Department of Neighborhood Housing and Property Improvement Sec. 14.01. Department generally. : t. :I IK; (a) Department established. There is hereby established an executive department of the City of Saint Paul to be known as the department of neighborhood housing and property improvement. The head of such department shail be the director, who, prior to such appointment, shall possess such qualifications as the council may by ordinance provide. (b) Departmental functions. The department of neighborhood housing and property improvement shall be responsible for administering and enforcing city housing and property maintenance codes and shall perform the following functions: (1) Inspect all buildings and properties as required by the city codes. (2) Administer and enforce laws regulating the maintenance of residential property including, but not limited to the city's vacant building program, the city's nuisance dwelling and nuisance abatement ordinances, the city's rental registration ordinance, the city's abandoned motor vehicle ordinance, the city's truth in sale of housing ordinance and program, and the city's graffiti removal program. (3) Maintain appropriate departmental records, including but not limited to, gazbage service billing records if applicabie, excessive consumption of inspection services billing records, graffiti removal billing records, reinspection billing records, nuisance abatement billing records, vacant building registrations, rental registrations, truth in sale of housing disclosure reports, (4) Investigate and enforce the city's boulevazd planting ordinance. CITY OF SAINT PAUL, MTNNESOTA �D t�3 -��`� (5) Enforce violations of the city's codes related to property maintenance, utilizing 2 enforcement tools in accordance with applicable law. 3 4 (c) Director; powers and duties. The director of the department of neighborhood housing 5 and property improvement shall be appointed by the mayor with the consent of the council, and 6 shall be in the unclassified service of the city. The director shall be accountable to the mayor and, 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 subject to supervision and control, shall administer the affairs of the department. The director shall have general authority and control over all departmental staff and shall oversee the proper fulfillment of all tasks and duries assigned to the department. The director shall have the power to prescribe such rules and regulations as aze deemed necessary or expedient for the proper operation of the department and to that end shall keep informed of the latest administrative practices. The director may designate, with the approval of the mayor, an employee of the department of neighborhood housing and property improvement to perform the functions and duties assigned to the director by law during the absence or disability of the director. The director shall have the power and duty to take all personnel actions, including hiring, assigning and reassigning employees, including supervisory personnel, within the department, and shall supervise their performance. Reorganizauon plans have proceeded to � the implementation stage. See Green Sheets No. 3004050 and No. 3004051 as part of the new vision and professionalism. It is appropriate to change the name and create the new Depaztment. AdvanWges If Approved: Under the City Council's leadership (Chronic Problem Properties report) the City now has an effecUve way to ensure that problem properties do not plague our neighborboods and quality of life. Under the leadership of Mayor Kelly, Code Enforcement has achieved a more proactive, more visible, more consistent, stepped-up approach to all properties. (Explain) J.� - ��� Memorandum CTI'Y OF SAINT PAUL TO: Dan Bostrom, City Council President Jerry Blakey, Councilmember Christopher Coleman, Councilmember Patrick Hams, Councilmember Jay Benanav, Councilmember Kathy Lantry, Councilmember 1�3�IT� SUBJECT: DATE: Andy Dawkins � � �-�-o Update on Green Sheet No. 3004051 (Code Enforcement Excessive Consumption) and Green Sheet No. 3004050 (Rental Registration) November 5, 2003 At the public hearing on October 22" two amendments were discussed that were not in fmal form on the 22" but are now included in today's packet: #3004051 now includes a Section 8(on page 6) that gives landlords an affirmative defense to a misdemeanor prosecution if the tenant caused the violation and the landlord took all necessary steps to enforce the lease. #3004050 now includes a Section 3(on page 4) that exempts Public Housing A�ency scattered site rental properties from the rental registration fee but the PHA must still annually provide a list of their properties which are still subject to rental registration regulations. II. I have reviewed both green sheets, as amended per the above, with Bill Cullen (St. Paui Association of Responsible Landlords) and Brian Strube (St. Paui Association of Realtors) and they both have si�ned-off in sUDDOrt of the two proposals. III. If given the opportunity I would like to clarify for the public record the three "triggers" that will be in place if the legislation is enacted: For both owner-occupied properties and rentai 1's and 2's, excessive consumption occurs when either (a) the property is not compliant at the time of a re-ins�ection after findin� a violation and giving a reasonable time to comply, or (b) there is a third initiai inspection within 12 months and a violation was found at each initial inspection. 2. For just rental 1's and 2's, an interior inspection can be requested whenever (a) excessive consumption has occurred, or (b) rental registration has been revoked. 3. For just rental 1's and 2's, a Notice of Intent to Revoke Registration can be mailed whenever (a) there is one or more documented nuisance incidents with regazds to the property, (b) there are outstanding code violations, or (c) excessive consumption has occurred �lus one additional inspection discloses a violation.
