a THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

7 Section 3432 of the Saint Paul Legislative Code is hereby amended to read as follows:

9 Sec. 34.32. Property areas; exterior standards.

t 1 The owner of any premises regulated by this section, as specified in section 34.03, shall comply with the
12 following requirements:
13 (1) Sanitation. All exterior property areas shall be maintained free from any accumulation of refuse,
14 garbage, animal feces (includi�i�eon droppin�s) or �se-outrescibles.
15 (2) Insect and rodent infestations. It shall be the responsibility of the owner to eaterminate any
16 infestation of rodents, vermin or other pests in all exterior areas and accessory structures on the
17 premises.
t8 (3) Accessory structures. All accessory structures including, but not limited to, detached garages,
19 sheds and fences shall be maintained structurally sound and in good repair. All exterior surfaces
20 shall be maintained in a stafe of good repair.
21 (4) Stored materials. It shall be unlawful to accumulate and store building material, lumber, boxes,
22 cartons or other containers, machinery, scrap metal, junk, raw material, fabricated goods and other
23 items in such manner as to constitute a nuisance or rodent harborage.
24 (5) Obscuring fences. Refer to the zoning code.
25 (6) Refrigerators and accessible containers. It shall be unlawful to permit a refrigerator or other
26 container, sufficiently lazge to retain a child and with doors which fasten automatically when
27 closed, to be exposed and accessible to children without removing the doars, lids, hinges or latches.

32 This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and
33 publication.

Pigeon and other bird and animal droppings are unsightly. In addirion these droppings pose a health risk and give a negative image of
the urban core [o our visitors. This legislation would requue that property owners keep their properties free from pigeon feces and
other putrescibles.

We are writing you regarding Council File 09-984 An orclinance amending Chapter 34 of the Saint Paul
Legislative Code to require pioperty owners to cleanup animal droppings. Please note that on Thursday,
NovembeL 5, 2009, City Staf� Saint Pau1 BOMA and a group of eighteen downtownbuilding owners or their
representatives attended a meeting with DSI staff to come up with pigeon reducrion strategies for the
downtown area. This representative goup of building owners and City staff pledged to work together at this
meeting towazds pigeon reduction and exclusion methods in downtown Saint Paul.
The �oup agreed that exclusion methods such as the boxing of "I" Beams in the skyways needed to
commence as soon as possible. The group also felt that other successful exclusionary methods could be
undertaken to eliminate the birds, and the dzoppings they leave on the sidewalks, from the ledges of the
skyway system.
While exclusionary methods may provide temporary relief &om pigeons, everyone in attendance agreed, that
some type of reduction strategy needed to be undertaken. The group was again impressed by the claims of
Ovocontrol which is, essentially, birth control for pigeons. The eg; of the animal simpiy never hatches. This
method is endorsed by PETA and does not have secondary consequences e.g. a peregrine falcon will not
become sterile if ii eats a pigeon with Ovocontrol in its system. Animal Control Superoisor, Bill
Stephenson's sma110vocontrol demonstration project, on the roof of the Lowry Hotel, has reduced pigeons
by 50% in one year on an average size flock. If we could appiy the Ovocontrol on a much lazger scale, we
could significantly reduce the overall pigeon population in downtown Saint Paul. Several owners did commit
to looking inm the installation of several Ovocontrol feeders.
For this reason we aze askmg ihat Council File 09-984 be tabled for six months as the downtown building
owners aze committed to working with City staff to reduce and control the pigeon population in downtown
Saint Paul.
