THE COUNCiL OF THE CITY OF SAIN'I' PAUL DOES ORDAIN:
Section 1.
11 Amending ordinance: council findings and statement of legislative intent. The term of the
12 interim ordinance initiated pursuant to Council File No. O1-648 provided, at section 2, that the
13 planning process would not exceed twelve months from the effective date of the interim
14 ordinance. In Council File No. 02-154, section 2 of Council File No. Ol-b48 was amended to
15 provide that the planning process would not exceed eighteen months from the effective date of
16 the interim ordinance. Section 4 of Council File No. O1-648 provided further that the term of the
17 interim ordinance could, if necessary, be extended for an additional period not to exceed eighteen
18 months. The Council now finds that it is necessary to invoke the extension contemplated in
19 section 4 of Council File No. 01-648 as the planning process for the Arcade St. Area has not yet
20 been completed.

The Council further finds that the regulations established under Council File No. O1-648 will
expire during the City's process for enacting this amending ordinance as required under the City
Charter. It is the Council's intent to presently conrinue the regulations established under Council
File No. O1-648 by passage of a separate resolution in Council File No. to insure that
the regulations established under Council File No. O1-648 continue until such time as this
amending ordinance takes effect.
Section 2.
Amendment. That section Z of Council File No. O1-648 is amended to read as follows:

Moratorium imuosed; lands affected: Pending completion o the said study and any other �
necessary studies or study recommendatiions, and the adoption of any amendments to the .
comprehensive plan and zoning code based upon the study or studies as provided under � 13 03
Minnesota Statute § 462.355, Subd. (4), the issuance of plan approvals and lot splits or building
and zoning permits for any zoned parcel of land or part of thereof on Arcade Street between

Nevada Avenue East on the north end of the Arcade Street Bridge on the south as depicted on the tJ3 -��8'
attached map, shall be prohibited for a period of time not to exceed thirtV eighteen (3�$) months
from the effective date of this ordinance.
Secrion 3.
Amendment. That section 4 of Council File No. O1-648 shall be amended by eliminating the
section as its provisions, with the enactment of this amending ordinance, aze no longer needed:

Section 4.
This ordinance amending Council File No. O1-648 shall become effective thirty (30) days after its
passage, approval and pubiication.
