� Section 1
8 Section 409.03 of the Saint Paul Legislative Code is hereby amended to read as follows:
lo Sec. 404.03. Number of licenses.

12 (a) In the downtown business district, and in all commercial develapment districts as defined in section
13 17.07.1 of the City Charter, on-sale licenses shall be issued only to hotels, clubs, restaurants and
la establishments for the sale of on-sale liquors exclusively. In a11 other areas of the city, licenses shall
t5 be issued only to hotels and restaurants, provided howevex, that establishments holding licenses on
16 August 16, 1995 shall not be affected by this limitation, but shall be entitled to have such licenses
�7 renewed so long as they are in compliance with all other reqiiirements of law and there exist no
18 grounds for adverse actions against such licenses. Notwithstanding the foregoing, the following
19 exceptions shall apply:
zo (1) A new license may be issued for a location in such other areas of the city if there had
21 previously been an on-sale intoxicating liquor license issued for tk�at location, unless:
22 a. The previous license had been revoked by the council for any reason other than
23 nonpayment of license fees within the�revious fifteen (15) �; or
z4 b. The previous license had terminated or expired more than two (2) years before the new
25 license had been first applied for; or
26 (2) An existing on-sale intoxicating liquar license may be allowed to move into another
27 location in the city if the previous location of the license was acquired by purchase ar
28 condemnation by a public body having the power of eminent dQmain, and if the distance
29 between the old and new locations is less than one-half (112) mile.
30 (b) Off-sale licenses shall be granted subject to the approval of the liquor control commissioner only to
31 proprietors of exclusive liquor stores, and but one (1) such license shall be issued for every five
32 thousand (5,000) inhabitants in the city.
33 (c) Notwithstanding any other provision of law to the contrary, the city shall not issue any on-sale
34 intoxicating liquor licenses in excess of two hundred (200).

38 This Ordinance will take effect and be in force thirty (30) days following its passage, approval and
39 publication.
