Establishment of permit fees. ll(a) Fees required: Before issuing any permit required by the building code, this chapter or other 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 pertinent provisions of the Saint Paul Legislative Code, the fee as indicated in the following schedule shall be paid. Where work for which any such permit is required is started or proceeded with prior to obtaining said permit, the fee specified shall be collected and, in addition, a penalty fee shall be collected. The penalty fee sha11 be equal to the specified permit fee. The payment of such penalty fee shall not relieve any person from fully complying with the requirements of the building codes in the execution of the work or from any other penalty prescribed herein. Building valuation for the purpose of establishing building permit fees shall be as set forth by the valuation data published by the Building Code Division, Department of Administration, State of Minnesota, as may be amended from time to time. Value of work other than that included in the valuation data published by the Building Code Division, State of Minnesota, must include the cost of installations, alterations, additions or repairs, including all labor and materials supplied by the contractor and other sources. The building code officer may require the contractor to furnish the city with a written statement of the actual cost of the wark. When such costs exceed those for which the perxnit was issued, an additional permit fee will be required and collected based on the fee schedule established herein. When the valuation of the proposed construction exceeds one thousand dollazs ($1,000.00), a plan review fee sha11 be paid to the building official at the tune of submitting plans and specifications for checking review. Plan review fees shall be sixty-five (65) percent of the total building permit fee as set forth in the table above. Expiration ofplan check: Applications for which no permit is issued within one hundred eighty (180) days following the date of application shall expire by limitation, and plans and other data submitted for checking may thereafter be returned to the applicant or destroyed by the building official. The building official may extend the time for action by the applicant for a period not exceeding one hundred eighty (180) days upon written request by the applicant showing that circumstances beyond the control of the applicant have prevented acfion from being taken. No applicaUon shall be extended more than once. In order to renew action on an application after expiration, the applicant sha11 resubmit plans and pay a new plan checking fee. Expiration of building permit: (1) Every permit issued by the building official under the provisions of this chapter shall expire by lunitation and become null and void if the building of work authorized by such permit is not commenced within one hundred eighty (180) days from the date of such perxnit or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of one hundred eighty (180) days. Before such work can be recommenced, a new permit shall be fust obtained so to do, and the fee therefor shall be one-half the amount required for a new pernut for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided fiirther, that such suspension or abandonment has not exceeded one (1) year. (2) Any permittee holding an unexpired permit may apply for an extension of the time within which he may commence work under that permit when he is unable to commence work within the time required by this section for good and satisfactory reasons. The building official may extend the time for action by the permittee far a period not exceeding one hundred eighty (180) days upon written request by the permittee showing that circumstances beyond the control of the permittee have prevented action from being taken. (4) All work commenced pursuant to the issuance of a building pernlit by the building official for conshuction, alteration, repair or remodeling of the exterior or the interior portions of R- I properties or commercial properties where the pernut valuation is under $500,000, must be completed within one (1) yeaz from the date of issuance of the building pernut or within one (1} yeaz from the effective date of this chapter, whichever is later. The building official may extend the time for compledon upon written request of the pernuttee establishing that circumstances beyond the control of the pennittee prevented completion of the work for which the building perxnit was authorized. Suspension or revocation of building permit: The building official may, in writing, suspend or revoke a permit issued under provisions of this chapter whenever the permit is issued in error or on the basis of inconect information supplied, or in violation of any ordinance or regulation or of any of the provisions of the state building code. Refund ofpermit fees: (1) The building official may authorize the refunding of any fee paid hereunder which was erroneously paid or collected. (2) The building official may authorize the refunding of not more than eighty (80) percent of the permit fee paid when no work has been done under a permit issued in accordance with this code. (3) The building official may authorize the refunding of not more than eighty (80) percent of the plan check fee paid when an appiication for a pernut for which a plan check fee has been paid is withdrauvn or canceled before any plan checking is done. The building official sha11 not authorize the refunding of any fee paid except upon written application filed by the original permittee not later than one hundred eighty (180) days after the date of fee payxnent. Other permit fees: Pernut fees for other than general construction shall be as follows: (1) Wrecking of buildings or structures. $ 5.00 per 1,000 cubic feet or fracrion thereof, minimum $ H4.99 70_00, with the exception of signs as specified in paragraph (10) below. (2) Moving of buiddings or structures. Buildings larger than 12 feet high, 14 feet wide, 25 feet long other than buildings used for group U, division 1, occupancies: $��-1-9A 254.00 per move. For electrical work the permit fee chazges shall be made at tl�e following rates; provided, however, the min;mum fee for any permit shall be: one-family dwelling electrical work $43.00, multifamily, commercial and industrial work, $3-3:89-58_00. a. Service: New service, change of service, temporary service, addition, alterafion or repair on either primary or secondary service up to 600v shall be $�3-99 58_00. b. Circuits: The fee for the installarion of new circuits and/or feeder additions, alterations or repairs to e�sting circuits up to 600v shall be $�88 12_00. c. The fee is one (1) percent of the valuation of the work; provided, however, that the minimum fee for any pernut is $F4-88 70_00. PZumbing fees: a. Drain waste and vent, water supply and fLxtures. 1. The fee for all initial pernuts issued by the department of safety and inspections shall be $76.00. The minimum fee shall be $42.00, in addition to which the following fees shall be paid: l. Standpipes: $64.00 for each standpipe for the first five (5) floars, plus $7.00 � for each floor above the fifth. 2. Sprinklers: $15.50 far each additional ten (10) sprinkler heads or fraction thereof. 3. Fire pumps: $50.00 for each pump. Fire extinguishing systems utilizing an extinguishing agent other than water, new installations, repairs or alterations: The fee shali be one percent of the valuation of the installation, repair or alteration with a minimum fee of $42.00. (9) Refr-igeration.• a. Refrigeration permit: One (1) percent of total value of work, minimum fee of $H4.89 70.00. b. Total value of work is defined under section 33.04(a). (10) Signs, billboards, marguees and awnings: a. Wal1 signs and projecting signs: $2.6� for each squaze foot with a minimum fee of $70.00. b. Marquees over public property: $138.00 for each installation. c. Repair permit: Twenty-five (25) percent of the fee for a new sign with a minimum fee of $70.00. d. Awnings projecting over public properiy: $2.10 per lineal foot, minimum $58.00 for each installation. A sepazate sign permit is required for awnings with signage. e. Roof and freestanding signs: $2.70 for each square foot with a minimum fee of $75.00. . Demolition pernut: $70.00. g. Temporary and portable signs: $52.00. h. Billboard extension permits: $48.00. Addirional fees: 1. Addifional fee for business signs located in a special sign district when there ate additional regulations that must be reviewed: $25.00. 2. $0.50 Minnesota State Surcharge required for all signs attached to a building for permit fees up to and including $1,000.00. For pernut fees over $1,000.00 the rate is 0.0005 per permit fee dollar. j. A separate electrical permit is required for all electrical work done on signs that are lit, whether internal or external. k. If building modifications aze necessary to accommodate a sign installation, an additional building perxnit shall be required. Steamfitting and hot water work: a. Fee for new construction or alteration shall be one (1) percent of total valuation of the work. Value of work must include the cost of installaUon, alteration, addition and repairs � c. including heat transfer units, accessories to the heating system, including pipe, fittings, and all labor and materials necessary for installation. In addition, it shall include all materials supplied by other sources when these materials are normally supplied by the contractor. Minimum permit fee for commercial, industrial, institutional or business occupancies is $H4.89 70_04. The fee for alterarions, additions and repair to existing refrigeration, gas and oil systems sha11 be based on one (1) percent of total valuation of the work with $64.00 minimum. Warm air, heating, ven2ilation and sheet metal: a. Mechanical warm air heating systems: $(4.9A 70.00 for the first 100,000 btu per hour or fraction thereof, plus $�.?8A 13.00 for each additional 100,000 btu per hour or fraction thereof. b. Venfilation systems, dust collection systems, pollution control systems, etc.: One (1) percent of total valuation of the work. Value of work must include the cost of installation, alteration, addirion and repair, including a111abor and materials necessary for instaliation. The minimum fee shall be $ H4:99 70_00 for commercial buildings and $�89 41.00 for residential ventilation work and duct modification. c. General sheet metal: A separate permit is required for general sheet metal work. For gutters, flashing, metal chinuieys, chutes or general sheet metal work, the fee shall be one percent of the total valuation of the wark. The minimum fee is $ f4.89 70.00. Incinerators: a. Domesric incinerators: $ b4�9 70.00 for each installation. b. Commercial and industrial incinerators: One (i ) percent of total value of work, minimum $64-A8 70.00 for each installation. Method for providing positive combusrion air must be provided with permit application. Solar heating systems: Permit fees for solaz heating systems shall be one (1) percent of total valuation, with a miniinum fee of $F4-8A-70.00. (19) Parkinglots: a. Permit fees for pazking lots shall be one (1) percent of total valuation, with a minimum fee of $H4�9 70.00. No pazking lot or loading and unloading area requiring approval under the provisions of Legislative Code sections 62103 and 62.105 shall be constructed nor shall any existing unimproved lot be paued without first obtaining a building permit. Such lots shall not be used untii the conshuction has been completed and approved by the building code officer. b. No off=street parking lot or loading and unloading area shall be repaved, modified, reconfigured or enlarged without first obtaining a building permit. The pernut fee shall be one (1) percent of the total valuation, with a minimum fee of $F4�9 70_00. (20) Tank instaldation and removal: a. Tank removal: $�,?98 167.00 b. Tank installafion: One (1) percent of the total valuation, with a minimum fee of $F>4.89 70_00. (21) Other piping: Includes process piping and miscellaneous piping that is not otherwise regulated under the state plumbing or mechanical code. The fee for other piping permits: One (1) percent of the total valuation, with a minimum fee of $(4.88 70_00. Fees, exemption for city: The city shall be exempted from the payment of permit fees required under this chapter where work is done by city employees on city-owned property not exclusively leased or rented to a party otherthan the city. It is the intent of this paragraph only that payment of fees are waived. Permits as required by other sections of the Saint Paul Legislative Code are to be applied for and issued, inspections are to be made as required and compliance with all other requirements must be made. Section 2 287 Section 33.07 of the Saint Paul Legislafive Code is hereby amended to read as follows: 288 289 Sec.33.07. Fences--Requirements. 290 (a) Permit. No person sha11 construct, or cause to be constructed, any fence in the city without first 291 obtaiuing a permit therefor from the building official. 292 (b) Height offences. No fence sha11 be erected exceeding six (6) feet six (6) inches in height above the 293 sidewalk or finished grade of any lot in a residence district or on any lot occupied for residential 294 purposes. The applicant shall ensure that fences and all supporting structures shall be completely 295 witthin the boundaries of such lot with no portion encroaching onto adjacent property. On a comer lot at two intersecting st�eets in a residential zoning district, no fence, wali or other structure shall be allowed above a height of two (2) feet from sidewalk grade in the triangulaz azea of the lot included withiu ten (10) feet of the comer along each lot line unless the structure is more than 80 % open. Fences for nonresidential uses in residential zoning districts shall not exceed eight (8) feet in height, except fences azound tennis courts, which shall not exceed twelve (12) feet in height, back stop fences, which shall not exceed twenty (20) feet in height, and golf range fences, which shall not exceed thirty (30) feet in height. The selvage end of chain link or metal fences shall be smooth; knuckled ends are permitted, twisted ends are not permitted. Variances. A variance of the fence height or comer cleazance regulations may be granted if, after investigation by the building official, it is found that site, or terrain, or nuisance aniinal conditions warrant a waiver of the height restrictions. An application fee of � seven dollazs ($H4.99 7_ 0�00) is required for each variance request. Swimming pool fences. All yards of one- and two-family structures contauung swimming pools shall be enclosed by an obscuring fence not less than four (4) feet in height. All yazds of residential structures of three (3) or more units and commercial structures containing swimming pools shall be enclosed by an obscuring fence not less than five (5) feet in height. The gates sk�all be of a self- closing and self-latching type, with the latch on the inside of the gate, not readily available for children to open. Gates shall be capable of being securely locked when the pool is not in use. Barbed wire fences. No bazbed wire fence shall be constructed within the city limits of the city, except for police and correction facilities, unless the following conditions aze complied with: (1) No fence which uses barbed wire may be built in, or abut, a residentially zoned district or built on or abut a lot occupied residentialiy. (2) Barbed wire, not exceeding three (3) strands, may be permitted on the top of a fence; providing, that the arxns do not project over public property. The minimuxn height to the bottom strand of the barbed wire shall not be less than six (6) feet from fuushed grade. (3) In a11 cases where a barbed wire fence is requested, an application shall be made to the building official. (4) A certificate of insurance indemnifying the City of Saint Paul sha11 be submitted with the applicarion subject to the approval of the city attorney as to form and in an amount as set forth in Minnesota Statutes, Section 466.04.
