facility for patrons
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1
Section 331.10 of the Saint Paul Legislative Code is hereby
amended to read as follows:
Sec. 331.10. Sanitary facilities and controls.

(e) Toilet facilities.
(1) Every food establishment, except mobile food vehicles,
shall be provided with conveniently located and
approved toilet facilities for employees which are kept
clean, in good repair, and free from flies, insects and
offensive odors. Separate employee toilet rooms shall
be provided for each sex when five (5) or more
employees may be on duty at any one (1) time.
(2) Toilet fixtures�and seats shall be of a sanitary design
and readily cleanable. Receptacles for waste material
shall be provided; shall be easily cleanable,
nonabsorbent and leak-proof; shall be kept clean; and
shall be covered in toilet rooms for women. An adequate
supply of toilet tissue shall be provided and
maintained in each toilet stool at all times.
(3) The doors of all toilet rooms shall be tight-fitting
and self-closing. Mechanical ventilation shall be
installed and used to provide a minimum of at lea5t ten
(10) changes of air per hour.
(4) When toilet facilities are provided for customers, the
facilities shall meet the requirements of this

(5) All food establishments that either serve alcoholic ,�
beverages and/or have seating capacity of fifty (50) or
more shall provide separate male and female toilet and
lavatory facilities, convenient to the dining area,�
and/or beer shall be exempt from this requirement
provided that thev have fewer than fiftv seats.
Section 2
This ordinance shall take effect and be in force thirty (30) days
following its passage, approval and publication.

Currently, the Saint Paul Legislative Code requires all food establishments
ith a seating capacity of fifty (50) or more, and/or food establishments that
serve alcoholic beverages, to provide separate bathroom facilities for males
and females. This is viewed as an onerous and unneceasary regulation for food
establishments that only serve wine and/or beer.
