Stat. § 462355, Subd. 4 9 and City Charter §§ 6.05 and 6.11, hereby initiates this interim ordinance process to temporarily 10 prohibit the establishment or relocation of adult uses pending a study, report, recommendations 11 and action upon such recommendations regarding the city's present zoning regulations which 12 require all adult entertainment uses pernutted under the zoning code to obtain a conditional use 13 pernut. 14 15 16 17 18 19 20 21 22 23 2Fl 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 The City Council has been advised that the general conditional use standards which are applicable to any land use first pernutted pursuant to a conditional use permit, may not be fully applicable to an adult entertainment use. The City Council desires to temporarily regulate adult bookstores pursuant to this interim ordinance while City staff and the planning commission prepare a study and report on the matter. The intent of this interim ordinance is to regulate the time, place and manner of adult entertainment uses pending the study and prompt enactment of any new conditional use permit standards applicable to adult entertainment uses. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 A study of the City's regulatory zoning ordinances relating to conditional use permits for aduit entertainment uses shall be made pursuant to Minn. Stat. § 462.355, Subd. 4. City staff and the planning commission are requested to study the matter and submit a report and recommendations to the City Council based upon the study so that action may be taken and made effective within the time set forth in Section 2 below or earlier as the case may be. Section 2 Pending the completion of the said study and the enactment of any amendments to the zoning code, for the purpose of preserving the status quo with respect to adult entertainment uses, and for the purpose of protecting the health, welfare and safety of the public, no zomng permits, building pernuts, or plat and lot split approvals may be issued or approved for the establishment or relocation of any adult entertainment use for a period of time not to exceed one year from the effective date of this interim ordinance process as allowed under Minn. Stat. § 462.355, Subd. 4 or until such time as the City Council has taken action on the recommendations contained in the study. Section 3 2 $t 'Ol�-'��� 3 Until such time as the said study has been completed and the City Council has reviewed its 4- recommendations for possible adoprion and the effective date of any adopted recommendation, 5 City departments receiving written applications for the approvals noted above shall accept the 6 applications and immediately process them in accordance with the provisions of Minn.
