WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on
May 28, 2009, for the purpose of considering the rezoning petition, and pursuant to
§107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission for approval; and
WHEREAS, the Planning Commission considered the rezoning petition at its meeting heid
on Jun 5, 2009, and recommended approval recommended to the City Council; and
WHEREAS, notice of public hearing before the City Council on said rezoning petition was
duly published in the official newspaper of the City on May 18, 2009, and notices were duly
mailed to each owner of afEected property and property situated wholly or partly within 350
feet of the property sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on July 15,
2009, at which al! interested parties were given an opportunity to be heard, the Gouncil
having considered all the facts and recommendations concerning the petition; now,
therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Number no map, as incorporated by
reference in §60.301 of the Saint Paul Legislative Code, as amended, is hereby further
amended as follows:
That the property at 1528 Grand Ave, being more particularly described as:

be and is hereby rezoned from OS - O�ce Service to RM2 Medium-density Residential.

WHEREAS, Kevin and Barbara Henry, File # 09-071-025, have appfied for a rezoning from OS Office-
Service to RM2 Medium-density Nfuftip{e-Famify Residential under the provisions of � 61.601(b) 04 the
Saint Paul Legislative Code, on property located at 1528 Grand Ave, Parcel Identfication Number
(PIN) 032823320087, legaliy described as SUMMIT VIEW LOT 2 BLK 3; and
WHEREAS, the Zoning Committee of the Pfanning Commission, on May 28, 2409, held a public
hearing at which ail persons present were given an opportunity to be heard pursuant to said
application in accordance with the requirements of � 61.303 of the Saint Paui Legislative Code; and
WHEREAS, the Saint Paul Pfanning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as substantially reflected in the minutes, made the following findings
of fact:

appiied to rezone the properiy from OS to RM2.

The existing zoning (OS) does not permit single family dwellings. The proposed zoning (RM2) is
consistent with the existing mix of residential densi6es and compatible with the way the area has
developed. The majoriiy of the block is comprised of single and mul5family residentiai structures,
with cflmmercial businesses to the west, at the intersec#ion of Snelling and Grand.
The proposed zoning is consistent wifh the Comprehensive Plan. The Housing section of the
District 14 Plan recommends main4aining and preserving the districf's current housing stock. The
Housing Chapter of the Comprehensive Plan indicates the importance of maintaining a mix of
Iand uses and a broad range of housing types (p. 11).
The proposed singie famify dwelling is compatible with surrounding residential and commerciai
uses, The RM2 classification allows for a variety of residential densities and is appropriately
located adjacent to the exisfing Community Business (B2) uses located on the same block, which
inGude a coffee shop, bakery, small restaurant and dry cieaner.
5. Rezoning the property to RM2 is not considered spot zoning. It would return the property to its
previous zoning designation, increasing its consistency with both surrounding land uses and
existing zoning.
NOW, THEREFORE, BE IT RESOLVED, that the Saint Paul Planning Commission, recommends to
C'ity Council, that the appiication of Kevin and Barbara Henry for a rezoning from OS Office-Service to
RM2 Medium-density Multiple-Family Residentiai for property at 1528 Grand Ave be approved.

Councii. Sarah Zom aiso stated District 14 had not responded, and there were 0 letters in

Barbara Henry, the applicant, stated that they acquired the property on a foreclosure and would �
like to change it back to a residential property to possibly rent out or sell in the future.

The public hearing was ciosed.
Commissioner Brian Aiton moved approval of the Rezoning-Council. Commissioner Kathi
Donnelly-Cohen seconded the motion.

the Saint Paul Planning Commission's Zoning Committee on May 28, 2009, the Commission
voted to recommend approval of your request on Jun 5, 2009.
• The P4anning Commission's recommendatian is being forxarded to the City Council for their
action. Minnesota Statutes 15.99 requires that ail city action on zoning applications be
completed within 60 days of the date the application is made, but allows the City to extend this .
period for an additionai 60 days (total of 120 days). In order to accommodate the City Council
public hearing on your rezoning, which is also required by state law, the City of Saint Paui is
hereby extending the deadline for action from Jufy 6, 2009, (originai 60 day deadline) to
Seotember 4. 2009 (additionai 60 day deadline). The City Council public hearing on this
rezoning has been scheduled for July 15, 2009.

E. ZONING CODE CITATION: §61.801(b) provides for changes to the zoning of property
initiated by the property owner.
F. HISTORY/RISGUSSION; ln 1998 a permit was issued to convert the five-unit building to a
single family dwelling with a home occupation. A 1999 inspection revealed that the building's
principle use was commercial office space with no discernable residentia{ space. The owner
was instructed to rezone the property to a commercial designation. The Planning
Commission recommended denial of the application to rezone from RM2 to OS; the
rezoning was subsequentiy approved by the City Council.
G. DISTRICT COUNCIL RECOMMENDATION: District 14 had not commented at the time this
report was prepared.
H. FINDtNGS:
