No member may hold any office or employment under the city. A member shall cease to be a member of the com- mission upon becoming a candidate for elective city office. The council may, by administrative ordinance, provide compensation and reimbursement of e%penses for the commissioners and establish a procedure for the appointment of altemates. Any member may be removed by the council for cause after a hearing. Proceedings for removal may be initiated by the mayor, the council or the board of education. Sec. 12.03.1. Civil service divisions. The civil service of the City of Saint Paul shall consist o£the classified and unclassi£ed service. Sec. 12.032. Unclassified service. The unclassified service shall comprise: (A) Elected o�cials. B) Heads of executive departments. (C) A secretary to the mayor. (D) The city attomey and deputy and assistant city attomeys, subject to Section 5.03. (E) The fire chief, and police chief, and per- sonnel director. (F) The city clerk. Sec. 12.04. Duties of the civil service commis- sion. Sec. 12.04.1. Hearing of grievances. The civil service rules shall include provisions establishing a formal procedure for the review of employee grievances not covered under labor agree- ments. After exhausting the formal grievance proce- dure, the complaining employee may petition the civil service commission for a hearing and the commission shall, within a reasonable time, con- duct a hearing at which all parties to the griev- ance or their representiatives may be heard. The commission shal] have the power to issue sub- poenas and to administer oaths and to compel the attendance and testimony of witnesses and the production of books and papers relevant to the grievance. The commission may make complaint to the district court of disobedience of its sub- pcena or orders under this section. Following the hearing, the commission shall promptly rule on the grievance petition. Its decision shall have such binding effect as the civil service rules prescribe. (Ord. Any person who believes that there has been a violation of Sections 12.01, 12.11, 12.11.1, 12.112, 12.11.3, or 12.11.4 of the Charter which directly aggrieves such person may apply to the commis- sion to investigate the matter. The commission shall conduct such investigation when in its judg- ment, the matter is oF substantial merit with respect to the applicant or other persons similarly situated. The wmmission may require any offi- cial or employee to provide data or testimony to assist in such investigation and shall file a report of its findings and recommendations with the mayor and the city council and the board of education oF independent school distriot aumber 625. Sec. 12.05. Director of personnel—Duties. The director of personnel shall manage the per- sonnei system of the city in a manner consistent with the provisions of Section 12.01 of the Chaz- ter. The director shall be subject to the control and supervision of the mayor. Sec. 12.06. Civ1 service rules and amendments. At the direction of the mayor, or on his or her own initiative, the director of personnel shall pre- pare personnel rules for review and adoption by the council. The rules shall deal vrith all matters necessary to the administration of the city per- sonnel system on a merit basis. The eouncil may by resolution adopt any or all of such rales with or without amendment or they may initiate their own proposed rules. Such rules or amendments which are approved by the council shall be sub- mitted within five (5? days of their passage to the civil service commission for their approval or re- jection. Within ten (10) business days the civil service commission shall either approve and sign the measure or shall return it to the council with a communication in writ.ing stating their disap- proval and the reason therefor. If the commission neither signs nor vetoes the measure within ten Supp. No. 2 (10) business days, it shall be deemed approved. Any such measure which is vetoed by the civil service commission may be reconsidered by the council and shall become law if passed by an af- firmative vote of at least five (5) members of the council within thirty (30) days of the veto. Status of employees and officers. 5ec. 12.07.1. Retention of positions. Every person holding a probationary or regular appointment to a position in the classified service at the time this Charter takes effect shall retain his or her position until discharged, promoted or transferred in accordance with the provisions of this Charter and the personnel rules. Probation- ary employees shall acquire such protection at the completion of their probationary period in the same manner as if this Charter had not been adopted. Sec. 12.072. Employees' rights and salaries. Allowances for vacation, sick �eaves, pension and retirement, and other rights of employees accrued when this Charter takes effect, shall not be afFeeted by the adoption of this Charter. No salary of any current employee shall be reduced as a result of the adoption of a Charter amendment. Sec. 12.07.3. Protection of employees in newly unciassified positions. The Chief indicated that this change was critical to the operations of the department's responsive services. As a division manager, this position reports directly to the Fire Chief requiring greater confidentiality due to the influence on policy decisions. The Chief also indicated that in 1996 the Emergency Paramedical Services Chiefwas upgraded to the levei ofDeputy Fire Chief. Positions in the Deputy Fire Chief class aze in the unclassified service. The Cluef Further indicated that the incumbent was retiring and now was the best time for implementing the change. At the direction of the mayor, or on his or her own initiative, the director of personnel shall pre- pare personnel rules for review and adoption by the council. The eouncil may by resolution adopt any or all of such rales with or without amendment or they may initiate their own proposed rules. Such rules or amendments which are approved by the council shall be sub- mitted within five (5? days of their passage to the civil service commission for their approval or re- jection. All appointments shall be from among the qual�ed voters of the city who aze in known sympathy with the application of inerit prineiples to public employment. No member may hold any office or employment under the city. A member shall cease to be a member of the com- mission upon becoming a candidate for elective city office. The council may, by administrative ordinance, provide compensation and reimbursement of e%penses for the commissioners and establish a procedure for the appointment of altemates. Any member may be removed by the council for cause after a hearing. Proceedings for removal may be initiated by the mayor, the council or the board of education. Sec. 12.03.1. Civil service divisions. The civil service of the City of Saint Paul shall consist o£the classified and unclassi£ed service. Sec. 12.032. Unclassified service. The unclassified service shall comprise: (A) Elected o�cials. B) Heads of executive departments. (C) A secretary to the mayor. (D) The city attomey and deputy and assistant city attomeys, subject to Section 5.03. (E) The fire chief, and police chief, and per- sonnel director. (F) The city clerk. Sec. 12.04. Duties of the civil service commis- sion. Sec. 12.04.1. Hearing of grievances. The civil service rules shall include provisions establishing a formal procedure for the review of employee grievances not covered under labor agree- ments. After exhausting the formal grievance proce- dure, the complaining employee may petition the civil service commission for a hearing and the commission shall, within a reasonable time, con- duct a hearing at which all parties to the griev- ance or their representiatives may be heard. The commission shal] have the power to issue sub- poenas and to administer oaths and to compel the attendance and testimony of witnesses and the production of books and papers relevant to the grievance. The commission may make complaint to the district court of disobedience of its sub- pcena or orders under this section. Following the hearing, the commission shall promptly rule on the grievance petition. Its decision shall have such binding effect as the civil service rules prescribe. (Ord. Any person who believes that there has been a violation of Sections 12.01, 12.11, 12.11.1, 12.112, 12.11.3, or 12.11.4 of the Charter which directly aggrieves such person may apply to the commis- sion to investigate the matter. The commission shall conduct such investigation when in its judg- ment, the matter is oF substantial merit with respect to the applicant or other persons similarly situated. The wmmission may require any offi- cial or employee to provide data or testimony to assist in such investigation and shall file a report of its findings and recommendations with the mayor and the city council and the board of education oF independent school distriot aumber 625. Sec. 12.05. Director of personnel—Duties. The director of personnel shall manage the per- sonnei system of the city in a manner consistent with the provisions of Section 12.01 of the Chaz- ter. The director shall be subject to the control and supervision of the mayor. Sec. 12.06. Civ1 service rules and amendments. At the direction of the mayor, or on his or her own initiative, the director of personnel shall pre- pare personnel rules for review and adoption by the council. The rules shall deal vrith all matters necessary to the administration of the city per- sonnel system on a merit basis. The eouncil may by resolution adopt any or all of such rales with or without amendment or they may initiate their own proposed rules. Such rules or amendments which are approved by the council shall be sub- mitted within five (5? days of their passage to the civil service commission for their approval or re- jection. Within ten (10) business days the civil service commission shall either approve and sign the measure or shall return it to the council with a communication in writ.ing stating their disap- proval and the reason therefor. If the commission neither signs nor vetoes the measure within ten Supp. No. 2 (10) business days, it shall be deemed approved. Any such measure which is vetoed by the civil service commission may be reconsidered by the council and shall become law if passed by an af- firmative vote of at least five (5) members of the council within thirty (30) days of the veto. Status of employees and officers. 5ec. 12.07.1. Retention of positions. Every person holding a probationary or regular appointment to a position in the classified service at the time this Charter takes effect shall retain his or her position until discharged, promoted or transferred in accordance with the provisions of this Charter and the personnel rules. Probation- ary employees shall acquire such protection at the completion of their probationary period in the same manner as if this Charter had not been adopted. Sec. 12.072. Employees' rights and salaries. Allowances for vacation, sick �eaves, pension and retirement, and other rights of employees accrued when this Charter takes effect, shall not be afFeeted by the adoption of this Charter. No salary of any current employee shall be reduced as a result of the adoption of a Charter amendment. Sec. 12.07.3. Protection of employees in newly unciassified positions.
