C� Council File #E ' � Ordinance # Green Sheet #.7V � 0�3 3�{ THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 10 11 12 13 14 IS 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 Section 6, Department of Public Works, of the Saint Paul Administrative Code is hereby amended to read as follows: 5ec. 6.01. Department generally. (a) Departrnent established. There is hereby established an executive department of the City of Saint Paul to be Irnown as the department of public warks. The head of such deparhnent shall be the city engineer and director, who, prior to such appoinhnent, shall possess such qualifications as the council may by ordinance provide. The deparpnent of public works shall be organized into the divisions of: streets and bridges, traffic and lighting, sewers and utilities, solid waste and energy, equipment services, municipai engineering, real estate, and administration. (b) Departmental functions. The department ofpublic works shall be responsible for the design, engineering, construction, operation and maintenance of the city's publac works projects involving and including all streets, sidewalks, alleys, bridges, sewers, lighting systems, flood-control devices, solid waste collection, disposai and reclamation systems, traffio-control devices, and the coordination of placement of other facilities in the public ways, including gas, electric, steam and water, and prope management, includin�pace allocation and communicarion sYStems, the coordination of buildin€� maintenance, and a svstem of assessments and valuations. (c) City engineer and director powers and duties. The city engineer and director of the department of public works shall be appointed by the mayor with the consent of the council, and shall be in the unclassified service of the city. The city engineer and director shall be accountable to the mayor and, subject to his/her supervision and control, shail administer the affairs of the deparhnent. He/she shall have general authority and control over all departmental staff and shall oversee the proper fulfillment of all tasks and duties ,,. , �. �r zz °oa assigned to the deparhnent. He/she shall have the power to prescribe such rules and o�'l3� regulations as he/she deems necessary or expedient for the proper operation of the department and to that end shall keep himselfflierself informed of the latest administrative 4 practices. Division of real estate. Within the denarhnent of �ublic works, there shall be a division of real estate. Under the sunervision ofthe director,the division shali: j� Maintain a compilation of all city-owned real estate to include a svstem indexin_g all �ro�ertv and pronert�interests of the city. � Administer the sale ar acguisition or lease of real property bv the citv includine. but not limited to, the acc�uisition of oropertv, when necessarv, through eminent domain proceedin¢s and the vacation of streets and public ways. � Administer the assessment orogram relative to the assessment of benefits in connection with the conshuction of local imnrovements. pursuant to polic� established by the council of the Citv of Saint Paul. u Process public hearines to be held bv the citv council relative to assessments, condemnations, demolition of daneerous buildinas, sewer repairs, service charees, and sutnmar� abatements. � Admiiiister the coliection, receipt and maintenance of assessment receivable accounts, advancepavments for sewer and SAC chazges. Assist other city deparhnents and divisions in the collection and receipt of receivables. U�on request to the division, a person shal] be permitted to inspect and copy records conceming assessment receivable accounts and the esrimated costs of�ending local improvement assessment pro�ects. Access to these records shail be provided at a reasonable time and vlace and without char�e to the individual. If the division is asked to provide copies of the data, the actual costs of�rovidin the cooies will be borne bp the individual makin�; the request. If the division is requested to calculate, compile or make copies of assessment data concernine nroperties not owned by the re uesting�artv, the division shall provide the appropriate service within a reasonable time of the request and require the requesting�parry to�av the actual costs of makinQ. certifving and compiling the information requested. The procedures used to nrocess these requests and the calculation of the actual costs of compiling and copvinythis information shall be determined by the division and a�proved by administrative order. 4 � Perforxn citv-wide real properry administration, including. but not limited to. ��� t�^' facility maintenance practices, capital improvements, space aliocation planning, property insurance coveraQe for citv buiidings and equipment, and environmental imvact and liabilitv. � Administer all properties assi�ted to be under the control of the division of real estate. 9 � Administer all annual maintenance assessments and service charQes including, but 10 not limited to, right-of-way maintenance, above-standazd street li�$tine, and 11 storm sewer svstem char�es �ursuant to olicv as established by the councii of the 12 City of Saint Paul. 13 14 15 16 17 18 19 20 21 22 23 (9� Supervise the erection and alteration of public buildings through the: vrenaration of all desi�ns, plans, s�ecifications and esrimates for public buildi�s to be erected or altered by the city or anv departrnent or a ency thereof: and insnection of construction sites to ensure compliance with contract terms and desi�n snecificataons. Section 3 That this ardinance revision shall take affect and be in force thirty (30) days after its passage, approval and publication.
