Section 366.05.2 of the Saint Paul Legislative Code is hereby amended to read as follows:
Sec. 366.05.2. Licensed vendors; restrictions.
No �erson who is licensed under Chapter 331A with the followin�
licenses: Customer apnreciation - Food sales. Food give-away, Mobile food cart, Mobile food
vehicle. Mobile food cartJvehicle non-nrofit, Retail food establishment - Temporarv, S�ecial
event food sales - 1 to 3 da�. Special event food sales - 4 to 14 davs, Snecial event food sales -
Annual, 3pecial Event food sales - Extension, 3pecial event food sales - Non-profit �6

Chapter 345 shall operate his or her business within two thousand (2,000) feet of any area for
which a pernut has been issued under this chapter, except when such licensee has obtained
written pernussion from the organizers of the event.

INITIATING PROBLEM, ISSUE, OPPORTUNITY (Who, What, When, Where, Why):
he Office of License, Inspections and Environmental Protection has proposed changes to chapter 310 regarding the license fees
charged, chapter 331A regarding the definirion of a special event as well as several other food related license categories, and the
ddition of several new license categories within chapters 310 and 331A. During the revisions of chapters 310 and 331A it was
determined that chapter 366 was closely related to both of those chapters. Some of the terms and license types referred to in chapt
366 were no longer valid license categories. Additionally, the new license categories aze not included in chapter 366. To provide
onsistency between these three related ordinances we aze proposing that section 366.05.2 be amended, as proposed.
VANTAGES.IF APPROVED:
e City will have consistency among the food, the license and the block party, community festival and special event ordinances.
Consistency will make it easier to properly interpret the ordinances. Consistency will also allow enfarcement of the applicable
rdinances with less chance of losing in court.
ISADVANTAGES IF APPROVED:
f the proposed changes to chapters 310 and 331A are not approved, chapter 366 will continue to be in conflict with chapters 310
d 331A.
ISADVANTAGES IF NOT APPROVED:
is ordinance will not refer to the appropriate license categories and other terms defined in chapter 331A. This will be confusing
