Section 1.

Statement of Legislative Purpose and Intent: The purpose of this interim ordinance is to
clarify the City CounciPs intent regarding the duration of the interim ordinance establishing the
Arcade Street Study Area in Council Files No. O1-646 and No. O1-648 and the extension of the
interim ordinance in Council File No. 02-514. Council Files No. O1-646 and No. O1-648
established an interim ordinance of twelve months' duration.
The expiration date of the interim ordinance established in Council Files No. O1-646 and No. Ol-
648 was set at twelve months after the effective date of the ordinance or sooner if the planning
commission reported its recommendations back to the City Council for action. Council File No.
02-514 was intended to amend Council File No. O1-648 by extending the interim ordinance for
an additional eighteen months beyond the initial twelve month period as pernutted under Minn.
Stat. § 462355, Subd. 4.
However, the title to Council File No. 02-514 states that the extension is for a six-month period
while the actual amending language in Council File No. 02-514 deletes the term "twelve" and the
numeral "12" and adds the amending term of "eighteen" and the numeral "18." The City
Council, in order to provide for the health, welfare and safety of the citizens of Saint Paul and to
insure the integrity of the planning process initiated pursuant to the interim ordinance, and to
prevent any confusion which might result by construing the six-month period referenced in the
tifle of Council File No. 02-514, together with the language amending the effective date of the
interim ordinance from twelve to eighteen months, did not intend to extend the effective period
of the interim ardinance for six months. It was the intent of the Council to take advantage of the
full time period of thirty months provided for the duration of interim ordinances enacted pursuant
to Minn. Stat. § 462355, Subd. 4.
Section 2.
That Council File No. O1-648, Section 2, is amended to read:

Moratorium imnosed; lands affected: Pending completion of the said study and any other necessary
studies or study recommendauons, and the adoption of any amendments to the comprehensive plan and
zoning code based upon the study or studies as provided under Mivnesota Statute § 462.355, Subd. (4),
the issuance of plan approvals and lot splits or buIlding and zoning permits for any zoned pazcel of land
or part of thereof on Arcade Street between Nevada Avenue East on the north and York Avenue on the
south as depicted on the attached map, shall be prohibited for a period of time not to exceed twe�ve thi
(iz'�� months from the effecrive date of this ordinance.
Section 3.
This ordinance shall become effective thirty (30) days after its passage, approval and publication.
