That I,egislative Code Chapter 64 is hereby amended by adding a new section 64.106 to read as
follows:
Sec.64106. Fees.
(a) Authoritv. Pursuant to Minn. Stat. § 462353. Subd.4, there are hereby established various
fees to defray the costs incurred in administering official zonine controls established �ursuant to
Minn. Stat. §§ 462351-364 which shall be paid by zonine annlicants to either the office of
license, inspections and environmental protection or the de�artment of �lannine and economic
develo�ment, as the case may be, based upon the tyne of official control avplication and whether
action on the official control application is reviewed bv fhe board of zonine apneals, the nlanning
commiss3on, the zonine administrator or the planning administrator. A fee for an appeal to the
city council from a zonin¢ control decision shall be paid to either the office of license,
inspections and environmental protection or the departrnent of planning and economic
develo�ment, as the case may be, based upon the type of official control application sought b�
the zonin� applicant. _
(bl Fee schedule: amendment of fees. Fees for the followine zonin¢ control applications shall be
as set forth in the schedule below. Zoning control application fees may be amended from time to
time b�rdinance. A conv of the fee schedule shall at all times be maintained in the office of the
citv clerk and displaved in the office of license, inspections and environmental protection and the
d�artment of vlanninQ and economic develo�ment.

maximum additional fee of $345, to offset costs associated with investi¢atin� O � _ `OZ

� Refunds
For a zonin¢ case withdrawn before £nal approval, the zonin¢ or planning
administrator may refund part of the fee based upon the proportion of the work
com�leted at the time of withdrawal.
17 Lazee sites
For lazae sites where onlv a portion of the site is affected bv the zonine action, the
zonine or plannine administrator may set the fee based on the size of the affected
portion of the site.
� Fee for permits and approvals sub,�ect to annual review condition. A holder of a conditional
use permit, nonconfornun, u�se pernut or variance, which the plannine commission, boazd of
zonin�a�peals, or citv council, has ap�roved subject to annual review, shall pay to the office of
license, inspections and environmental protection, at the time the zonin� administrator provides
notice of the annual review to the permit holder, an annual review fee in the sum of $50.
Section 2
This ordinance shall become effective thirty (30) days after its passage, approval and
publication.

In the past, fees were established by resolution. This Ordinance would put them in the legislaflve code as required by state law.
Currently, fees chazged cover approximately 50% of operating costs for services associated with reviewing, investigating and
administering Saint Paul's zoning activiries.

RE: Planning Commission recommendation on 03-1029 - an ordinance amending the Zoning Code
pertaining to administration of the Zoning Code and setling fees to defray the costs of
reviewing, investigating and administering services, materials, and work performed and
furnished to persons making zoning applications to the City.
Dear President Bostrom and members of the City Council:
LIEP has initiated an ordinance establishing zoning fees in the City Zoning Code and increasing existing
fees 25%. Minnesota Statutes §462.357 Subd. 4 requires that an amendment to the zoning ordinance
shall be referred to the planning agency for study and report.
The Planning Commission supports the proposed fees. The proposed fees are reasonable for the services
provided and in line with similar fees in other communities.
The zoning fees ardinance initiated by LIEP amends existing Chapter 64 Administrarion and Enforcement
of the Zoning Code. However, it has been transmitted to the City Council at the same time as an
ordinance that reformats the entire Zoning Code, including renumbering and substantially restructuring
the Administration and Enforcement chapter as Chapter 61.
Attached is an alternative zoning fees ordinance that should be substituted for the ordinance initiated by
LIEP if it is adopted at the same time or after the ardinance amending Chapters 60-69 of the Saint Paul
Legislative Code pertaining to zoning code reformatting and related amendments. If the fees ordinance is
adopted first, the Council should move iYs intent to have the Zoning Code reformatting ordinance
amended as in the attached alternative zoning fees ordinance. In addition, if the fees ordinance amending
Chapter 64 is adopted first, it should be amended to delete Sections 64.203(e), 64.204(d) and 64300(1),
all of which state fees are to be established by resolurion of the City Council and are therefore
inconsistent with the new language that establishes the fees right in the ordinance.
