Minutes 12-02-1993 SUMMARY MINUTES OF THE SAINT PAUL CITY CDUNCIL Thursday, December 2, 1993 5:00 P.M. Present - 5- Councilmembers Guerin, Maccabee, Rettman, Thune, Wilson Absent - 2- Councilmembers Grimm (excused), Long (excused) Councilmember Rettman said item # 7 does not need to be referred to the Finance Committee and moved approval. Councilmember Rettman moved approval of the Consent Agenda as amended. Adopted Yeas - 5 Nays - 0 C�NSENT AGENDA FOR ACTION 1. Claim of James Morgan. Referred to the City Attorney's Office. 2. Resolution - 93-1797 - approving the appointment of Kay Willshire to the Advisory Committee for People with Disabilities. Adopted Yeas - 5 Nays - 0 COMMITTEE REFERRAL: 7. � Resolution - 93-1801 - amending the 1993 Budget of the Housing Information Office by accepting additional grant funds for the Mortgage Foreclosure Prevention Program. Resolution - 93-1802 - amending the 1993 Budget of the Civic Center Authority by transferring the financing & spending plans due to preliminary expenses for architecture, surveying, etc. costs from its Operating Fund prior to the 1993 Bond issue. Third Reading - 93-1733 - An ordinance to enact Chapter 380 of the Legislative Code establishing the licensure of tanning facilities. (For Action) � Bob Kessler, License Division distributed copies of the recommended fee schedule for �=�tanning facilities. After a brief discussion, it was laid over one week for the Final Adoption. Laid over until December 9th for adoption. Councilmember Rettman introduced a group of Weeblo Scouts from Holy Childhood School who were observing the Council as part of earning their Government Badge. 10. Third Reading - 93-1753 - An ordinance amending Chapter 60.201.A of the Legislative Code, changing the reference to "adult massage parlor" to "adult massage center" corresponding to the change in Chapter 412. (For Action) No one appeared in opposition. Bob Kessler, License Division requested this be laid over until December 21 st. Continue Public Hearing until December 21st. 1�. Third Reading - 93-1754 - An ordinance amending Chapter 60.213M of the Legislative Code changing the reference to "massage parlor" to "massage center" corresponding to the change in Chapter 412 of the Code. (For Action) No one appeared in opposition. (See item # 10 above) 692 Continue Public Hearing until December 21 st. December 2, 1993 12. Third Reading - 93-1755 - An ordinance repealing sections 331.01 to 331.44 of the Legislative code and replacing it with an amended Chapter 331 to update the present food code and deleting obsolete terminology, license categories and standards. (For Action) No one appeared in opposition. Laid over until December 9th for Final Adoption. 13. Third Reading - 93-1756 - An ordinance to amend the license fee schedule in Chapter 310 of the Legislative Code. (For Action) No one appeared in opposition. Upon request of Bob Kessler, License Department, Councilmember Rettman moved to withdrawal of the ordinance. Roll Call Yeas - 5 Nays - 0 WITHDRAWN 14 ' Third Reading - 93-1774 - An ordinance amending Chapter 60 of the Legislative Code � pertaining to regulating the location of firearms dealers who sell firearms. (For Action) ,-,. No one appeared in opposition. - Councilmember Maccabee moved to continue the Public Hearing until December 16th. Roll Call Yeas - 5 ;: Nays - 0 Continue Public Hearing until December 16th. 15. Third Reading - 93-1650 - An ordinance to amend the license fee schedule in Chapter 310 of the Legislative Code increasing license fees by 2% in conjunction with an estimated 2% ' increase in enforcement costs for 1994. (For Action - Public Hearing continued from November 9th) No one appeared in opposition. A brief discussion ensued among Councilmembers regarding fee schedules for various license renewals and the renewal fee for Massage Therapist Home Occupation was amended. Laid over until December 9th for adoption. 16. - Resolution - 93-1735 - approving an application for a General Repair Garage License by Chong Thao dba Thao Inc. at 631 Dale Street. (Laid over from November 18th) No one appeared in opposition. Bob Kessler, License Department requested a lay over of one week and Councilmember Rettman moved to continue the Public Hearing one week. Roll Call Yeas - 5 Nays - 0 Continued Public Hearing until December 9th. 17. Resolution - 93-1687 - approving the vacation of Lafayette Road between Grove and old Lafayette Road by the Space Center Inc. (Laid over from November 18th) 693 � No one appeared in opposition. Councilmember Thune moved approval. Adopted Yeas - 5 Nays - 0 18. Public Hearing on the Administrative Law Judge's Report on Check's Cashed of Minnesota Inc. and Resolution - 93-1803 - disapproving an application for a currency exchange license . by same per ALJ recommendation. Phil Byrne, Assistant City Attorney reviewed the staff report and recommendation for denial � of the license. He said the applicant did not attend the ALJ hearing and is now out of -; business at this location.
