Section 1
The Saint Paul City Council hereby refers to the Saint Paul Planning Commission and
requests, pursuant to Minn. Stat. § 462355, Subd. 3, that the Planning Commission study the
attached language set forth as Attachment No. lwhich pertains to the repair and maintenance of
advertising signs as a possible amendment to the Saint Paul Zoning Code and to submit a report
and recommendation to the Council.
Section 2
Pending any report and recommendation from the Planning Commission, and for the
purposes of prohibiting the issuance of any zoning or building permits to repair or maintain non-
conforming advertising signs within the city of Saint Paul which would exceed in scope the basic
maintenance and repairs described un�der Attachment No. 1 or as provided in Leg. Code
62.102(¢l, and until such time as a report and recommendation concerning the proposed
ordinance language contemplated under Attachment No. 1 has been completed, and the City
Council has taken action on any recommendations contained therein or has requested and
received additional information and taken acfion, no zoning or building permits for any non-
conforming advertising sign shall be issued or approved by the City, its ofFicers, employees,
agents or commissions which would exceed in scope the basic maintenance and repairs described
under Attachment No. 1 or as nrovided in Lee. Code 62.102(e). This interim ordinance is
enacted for the purposes of protecting the City's planning process and the health, welfare and
safety of its citizens in addition to the other purposes expressed herein or in an accompanying
resolution.

For a period of time not to exceed 12 months from the effective date of this interim
ordinance, and for the purposes of prohibiring any development that might be inconsistent with
the pending study and any amendments to the City's comprehensive plan or zoning regulations,
the prohibitions herein shall continue in full force until a comprehensive policy for the City
relating to the above-described maintenance and repairs can be adopted. In the event the studies
and recommendations of the Planning Commission and the deliberations of the City Council
require additional time, these prohibitions may be extended, by separate action of the City
Council, for additional periods of time not to exceed an additional 18 months as allowed by
Minn. Stat. § 462355, Subd. 4.
Section 4
The reasons stating the need for this interun ordinance are incorporated herein by
reference as set forth in an accompanying resolution of the Council of the City of Saint Paul
which immediately prohibits the issuance of zoning and building permits for repairs to non-
conforming advertising signs pending the adoption of this the interim ordinance.
Section 5
This interim ordinance shall take effect and be in force thirty (30) days from and after its
passage, approval and publication.

billboards as distinct from renovations. Repairs of non-confornung uses aze pernutted under the State law so it is
important that the City's ordinance be clearly stated.

PROPOSED ORDINANCE
It is the intent of the Saint Paul City Council, through this ordinance, to harmonize its policies as
to advertising signs as stated in the Zoning Code §66.214 with newly enacted state statute
§462357 (1)(e).
Zoning Code Section 66.302 shall now read in its entirety:
In keenine with the intent expressed in Section 66 214 it is the further intent of the city council
that advertisin� siens not nermitted bv this chanter shall be eradually removed as thev deteriorate
Advertisin��ns not oermitted bv this chapter shall not be replaced relocated or renovated
Renovation shall mean the replacement of the s�n face the replacement of structural elements
supplementing or reinforcine existing structural elements repositionine footinas or bed frames
addin¢ or uQ rading electrical services or an�provement that extends the life of the advertising
si¢n.
Basic maintenance and reoairs of leeal nonconforming advertising signs shall be permitted
includin� paintine renair of existin� electrical services replacement of border trim replacement
of nuts and bolts and other small connectors and up rading of catwalks and safety cables that
protect company workers.
As used in this subsection, the term structural elements is defined to mean the major components
of an advertisin� sign structure, includine but not limited to footints bedframes ip tch pans
towers or u�r�ight vertical poles kickers sup ortin��r�i�ht noles horizontal stri�ers and
outrig er� s, diagonal bracin� and reinforcin cables
