Sec. 130.03. Verified petitions and tiling expense.
All petitions filed by owners as provided above shall be verified by the oath of one of the
petitioners that the petition was signed by each of the parties described in the petition and in the
presence of the affiant. Such petitions must be approved by the
real estate division of the department of public works as to form before
submission to the council. The real estate
division of the denartment of nublic works shall certify that the petition is signed by the requisite
number of petitioners and that such petitioners are the owners of the property abutting upon the
street or portion thereof sought to be vacated. For the purpose of verifying titles and ownership,
abstracts of title certified to the date of the petition or to any time thereafter shall be submitted
with the petition. At the time of filing such petitions the owners petitioning therefor shall pay to
the caty clerk one hundred dollars ($100.00) as the filing fee therefor and coverage of the city's
publication, filing and other procedural costs connected therewith.

Section 130, Procedure for Vacating Streets and Other Public Grounds, of the Saint Paul
Legislative Code is hereby amended to read as follows:
Sec. 130.04. Public hearing.
34 (a) The real estate division of the department of
35 public works shall contact all affected city departments, agencies and other units of govemment
36 for the purpose of submitting to the council a report with recommendations conceming the
37 present or future needs and uses of the street under consideration. This report shall be returned to

1 the city councii within sixty (60) days following the date of the request unless the council shall ��`o�
2 grant an extension of time thereof. Upon receipt of the report and recommendations, the council
3 shall fix a date for public hearing to consider the petition and afford an opportunity to ail affected
4 property owners to be heard. The city clerk shall cause notice of the hearing to be published once
5 in the official newspaper of the city, and mailed notice thereof shali be given by the department

real estate division of the depariment of �ublic works to all
owners of land abutting on the street proposed to be vacated. Published notice and mailed notice
shali be made at least twenty (20) days in advance of the public hearing.
(b) The council, at the public hearing or adjournment thereof, shall consider the petition and
may, by resolution adopted by an affirmarive vote of at least five (5) of its members, vacate and
deciare such street or portion thereof vacated and discontinued. The council may condition any
vacation upon terms and conditions and such compensation being paid to the city as shall be set
forth in its resolution. No vacation of any street shall be allowed except upon compliance with all
such terms and conditions as may be established by the city council.
Section 3
That this ordinance revision shall take affect and be in force thiriy (30) days after its passage,
approval and publication.
