An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps
thereof:
WHEREAS, Pursuant to Minnesota Statutes § 462.357 and §64.400 of the Legislative
Code, Zane and Mary �leal duly petitioned to rezone 998 Bush Ave, being legally
described as TERRY'S ADDITION TO THE CITY OF ST. PAUL, COUNTY OF RAMSEY,
STATE OF MINN. LOT 1 BLK 20, PIN 282922340107, from B3 General Business to RT1
Two-Family Residential to re-establish a duplex; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on
August 13, 2009, for the purpose of considering the rezoning petition, and pursuant to
§107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission for approval; and
WHEREAS, the Planning Commission considered the rezoning petition at its meeting held
on August 21, 2009, and recommended approval to the City Council; and
WHEREAS, notice of public hearing before the City Council on said rezoning petition was
duly published in the official newspaper of the City on August 27, 2009, and notices were
duly mailed to each owner of affected property and property situated wholly or partly within
350 feet of the property sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on September
16, 2009, at which all interested parties were given an opportunity to be heard, the Council
having considered all the facts and recommendations concerning the petition; now,
therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Number 14, as incorporated by
reference in §60.301 of the Saint Paul Legislative Code, as amended, is hereby further
amended as follows:

WHEREAS, Zane and Mary Neal, File # 09-217-922, have applied for a rezoning from B3 General
Business to RT1 Two-Famity Residential to re-estabiish a dupiex under the provisions of § 61.801(b)
of the Saint Paul Legislative Code, on property located at 998 Bush Ave, Parcel Identification Number
(PIN) 2829223401Q7, legally described as TERRY'S AQDITION TO THE CITY OF ST. PAUL,
COUNTY OF RAMSEY, STATE OF MINN. LOT 1 BLK 20; and
WHEREAS, the Zoning Committee of the Planning Commission, on August 13, 2009, held a public
hearing at which all persons present were given an opportunity to be heard pursuant to said
application in accordance with the requirements of § 61.303 of the Sai�t Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as substantially reflected in the minutes, made fhe following findings
of fact:

The applicarrts have purchased the property and seek to re-establish the previous duplex
use. Since duplexes are not allowed in the B3 zoning district and the structure has been on
the Departmeni of Safefy and Inspection's vacant building list for more than 365 days, the
duplex use cannot be re-established without rezoning or applying for a nonconforming use
permit. The applicants have chosen to seek a rezoning to RT1, which allows duplexes.
The proposed zoning is consistent with the way fhis area has developed. The buildings on
this block face are residential structures. The properties across the alley to the south and
across Cypress to the east are currently zoned RT1.
The proposed zoning is consistent with the Comprehensive Plan. The current Land Use and
Housing chapters of the comprehensive plan support maintaining a range of housing types
(Housing Plan policy 4.1; Land Use Plan objective 5.3). The preliminarily approved update to
the Housing chapter supports increased housing choices across the city to support
economically diverse neighborhoods. (Policy 1.1)
The 1986 District 4 Plan Land Use Policy includes the following: 5. The District Council wil!
oppose conversions ofrental properfy to more unifs tiran for which fhe area is zoned, and will
apply stringenf standards when considaring requests for variances. These standards will
include: properlot size as designated in fhe Zoning Code; parlvng availability,• and
marntenance record of the properly. Entirely residenSal uses are not pemtitted under the
current 63 zoning. The proposed zoning to RT1 will permit only duplex residential, the
historic use of the property. The lot area meets fhe zoning code standard of 50 ft. of frontage
and 6000 sq. ft of lot area. While there is no off-street parking provided at this time (a

property. Property maintenance issues appear to have started at the time fhe building
became vacant, and couid be resolved by re-occupancy of the residence.
4. The proposed duplex use is compatible with surrounding uses to the east and soutfi (aiready
zoned RT1) as well as immediately west of the site.
5. Court ru(ings have determined thaf "spot zoning° is illegal in Minnesota. Minnesota courts have
stated that this term 'applies to zoning changes, typically limited to small plots of land, which
establish a use c/assification inconsistent wifh the surroundrng uses and creates an island of
nonconforming use wifhin a largerzoned disfrict, and which dramatica!lyreduce the value for
uses spec�ed in the zoning ordinance of eifher the rezoned plot or abutting property." Since
there is other land zoned RT1 immediately adjacent to this site, the rezoning is not spot zoning.
NOW, THEREFORE, BE IT RESOLVED, that the Saint Paui Planning Commission, recommends to
City Council, that the application of Zane and Mary Neal for a rezoning from B3 General Business to
RT1 Two-Family Residential to re-establish a duplex for property at 998 Bush Ave be approved.

inserts for Pne Plannmg Commission manuals including a listing of staff and their contact
infozmation, a couple of new maps in color, and a new s�mary sheet on zoning districts and the
various uses ttat are permitted in each districL
Also, Ms. Drummond reported that a resolution was approved at the City Coimcil last Wednesday
requesting various city departments including Pazks and Planning and Economic Development to
work with Ramsey County Public Health on an analysis of food needs m the community. This is
something a few of PED staff have already started worldng on. This is a formal resolution from
the council asldng staff to coutinue to work on the anatysis of food needs, because there is an
increasing interest in this issue.
Related to that issue there is an ordinance cinrenfly under review at City Council that would make
it easier for people to raise chickens on their property. It would eliminate a petition requirement
for raising threa or fewer chickens.
. At the HRA meeting last week the HRA Commissioners approved a new program for parking
called the Neighborhood Commercial Parldng Frogram. This program has been set up to address
• the loss of on-street parking on University Avenue that will result from construction of the LRT.
This program will provide forgivable loans to commercial property owners who want to make
improvements to shazed parldng lots. There is an moentive to get two or more properry owners
together and agree to share pazldng and make improvements. The goal of the program is to better
manage and utilize the off-street pazldng that is already on the corridor.

Patricia James presented the staff report with a recommendation of approvaf for the Rezoning.
Patricia James also stated District 4 had not responded, and there were 0 letters in support, and
0 letters in opposition.
Upon questions of the Commissioners, Ms. James, explained that the property has been vacant
for at least two years. She also stated that prior to becoming vacant it was used as a duplex
• and has been since the late 1970's according to the old city land use maps.
The applicant, Mary Neal, explained that she has a history of eighteen years investing in
properties that are in need of repair. She also stated she does not believe in a quick fix, she is
very concemed with high quality workmanship.
The public hearing was ciosed.
Commissioner Carole Faricy moved approval of the Rezoning. Commissioner Stephen Gordon
seconded the motion.
The motion passed by a vote of 7-0-0.

Sainf Paul Planning Commission's Zoning Commitfee on August 13, 2009, the Commission
voted to recommend approval of your request on August 21, 2009.
The Pianning Commission's recommendation is being forvvarded to tfie City Councif for fheir
action. Minnesota Statutes 15.99 requires that all city action on zoning applications be
completed within 60 days of the date the application is made, but allows the City to extend this
period for an addifional 60 days (total of 120 days). In order to ensure sufficient time for the City
