The East Consofidated Smali Area Plan (1993) recommends creating parking at the rear of buildings along Payne Avenue by acquiring and demolishing up to 120 feet of properiy and creating strong landscaping buffers...between the parking area and the adjoining residential areas. This rezoning application is in substantial compliance with fhis recommendation, since the property to be rezoned extends 100 ft. west of the alley separating fhe commercial property along Payne from the proposed parking lot. 6. The planning commission may grant modificafions of §62.104 based on findings that such modification is consisfent with the intent of the code and wifh the reasonable enjoyment of adjacent property, A new site plan was submitted at the site plan review meeting on May 1, 2002. It appears that the site plan meets the requirements of §62, iO4 with the . exception of the setback requirements for the P-1 District when it adjoins a disfrict that requires a greater setback than 4 ft. and the requirement for a visuai screen along the minimum front yard setback line. The RT-2 District requires a 25 ft. setback or the average of the biock. The site plan shows a setback of 26.1 ft. at the southwest corner of the parking lot for a distance of approximately 37 ft. rather than the full width of the parking lot. They are also proposing an ornamental fence and landscaping that does not meet the requirements for a visuaf screen (of sufficient height and densily to visua{ly separate the screened activity from adjacent property). Modifying these conditions would be consistent with the intent of the code, which is to maintain the character of the surrounding area, and reasonable enjoyment of adjacent property. The initial setback � continues the character of the residential uses to the south and provides a transition to the more commercial character of the land uses to the east and south. The landscaping proposed for this portion of the parking lot wili be consistent with the portion focated in the S-3 zoning district. (8) P-1 Vehicular Parkrng Districts shall be developed and maintained in accordance with the requirements of §62.104. The appiicant is working and will continue to work with city staff to meet the requirements of §62.� 04 regarding the design of this lot, meeting this condition. An updated pfan that addresses landscaping and drainage issues and hours of operation wili be ready for the Planning Commission meeting on May 10, 2002. Ms. James stated the zoning staff recommends approval of the rezoning. Upon question of Commissioner Faricy, Ms. James stated if the restaurant stays open for 24 hours the lot wiI{ always be in use. Prior to the restaurant staying open 24 hours the zoning staff is asking that the condition of the fence be modified because the entrances are fairly removed from the adjacent residential uses the bushes wil4 screen the mutti-fainily residences. Mr. Jeremy Lenz, representative of the applicant, appeared and stated the parking tot was requested by Mr. Frish, Neighborhood Association and other business owners on the avenue because of the need for parking in the immediate area. No one spoke in support or opposition. The hearing was closed. Commissioner Kramer moved approval of the rezoning.
