VTHEREAS, the CiTy Council is authorized under Minnesota Statutes Section 462357 and Section 64.400 of
the Legislative Code to adopt the Fort Road Development Plan sumniary as an addendum to the
Comprehensive Plan and to adopt zone changes implementing tY�e plan summary; and
WHEREAS, the Planning Commission inatiated the Zoning Study on November 22, 2002, for the purpose of
considering amendments to the Saint Paul Legislative Code pertaining to the Fort Road azea of the City (Wesi
Seventh Street); and
WHEREAS, the Planning Commission held a public hearing on the Forr Road Development Plan summary
and the Zoning Study on January 14, 2005, notice of which was mailed to al] property owners in the study
area and was published in the Saint Paul Pioneer Press on December 27, 2004, January 3, 2005, and January
10, 2005; and
WHEREAS, the consideration of public testimony and the recommendations of City staff, the Planning
Commission on 3anuary 28, 2005, recommended approval of the rezonings as proposed; and
WHEREAS, notice of a public hearing before the City Council on the Fort Road zoning proposals was dul}�
mailed to all properry owners in the study area and duly published in the official newspaper of the City on
February 6, 2005; and
WHEREAS, a public hearing before the City Council having been conducted on February 16, 2005, at which
all interested parties were given an opportunity to be heazd, the Council having considered all the facts and
recommendations concerning zoning for the Fort Road area of the City; now therefore
THE COUNCIL OP THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1
The Council of the City of Saint Paul does hereby amend the Saint Paul Zoning Ordinance by amending the
zoning ciassifications for the following properties on the zoning maps of the City of Saint Paul, Sheets No.
27, 28 and 35, as incorporated by reference in Section 60.303 of the Saint Paul Legislative Code:

RESOLUTIO�T ADOPTI�TG THE FORT ROAD DEVELOPMENT PLfIN
ZONIlVG STUDY
WIIEREAS,the Planning Commission is authorized under Minnesota Statutes Section 462.357 (5)
and Section 64.4Q0 of the Saint Paul Legislative Code to initiate a 40-Acre Study for the purpose of
amending the Zoning Code; and
WHEREAS, the Planning Commission on November 22, 2002, initiated the preparation of a Zoning
Study for the Fort Road (West Seventh Street) area; and
WHEREAS, the Ptanning Commission held a public hearing on the Fort Road Deve�opment Ptan
Summary and Zoning Study on 7anuary 14, 2004, notice of which was duly given in the Saint Paul Pioneer
P:ess oa December 27, 2fl04; ;anaary 3, 2J�5; a��d January 10, 2��5; and
WHEREAS, the Planning Commission, in accordance with state statutes, has determined that:
The stud� area is at least 40 acres in size.
The number of real estate descriptions affected by the amendments renders obtaining of written
consent impractical.
The proposed amendmems are related to the overall needs of the communiry, to existing land use
or to plans for future land use, as laid out in the Fort Road Devetopment Plan 3ummary.

adoption of the Zoning Code amendments attached hereto and directs the PlanningAdministratorto forwazd

We represent George Fulfoxd, 3r. in connection with property which he owns at 533
Randolph, which is in the vicinity of the Schmidt Brewery. It has recently come to his attention
that Council Member Thune is proposing a rezoning of thac propeny to TN-3, rather than the I-1
which the Planning Commission recommended. Y am also enclosing a letter which Mr, Pulford
sent ta the Planning Commission urging tl�at property ad}acent to 533 RandoIph likewise be
rezoned to I-1. 'The Planning Commission agreed with 1�1i. Fulfo�d.
The property at 533 Randolph is cuzrently used by ehe School District as its bus garage.
It is at a different elevation than other property proposed ta be rezaned to TN in connection with
the redevelopment of the Schmidt Brewery. It is in a geographically dif�ezent area. It is an area
of railroad tracks.
We saongly urge the St. Paul City Council to reZOne the property at 533 Randolph to I-1,
rather than TN-3, The City Council should follow the recommendation of the Planning
Commission and take into consideration the cunent use of the propetty, as well as ics foraseeable

use, which is not TN-3 uses. Mr. Fulford strongly objects to the rezoning of his property to T'N-
3, which simply is unreasonable and not supported by the record. We strongly urge the City
Council to foltow the Planning Commission by rezoning 533 Randolph to I-Z rather than TI�'-3.
For medicai reasons, Mr. Fulford is unabie to auend today's meeting.

accupied by the St. Paul School Dist. 625 for stonge of buses and police cazs.
This property is one of four properties on the north side of Randoiph between Auke on
the east and Drake on the west. They are a11 cunently zoned I2 including the properties east of
Auke.
Please refer to your map provided to Qroperty owners� The propenies between Drake &
Duke are now included zn ihe proposed re-zoning to TI from T2 with the glaring exception of the
parcel owned by the same folks that own the brewery property. This parcel is proposed for r�
zoning t0 "Z'N3. This is inconsistent with your overall planning. 3ust because the main brewery
property is pmposed to bc TN3 do you viotate good planning just because a pazcel is owned by
the same brewery property owners? 'Your zoning should be znore consastent along the nozth szde
of Randolph with all properties that are boundary properties be zezoned to Zl rather co have oae
inserted with different zoning. Please reconsider your proposaI for this ona pa�ei. If you drive
on James you see that all the properties that boundary on Randolph are ac a different lower
elevarion than che properties nonh of James.
Zn addition I have a purchase a�eement submitted to the brewery owners for part of their
property that is south and east of che railroad tracks for the beneft of the School bist. 625 bus
garage needs. TN3 2oning would most likely not fzt with the proposed Ti zoning of our property.
The school district transponacion people would certainly appreciate youz cooperation.

The intent of the Zoning Study is to adopt zoning districts that will implement the policies in the Fort Road Development
Pfan summary.
Explanation of non-conforming use status, or better known as "grandfather rights":
When a zoning classification is changed on a property, and the new zoning classification does not permit the current use,
the current use (house, business, industry, for exampfe) is not affected unfess or until that use is vacant for one year or is
demolished. The existing use is "grandfathered in." (This is also called "having non-conforming rights" to the previous
zoning classification.) When an existing use is vacant for one year or is demolished, then the new use would have to
conform to the new zoning.
If the owner of a property wlth a"non-conforming use" wishes to change or expand that use, he/she will have to apply to
the Planning Commission for either a"change of non-conforming use" permit or an "enlargement of non-conforming use"
permit.
These are the zoning classifications proposed for the Albion, Otto and Randolph nodes:
• TN2 TN means Traditional Neighborhood. Permits mixed-use, including residentfal and commercial (both retail
and office). It is designed for use in existing or potentiaf pedestrian nodes.
• TN3

• 62
• B3
Mixed-use development on large sites.
Medium industry. General manufacturing, including produciion and processing of materials.
Light industry Light manufacturing and assembly from previously prepared materials.
Community business. Generally characterized by a cluster of establishments with relatively large
vehicular and pedestrian activity.
General business. This is intended for a diversity of types of businesses and is generally located along
major tra�c streets or adjacent to B-2 districts.
