An ordinance amending the interim ordinance adopted pursuant to Minnesota Statute § 462.355,
Subd. 4, in Council File No. 02-1115 on December 26, 2002, which preserved the status quo
with respect to the use of property in the Sunray area
The Council of ihe City of Saint Paul does ordain:
That Council File No. 02-1115 be amended by adding a new section 3.1 to read:
Section 3.1
Additional Exem tions: In order that the developers of a proposed Cub Foods grocery store
may apply for, and if approved, receive zoning and building permits necessary to undertake the
said development, the developers are exempted from the prohibitions established under this
interim ordinance. The owners of presently existing businesses which may be relocated as a part
of establishing the proposed Cub Foods grocery store aze also exempted from the prohibitions
established under this interim ordinance so that the said owners may also apply for and, if
approved, receive any zoning or building pernuts necessary to undertake construction in a new
location within the Sunray Shopping Center.
