"Construction project" means any capital project paid for wholly or in part by the City to construct or remodel any building, structure, park, utility, street, sidewalk, or parking facility, or any portion thereof, located within the limits of the City of Saint Paul and to be operated by the City. "Eligible fund" means a source fund for construction projects from which art is not precluded as an object of expenditure. Public art shall mean publiclv accessible original art that enriches the citv and evokes meanin�. It mav include permanent visual art, performances, installations, events and other temporuv works; it mav also include the artist-desi�ned infrastructure and structures themselves. Public art should consider the site, its context and audience. Public art mav vossess functional as well as aesthetic qualities• it may be inte�ated into the site or a discrete work. Public artist in residence orogram shall mean an Artist or artists who works within the Citv as a resource in urban plannine capital pro�ect desi�n and the identification of public art opportunities 09-212 88 89 90 91 92 93 94 95 96 97 Public art plan shall mean a biennial ulan which identifies oovorhxnities for acauisition and inclusion of �ublic art within canital proiects. The Office of Financial Services shall be responsible for imnlementation of the public art capital budg_et plan as part of the City of Saint Paul ca�tal improvement bud� Public�place shall mean oubliclv accessible landscapes, structures, and infrastructure. Public places include, but are not limited to public nazks, plazas, streets and boulevards, brid�es and stairwavs, buildinas and waterworks. 98 Sec. 12.043. For all capital proiects funded bv eli�ible sources resultin� in a propertv to be operated by the City; the Citv of Saint Paul shall dedicate 1% of the elieible proiect costs as determined bv the Office of Financial Services, to be used for Public Art. If the Director of the Denartnient resnonsible for the canital �roj ect determines that this use of fixnds cannot or should not be included in a s ecific project, he/she shall seek apnroval of the Citv Council to use the funds described above to supplement other nublic art nroiects, or public art maintenance within that department. The specific use shall be as determined bv said Director and consistent with the Public Art Plan. �2) OnEOing maintenance. Maintenance and restoration costs in an amount equal to one-half of one percent (%Z% ) of total Capital Maintenance proiects approved as part of the Caroital Improvement BudPet shall be appropriated to support maintenance and restoration of the Citv's public art collection All Public Art donated to the Citv must come with a plan to fund and deliver oneoin� maintenance or the resolution acceptin� the Public Art must identify how maintenance of the donated Public Art will be funded 12.04 Planning and Desien.
