The Council of the Ciry of Saint Paul does ordain:

Statement of legislative intent: The City's 19991and use component of the
comprehensive Plan calls for refining neighborhood area planning studies to insure that any
amendments to the zoning code resulting from neighborhood area siudies conform with the
comprehensive plan. Studies of various City neighborhoods have recently taken place in keeping
with the City's strong tradition of neighborhood area planning.
Two study azeas have been located in eastside neighborhoods. A study of the Arcade
Slreet Area is presendy underway and the White Bear Avenue Area study was recently
completed. The White Bear and Arcade study areas are characterized by a unique mix of
commercial and residential land uses which reflect historical development patterns in the City's
eastside neighborhoods. In particular, the White Bear Avenue Area study refened to this
historical development pattern as a"denser, street car type of development along the southern
portion of the corridor to the mare suburban, auto oriented development at the northern end."
The City's Sunray area directly abuts the southern boundary of the White Bear Avenue
Study area. Development within the Sunray area is generally chazacterized by a dense
concentration of community and general business zoning districts at its core and multiple family
housing zoning districts along its edges. These community and general business districts have
the "suburban, auto oriented" development pattern noted in the White Beaz Avenue Area study.
The Sunray community and general business districts form one of the major commercial and
employment centers in the City. Because these communiry and general business districts form
the eastern gateway to the City along interstate 94, it must become a priority of the City to insure
opportunities for continued growth and prosperity in the Sunray area. The recent and explosive
growth in retail and commercial activity in municipalities directly to the east of the Sunray area
present direct economic challenges to the many commercial and retail businesses in the Sunray
Area.
In order to compliment and build upon the vision contained in the recent White Bear
Avenue Study area and to insure the continued prosperity of the Sunray commercial and PU3USNFID

employment center, a study of the existing pa�ern of official controls, as defined in Minn. Stat. §
462352, Subd. 15, in the Sunray area must be underCaken to identity potential land use problems
and to create land use solutions that will build neighborhood vitality and create economic
opportuniries in this unportant gateway neighborhood.

Pending the completion of such a study by the City's Department of Planning and
Economic Development and the Plaiming Commission and their recommendations to amend the
City's comprehensive plan and zoning code and the City Council's adoption of such
recommendations, and for the overall purpose of protecting the City's planuing process, a
moratorium of limited duration must be enacted for the purpose of prohibiting developments
which may be inconsistent with comprehensive plan development and zoning code objectives for
the Sunray azea.
Section 2
Moratorium imposed: lands affected: Pending completion of the said study and any
other necessary studies or study recommendafions, and the adoption of any amendments to the
comprehensive plan and zoning code based upon the study or studies, as provided under Minn.
Stat. § 462355, Subd. (4), the issuance of approvals for plats, lot splits or building and zoning
permits for any parcel of land or part thereof within the areas of the Sunray Study Area, as set
forth below, shall be prohibited for a period of time not to exceed twelve (12) months from the
effective date of this ordinance. Until such time as said study has been completed and the
Council has reviewed its recommendafions for possible adoption, city depattments receiving
written applications far the approvals noted above shall accept the applications and immediately
process them in accordance with the provisions of Minn. Stat. § 15.99, Subd. 2 and with the
intent of this interim ordinance. The lands affected by this interim ordinance shall be within the
following boundary: ,

. N. McKnieht Road and Wilson Avenue West to Kennard Street
South to Burns Avenue East to Ruth Street North to I-94 East to N. McKnieht Road and North to
Wilson Avenue. ^
Section 3
Moratoriam, exemptions: The following are exempted from the moratorium provisions
imposed under Section 2:
1. Building, plumbing, mechanical and electrical permits for repairs or minor alterations
to conforming or non-confornung structures, or for work on dangerous or vacant
buildings administered under Leg. Code Chapter 43, or for work on single or multi-
family residential structures or uses.
2. Demolition permits for nuisance buildings pursuant to Leg. Code Chapter 45.
3. For work on sinele or multi-familv residential structures and institutional uses on
residentiallv zoned land.
Section 4
The restrictions enacted herein may be extended by the Council of the City of Saint Paul
for additional periods not to exceed an additional eighteen (18) months in the event the studies

and recommendations of the Planning Commission and the deliberations of the Saint Paul City
Council require such ea-tensions.
Section 5
This interim ordinance for the Sunray area shall take effect and be in force 30 days from
and after its passage, approvai and publication.
