed the changes that the Council had requested. Councilmember Maccabee said the information she requested had not been submitted by Mr. Strathman. She said if the benefits provide more money than needed to pay health benefits, then the dollars should be returned to the City and not added to Councilmembers salaries at the end of the year. Councilmember Guerin criticized the media coverage on this issue and spoke in favor of eliminating the health benefits. After further discussion, Councilmember Maccabee moved approval of the substitute ordinance. Adopted Yeas - 7 Nays - 0 ' Councilmember Maccabee left the meeting and returned during discussion of the following item. ,� Sharon Anderson spoke against the ordinance and said the Council was not acting according to the voters decision to make the Council part time at a$30,000 salary. Paul Johnston, 1741 Portland, thanked the Council for eliminating deferred comp benefits and spoke agains� the hiring of policy analysts. He c'rted a recent.:newspaper article on the growth of the CounciPs budget and staff. Mary Jane Rachner, Fred Sande and Scott Kraemer, 1824 Holly, spoke against the ordinance allocating any benefits to Councilmembers and steep increases in property taxes. Councilmember Rettman said the Council is cutting their budget by $250,000 -$3�,000. Discussion ensued among Councilmembers regarding the Council's proposed budget, reorganization plan and benefits. After a brief discussion, the matter was laid over until November 30th for final adoption. Laid over until November 30th for Final Adoption. 11. Third Reading- 93-1689 - An ordinance establishing seven positions entitled Councilmember-Secretary as specified by Chapter 12 of the Charter of the City of Saint Paul, Section 12.03.2(h). Tom Hennessy, 267 Lafayette Road, a representative of AFSME spoke against unclassification of the position of Councilmember Secretary. �'Louie Greengard, Trades & Labor Assembly said the Assembly voted to support AFSME's �� position and urged the Council to continue using classified secretaries. �:� Laid over until November 30th for Final Adoption. -� Councilmembers Guerin and Long left the meeting at this poirrt and did not return. . Councilmember Maccabee left the meeting and returned during the discussion of the following item. 667 November 18, 1993 12. Third Reading - 93-1693 �'-An ordinance amending Ordinance # 13534 approved January 31, 1967 which designated Dayton Avenue from Dale to �ctoria and Marshall Avenue from Dale to �ctoria as one way streets, which will alfow the streets to revert to two-way. A�' woman from the neighborhood spoke � in opposition to this ordinance and said neighborhood residents did not want to see the street revert back to a two way roadway and were not consulted about the proposal. She asked for a delay in the adoption of this ordinance so that the neighborhood block group could meet and discuss this matter. After a brief discussion with the woman, Council President proposed a one month delay. Councilmember Thune moved approval of a one month lay over. Roll Call Yeas - 5 Nays - 0 Laid over until December 16th for Final Adoption. 13. Resolution - 93-1 �35 - approving an application for a General Repair Garage License by Chong Thao dba Thao Inc. at 631 N. Dale Street. Douglas King, 750 Blair Avenue spoke in opposition to issuing the license � without stipulations and said there were many vehicles without proper licensing. He said that vehicles are illegally parked and asked that the License Division check on the storage of vehicles parked on the property. °�Councilmember Maccabee moved a two week layover to allow the License Division time to � inspect the properry. Roll Call Yeas - 5 Nays - 0 `�aid over until December 2nd. �;, . 14. ��Resolution - 93-t736 - approving an application for an Off Sale Liquor License by Elisabeth �Cogl dba Kappy's Liquor at 345 N. Wabasha Street. FNo one appeared in opposition. Councilmember Thune said the owner had agreed to restrictions on selling small bottles and moved approval. Adopted Yeas - 5 Nays - 0 15. Resolution - 93-1737 - to consider the level of service for the 1994 Street and Alley Maintenance Program. No one appeared in opposition. Councilmember Rettman commended Councilmember Thune and the Public Works Committee for developing a pro increase assessment proposal. Councilmember Thune spoke of the need to increase ticketing and towing during snow plowing and street cleaning. AI Shetka, Public Works Departmerrt questioned if the Counci� had the correct resolution. Councilrnember Thune moved approval. Adopted Yeas - 5 Nays - 0 668 November 18, 1993 16. Resolution - 93-1687 - In the Matter of the petition of the space Center Inc. for the vacation of Lafayette Road befinreen Grove Street and the new Lafayette Road. (Laid over from November 9th) No one appeared in opposition. Councilmember Thune said Public Works Committee recommended a two week layover. Roll Call Yeas - 5 Nays - 0 Laid over until December 2nd. MISCELLANEOUS: 17. Resolution • 93-1688 - establishing the rate of pay and fringe benefits for the unclassified positions entitled Councilmember-Secretary. (laid over from November 4th) (See discussion with item # 11) Laid over until November 30th. Councilmember Thune moved to suspend the rules to introduce the following resolution. Adopted , Yeas - 5 Nays - 0 SResolution -93-1772 - rescinding Council selection of a grade-separated Shepard : Road/Chestnut Street connection and adopting an at grade (on Chestnut Street alignment) connection. Councilmember Thune moved to refer the item to the Public Works Committee. Roll Call YeaS - 5 Nays - 0_. : Referred to Public Works Committee. Councilmember Grimm moved to adjourn the meeting at this point.
