WHEREAS, Pursuant to Minnesota Statutes §462.357 and §61.800 of the Legislative Code, Michlitsch Builders
Inc. duly petitioned to rezone 8�� and 8Q6 East Third Street being legally described as PIN 32-29-22-14-0195
and 32-29-22-14-0196; Subj to Third St Lots 1 and 2, Auditor's Subdivision No. 14 St. Paul, Minn., from B-2
(Community Business) and P-1 (Parking) to TN2 Traditional Neighborhood for residential or mixed use
development; and
WHEREAS, the Zoning Committee of the Pfanning Commission held a public hearing on June 10, 2004, for
the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative Code,
submitted its recommendation to the Planning Commission for approval; and
WHEREAS, the Planning Commission considered the rezoning petition at its meeting held on June 18, 2004,
and recommended approval to the City Council; and
WHEREAS, notice of public hearing before the City Council on said rezoning petition was duly published in the
official newspaper of the City on July 19, 2004, and notices were duly mailed to each owner of affected
property and property situated wholly or partly within 350 feet of the property sought to be rezoned; and

WHEREAS, Michlitsch Builders inc., File # 04093-165, have appiied for a rezoning from B-2

use deve{opment under the provisions of §66.300 of the Saint Paui Legislative Code, on property
located at 800 and 806 East Third Street, Parcel Identificafion Number (PIN) 32-29-22-1 40 1 95; 32-
29-22-14-0196, Iegaily described as Subj to Third St Lot 1 and Lot 2 Auditor's Subdivision No. 14 St.
Pauf, Minn.; and
WHEREAS, the Zoning Committee of the Planning Commission, on June 10, 2004, held a public
hearing at which all persons present were given an opportunity to be heard pursuant to said
application in accordance with the requirements of §61.303 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the pubiic hearing as substantialiy reflected in the minutes, made the foliowing findings
of fact:
1. The appticanf proposes rezoning both lots to TN2. The TN2 district permits both mixed use and
wholly residential developments. At this point, the applicant is considering two major attemative
• redevelopments. Option A would convert the existing buiiding to six residential units and add
garages on the lof to the east. A variation of this option wouid be to retain one or two spaces on
the first floor of the building as commercial spaces. Option B wouid convert the existing building
to six units and add two additional units above new garages in back. Under Option A, there woufd
be garages accessed off Maple on a lower level as well as garages with access from Third on an
upper Ievel. Under Opfion B, seven garage spaces wouid be provided with access from Maple.
- The two residential units above the garages would be at a slightiy higher level than Third Street.
There would be no parking access from Third Street.
2. Parking would need to be provided for new construction only, since the existing building has no
off-street parking and is legaliy nonconforming. Under Option A, 8 spaces wouid be provided for
the six units. Option B provides 7 spaces for 8 units.
3. The intent of the TN2 district is to support compact, pedestrian-oriented commercial and
residenfial development that, in tum, can support and increase transit usage. it permits both
exclusively residential as weli as mixed use development. The B-2 zoning disfrict does not permit
buildings fhat are exclusively residential. 8ecause of the flexibifity of the TN2 district, the
proposed rezoning is better suited to the way the area has deveioped, with its changing market
for commercial and residential uses.

4. Tfie proposed TN2 zoning is co�sistent with comprehensive plan policies supporting mixed uses
and providing a range of housing types and values.
5. The proposed rezoning wili nof have an adverse impact on the surrounding area, and is likely fo
have a positive impact by stabilizing a deteriorating commercial-residenfial buiiding.
6. Given the conditions in fhe immediafe area, the 62 distriet does not allow the reasonable
conversion of this building to wholly residential use, while the proposed TN2 zoning can
accommodate the proposed use.
7. 8ecause this is a rezoning from one commerciai district to another, no consent petition from
neighboring property owners is required.
8. The property is in the Dayton's Btuff Historic District and the building designs and p{ans must
receive approval from the 5aint Paul Heritage Preservation Commission as wetl as site plan
review.
NOW, THEREFORE, BE fT RESOLVED, that the Saint Paul Pianning Commission, recommends to

job, and congratulated him by reading a resolution honoring his enfihusiasm and dedication to his

Ciry Council buriness on 6/16/04:
Mr. Lazry Soderholm stated the City Council received the Mayor's veto of a City Council
decision about the cluster housing project on Burgess Street. The Planning Coussnission
approved a condirional use permit for the proiect, and that decision was reversed by the Ciry
Councii. However, in that reversal the Council had gone beyond the state 60-day tim.e limit,
and for that reason the Mayor vetoed their decision. LIEP has issued the building pexxnits for
those units, so it remains to be seen how it will play out.
The altey vacation at Universiry and Dale for the library housing/mized use development was
approved.

Ms. Simison stated the MiddIe Section is the second of three neighborhoods in the Phalen
Corridor where specific plans have been prepazed to implement the overall Phalen Corridor
Development Strategy of jobs, housing, the construction of Phalen Boulevazd and environmental
cieanup. She reporfed work began on tfie Middle Section plan and 40-acre study approximately
18 months aao and, after a hiatus, has been concluded. Staff is requesting that the Commission
set a public hearing date of 7uly 30'" so that the plan and zone changes can be considered.

Commissioner Gordon asked about the pertnitfed uses going from B2 to TN2 and Ms. James stated funeral homes and
mortuaries are one difference, but the rest seemed to be similar.
Commissioner Alton questioned if there was any use that is permitted in 62 that is not in TN2 and Ms. James stated that the
kinds of uses that are not pertnitted in the TN districts thaf are permitted in B2 are conditionat uses like gas stations and auto
service stations - some of the more auto oriented uses. He asked if the parking requirements were lessened in the TN2 and Ms.
� mes stated no the parking requirements are the same, and fhat the difference is that in the FN districts the mirtimum
ndards are also the maximum standards, whiie in B2 there is no maximum. So if you are required to have 5 spaces you
cou(d have 20 spaces under B2 zoning, but in the TN districts you cou(d have s�o morz than 7 spaces. li they want more than 2
extra spaces, they would nesd a variance or they would have to put them underground or in a structure.

Commissioner Kramer asked if they were going fo be combining this into one lot, and Mr. Michlitsch stated yes.
Commissioner Aiton asked if they wouid ali be residential and Mr. Michlitsch said yes. Commissioner Alton askecf if there were
any plans to change them to commerciaf in the future and Mr. Michlitsch s;ated he has no plans for that. He will be se!ling the
units to individual buyers, so they could do something like a home office, efc.
No speakers in support or opposition.

Commissioner Kramer moved approval of the Rezoning. Commissioner ponnelly-Cohen seconded ttie motion.
CommissioRer Alton asked why this isn't spot zoning and Ms. James stated that it is in a mixsd use density area, and TN2 is
quite similar fo fhe B2. IYS changing from one commerciaf use to another, and it doesn't create an island of nonconfo�nity,
w�ich is one of t�he 5ndings regarding spot zoning.

The Dayton's BlufF Community Council at our Housing Environment and Economic
Development meeting on June 14, 2004 passed a resolution supporting the request to
� change the zoning on 800-806 East 3` Street from B2 and P1 to T'N2 with the
requirement that we are notified when businesses aze going to moved into the building. It
is a wonderfiil historic Victorian building and this project wilI be a great asset to
Dayton's Bluff.

siightly higher level than Third Street. There would be no parking access from Third Street.
2. Parking would need to be provided for new construction only, since the existing building has
no ofF street parking and is legaily nonconforming. Under Option A, 8 spaces would be
� provided for the six units. Option B provides 7 spaces for 8 units.
3. The intent of the TN2 district is to support compact, pedestrian-oriented commercial and
residentiai development that, in turn, can support and increase transit usage. it permits both

exclusively residential as well as mixed use development. The B-2 zoning district does not
permit buildings thaf are exciusively residential. Because of the flexibility of the TN2 district,
tfie proposed rezoning is befter suited to the way the area has developed, with its changing
market for commercia! and residential uses.
4. The proposed TN2 zoning is consistent with comprehensive pian policies supporting mixed
uses and providing a range of housing types and values.
5. The proposed rezoning wifl not have an adverse impact on the surrounding area, and is Iikely
to have a positive impact by stabilizing a deteriorating commercial-residentiai building.
6. Given the conditions in the immediate area, the B2 district does not allow the reasonable
conversion of this buiiding to wholly residenfial use, whi(e the proposed TN2 zoning can
accommodate fhe proposed use.
7. Because this is a rezoning from one commerciai district to another, no consent petition from
neighboring proper[y owners is required.
8. The properfy is in the Dayfon's B(uff Historic District and the buiiding designs and plans must
receive approval from the Saint Paul Heritage Preservation Commission as well as site plan
review.
I. STAFF RECOMMENDATION: Based on the above findings, staff recommends approvat of the
rezoning from B-2 (Community Business) and P-1 (Parking} to TN2 Traditional Neighborhood for
residentiai or mixed use development.
