CITY CHARTER
625. Terms shall be six (6) yeazs, eacept that one
of the three (3) members first appointed shall serve
for a term of two (2) years and one for a term of
four (4) yeazs. All appointments shall be from
among the qual�ed voters of the city who aze in
known sympathy with the application of inerit
prineiples to public employment. No member may
hold any office or employment under the city. A
member shall cease to be a member of the com-
mission upon becoming a candidate for elective
city office. The council may, by administrative
ordinance, provide compensation and reimbursement
of e%penses for the commissioners and establish a
procedure for the appointment of altemates. Any
member may be removed by the council for cause
after a hearing. Proceedings for removal may be
initiated by the mayor, the council or the board of
education.

Sec. 12.03. Classified and unclassified.
Sec. 12.03.1. Civil service divisions.
The civil service of the City of Saint Paul shall
consist o£the classified and unclassi£ed service.
Sec. 12.032. Unclassified service.
The unclassified service shall comprise:
(A) Elected o�cials.
B) Heads of executive departments.
(C) A secretary to the mayor.
(D) The city attomey and deputy and assistant
city attomeys, subject to Section 5.03.
(E) The fire chief, and police chief, and per-
sonnel director.
(F) The city clerk.
(G) Members of boards and commissions.
(I� Such additional positions as shall be assigned
by ordinance to the unclass�ed service,
with Lhe consent of the civil service com-
mi�sion.

The classified service shall include ali other
positions in the city service, including offices her�
inafter created and not egciuded therefrom. All
class�ed employees shall enjoy the benefits and
protection and be subject to the civil service rules
and no permanent employee in the classified ser-
vice shall be discharged eacept for cause and upon
such hearing as the civil service rules or other
law prescribe.
Sec. 12.04. Duties of the civil service commis-
sion.
Sec. 12.04.1. Hearing of grievances.
The civil service rules shall include provisions
establishing a formal procedure for the review of
employee grievances not covered under labor agree-
ments. After exhausting the formal grievance proce-
dure, the complaining employee may petition the
civil service commission for a hearing and the
commission shall, within a reasonable time, con-
duct a hearing at which all parties to the griev-
ance or their representiatives may be heard. The
commission shal] have the power to issue sub-
poenas and to administer oaths and to compel the
attendance and testimony of witnesses and the
production of books and papers relevant to the
grievance. The commission may make complaint
to the district court of disobedience of its sub-
pcena or orders under this section. Following the
hearing, the commission shall promptly rule on
the grievance petition. Its decision shall have such
binding effect as the civil service rules prescribe.

Sec. 12.04.2. Studies.

ment and effect of this chapter and the obser-
vance of the provisions and the rules established
hereunder.

Sec. 12.04.3. Other duties.

tions not inconsistent with the Charter as the
council may prescribe by adm;n;.cfrative ordinance.
Sec. 12.04.4. Investigations.
Any person who believes that there has been a
violation of Sections 12.01, 12.11, 12.11.1, 12.112,
12.11.3, or 12.11.4 of the Charter which directly
aggrieves such person may apply to the commis-
sion to investigate the matter. The commission
shall conduct such investigation when in its judg-
ment, the matter is oF substantial merit with
respect to the applicant or other persons similarly
situated. The wmmission may require any offi-
cial or employee to provide data or testimony to
assist in such investigation and shall file a report
of its findings and recommendations with the mayor
and the city council and the board of education oF
independent school distriot aumber 625.
Sec. 12.05. Director of personnel—Duties.
The director of personnel shall manage the per-
sonnei system of the city in a manner consistent
with the provisions of Section 12.01 of the Chaz-
ter. The director shall be subject to the control
and supervision of the mayor.
Sec. 12.06. Civ1 service rules and amendments.
At the direction of the mayor, or on his or her
own initiative, the director of personnel shall pre-
pare personnel rules for review and adoption by
the council. The rules shall deal vrith all matters
necessary to the administration of the city per-
sonnel system on a merit basis. The eouncil may
by resolution adopt any or all of such rales with
or without amendment or they may initiate their
own proposed rules. Such rules or amendments
which are approved by the council shall be sub-
mitted within five (5? days of their passage to the
civil service commission for their approval or re-
jection. Within ten (10) business days the civil
service commission shall either approve and sign
the measure or shall return it to the council with
a communication in writ.ing stating their disap-
proval and the reason therefor. If the commission
neither signs nor vetoes the measure within ten

(10) business days, it shall be deemed approved.
Any such measure which is vetoed by the civil
service commission may be reconsidered by the
council and shall become law if passed by an af-
firmative vote of at least five (5) members of the
council within thirty (30) days of the veto. Any
such measure which has been reconsidered by the
council and repassed shall be deemed approved.

Sec. 12.07. Status of employees and officers.
5ec. 12.07.1. Retention of positions.
Every person holding a probationary or regular
appointment to a position in the classified service
at the time this Charter takes effect shall retain
his or her position until discharged, promoted or
transferred in accordance with the provisions of
this Charter and the personnel rules. Probation-
ary employees shall acquire such protection at
the completion of their probationary period in the
same manner as if this Charter had not been
adopted.
Sec. 12.072. Employees' rights and salaries.
Allowances for vacation, sick �eaves, pension
and retirement, and other rights of employees
accrued when this Charter takes effect, shall not
be afFeeted by the adoption of this Charter. No
salary of any current employee shall be reduced
as a result of the adoption of a Charter amendment.
Sec. 12.07.3. Protection of employees in newly
unciassified positions.
When a position in the unclass�ed service is
created under terms of this Charter, any person
who has served satisfactorily in the affected posi-
tion for at least five (5) continuous years prior to
the position change shall be entitled to retain, for
two (2) years or until transferred into a classified
job, whichever is the shorter period, ali rights
and privileges to which that person would have
been entitled in a class�ed job.

Back�round
In August of 2000, the Office of Human Resources received a request from the Fire Chief to place
the Emergency Paramedical Services Chief position in the unclassified service. The Chief
indicated that this change was critical to the operations of the department's responsive services.
As a division manager, this position reports directly to the Fire Chief requiring greater
confidentiality due to the influence on policy decisions. The Chief also indicated that in 1996 the
Emergency Paramedical Services Chiefwas upgraded to the levei ofDeputy Fire Chief. Positions
in the Deputy Fire Chief class aze in the unclassified service. The Cluef Further indicated that
the incumbent was retiring and now was the best time for implementing the change. Section
12.03.1 o€the City Charter establishes the Ciuil Service.divisions o£Yhe City of Saint Paul.. _
Section 12.032 states that the unclassified service shall consist of Elecfed Officials, Department
Heads, Secretary to the Mayor, the City Attomey, Deputy City Attomeys, and Assistant City
Attorneys, the Fue Clue� the Police Chie� the Human Resources Director, the City Clerk,
members of boards and cominissions, and such additional positions as shall be assigned by
ordinance to the unclassified service, with the consent of the Civil Service Commission.

Job Description
This position performs highly responsible manageriai work directing tfie emergency paramedical
services (EMS) operation of the Departme� o£Fire and Safety Servtces. The respons�ilities
include developing and implementing policies and procedures, planning, certification, tra nin
evaluating the EMS operation, a;n the budget, assuring compliance with medical
guidelines and feder�l, state and local regulations and standards, and coordinating the activities of
the EMS operations and fire suppressioa Generai supervision is provided by the Fire Clne£
Supervision esercised by the position is general and technical, either directly or through
subordinate supervisors, over emergency paramedical services assigned personnel. Specific duties
that may be performed aze descn'bed in the attached class specification
Comparison to Other Positions
The duties that have been assigned to the position in question aze consistent with those of other
s�tnilaz positions in the unclassified service. Tliere are no specific criteria for determining whether
positions should or shouidn't be placed in the unclassified service in accordance with the provisions
of the City Charter. Positions that have been placed in the unclassified service have either reported
directly to the Mayor or the City Cauncil, had responsibility for carrying out the initiatives of the
Mayor's Administration or the Ciry Council, or reported directly to a department head as either a
confidential assistant or division manager. In pazamilitary organizarions like the Fire and Police
Departments the unclassified positions have been administrative assistants and managers at a high
level in the chain of command. Such positions ha�e been assigned to perform policy development,
long range planning, and other administrative activities under the confidential direerion ofthe Police
or Fire Cluef. In the Fire Department, the unclassified positions are the Administrative Assistant to
the Fire Chie� the three Assistant Fire Chiefs, and the three Deputy Fire Chiefs. The Emergency
Paramedical Services Chief is at the same level as the three deputies ifl the command structure.
Recommendation
- It is recommended that the position be placed in the unclassified service and be appointed by the
Fire Chief.

CITY CHARTER
625. Terms shall be six (6) yeazs, eacept that one
of the three (3) members first appointed shall serve
for a term of two (2) years and one for a term of
four (4) yeazs. All appointments shall be from
among the qual�ed voters of the city who aze in
known sympathy with the application of inerit
prineiples to public employment. No member may
hold any office or employment under the city. A
member shall cease to be a member of the com-
mission upon becoming a candidate for elective
city office. The council may, by administrative
ordinance, provide compensation and reimbursement
of e%penses for the commissioners and establish a
procedure for the appointment of altemates. Any
member may be removed by the council for cause
after a hearing. Proceedings for removal may be
initiated by the mayor, the council or the board of
education.

Sec. 12.03. Classified and unclassified.
Sec. 12.03.1. Civil service divisions.
The civil service of the City of Saint Paul shall
consist o£the classified and unclassi£ed service.
Sec. 12.032. Unclassified service.
The unclassified service shall comprise:
(A) Elected o�cials.
B) Heads of executive departments.
(C) A secretary to the mayor.
(D) The city attomey and deputy and assistant
city attomeys, subject to Section 5.03.
(E) The fire chief, and police chief, and per-
sonnel director.
(F) The city clerk.
(G) Members of boards and commissions.
(I� Such additional positions as shall be assigned
by ordinance to the unclass�ed service,
with Lhe consent of the civil service com-
mi�sion.

The classified service shall include ali other
positions in the city service, including offices her�
inafter created and not egciuded therefrom. All
class�ed employees shall enjoy the benefits and
protection and be subject to the civil service rules
and no permanent employee in the classified ser-
vice shall be discharged eacept for cause and upon
such hearing as the civil service rules or other
law prescribe.
Sec. 12.04. Duties of the civil service commis-
sion.
Sec. 12.04.1. Hearing of grievances.
The civil service rules shall include provisions
establishing a formal procedure for the review of
employee grievances not covered under labor agree-
ments. After exhausting the formal grievance proce-
dure, the complaining employee may petition the
civil service commission for a hearing and the
commission shall, within a reasonable time, con-
duct a hearing at which all parties to the griev-
ance or their representiatives may be heard. The
commission shal] have the power to issue sub-
poenas and to administer oaths and to compel the
attendance and testimony of witnesses and the
production of books and papers relevant to the
grievance. The commission may make complaint
to the district court of disobedience of its sub-
pcena or orders under this section. Following the
hearing, the commission shall promptly rule on
the grievance petition. Its decision shall have such
binding effect as the civil service rules prescribe.

Sec. 12.04.2. Studies.

tions not inconsistent with the Charter as the
council may prescribe by adm;n;.cfrative ordinance.
Sec. 12.04.4. Investigations.
Any person who believes that there has been a
violation of Sections 12.01, 12.11, 12.11.1, 12.112,
12.11.3, or 12.11.4 of the Charter which directly
aggrieves such person may apply to the commis-
sion to investigate the matter. The commission
shall conduct such investigation when in its judg-
ment, the matter is oF substantial merit with
respect to the applicant or other persons similarly
situated. The wmmission may require any offi-
cial or employee to provide data or testimony to
assist in such investigation and shall file a report
of its findings and recommendations with the mayor
and the city council and the board of education oF
independent school distriot aumber 625.
Sec. 12.05. Director of personnel—Duties.
The director of personnel shall manage the per-
sonnei system of the city in a manner consistent
with the provisions of Section 12.01 of the Chaz-
ter. The director shall be subject to the control
and supervision of the mayor.
Sec. 12.06. Civ1 service rules and amendments.
At the direction of the mayor, or on his or her
own initiative, the director of personnel shall pre-
pare personnel rules for review and adoption by
the council. The rules shall deal vrith all matters
necessary to the administration of the city per-
sonnel system on a merit basis. The eouncil may
by resolution adopt any or all of such rales with
or without amendment or they may initiate their
own proposed rules. Such rules or amendments
which are approved by the council shall be sub-
mitted within five (5? days of their passage to the
civil service commission for their approval or re-
jection. Within ten (10) business days the civil
service commission shall either approve and sign
the measure or shall return it to the council with
a communication in writ.ing stating their disap-
proval and the reason therefor. If the commission
neither signs nor vetoes the measure within ten

(10) business days, it shall be deemed approved.
Any such measure which is vetoed by the civil
service commission may be reconsidered by the
council and shall become law if passed by an af-
firmative vote of at least five (5) members of the
council within thirty (30) days of the veto. Any
such measure which has been reconsidered by the
council and repassed shall be deemed approved.

Sec. 12.07. Status of employees and officers.
5ec. 12.07.1. Retention of positions.
Every person holding a probationary or regular
appointment to a position in the classified service
at the time this Charter takes effect shall retain
his or her position until discharged, promoted or
transferred in accordance with the provisions of
this Charter and the personnel rules. Probation-
ary employees shall acquire such protection at
the completion of their probationary period in the
same manner as if this Charter had not been
adopted.
Sec. 12.072. Employees' rights and salaries.
Allowances for vacation, sick �eaves, pension
and retirement, and other rights of employees
accrued when this Charter takes effect, shall not
be afFeeted by the adoption of this Charter. No
salary of any current employee shall be reduced
as a result of the adoption of a Charter amendment.
Sec. 12.07.3. Protection of employees in newly
unciassified positions.
When a position in the unclass�ed service is
created under terms of this Charter, any person
who has served satisfactorily in the affected posi-
tion for at least five (5) continuous years prior to
the position change shall be entitled to retain, for
two (2) years or until transferred into a classified
job, whichever is the shorter period, ali rights
and privileges to which that person would have
been entitled in a class�ed job.

In August of 2000, the Office of Human Resources received a request from the Fire Chief to place
the Emergency Paramedical Services Chief position in the unclassified service. The Chief
indicated that this change was critical to the operations of the department's responsive services.
As a division manager, this position reports directly to the Fire Chief requiring greater
confidentiality due to the influence on policy decisions. The Chief also indicated that in 1996 the
Emergency Paramedical Services Chiefwas upgraded to the levei ofDeputy Fire Chief. Positions
in the Deputy Fire Chief class aze in the unclassified service. The Cluef Further indicated that
the incumbent was retiring and now was the best time for implementing the change. Section
12.03.1 o€the City Charter establishes the Ciuil Service.divisions o£Yhe City of Saint Paul.. _
Section 12.032 states that the unclassified service shall consist of Elecfed Officials, Department
Heads, Secretary to the Mayor, the City Attomey, Deputy City Attomeys, and Assistant City
Attorneys, the Fue Clue� the Police Chie� the Human Resources Director, the City Clerk,
members of boards and cominissions, and such additional positions as shall be assigned by

Job Description

services (EMS) operation of the Departme� o£Fire and Safety Servtces. The respons�ilities
include developing and implementing policies and procedures, planning, certification, tra nin
evaluating the EMS operation, a;n the budget, assuring compliance with medical
guidelines and feder�l, state and local regulations and standards, and coordinating the activities of
the EMS operations and fire suppressioa Generai supervision is provided by the Fire Clne£
Supervision esercised by the position is general and technical, either directly or through
subordinate supervisors, over emergency paramedical services assigned personnel. Specific duties
that may be performed aze descn'bed in the attached class specification
Comparison to Other Positions
The duties that have been assigned to the position in question aze consistent with those of other
s�tnilaz positions in the unclassified service. Tliere are no specific criteria for determining whether
positions should or shouidn't be placed in the unclassified service in accordance with the provisions
of the City Charter. Positions that have been placed in the unclassified service have either reported
directly to the Mayor or the City Cauncil, had responsibility for carrying out the initiatives of the
Mayor's Administration or the Ciry Council, or reported directly to a department head as either a
confidential assistant or division manager. In pazamilitary organizarions like the Fire and Police
Departments the unclassified positions have been administrative assistants and managers at a high
level in the chain of command. Such positions ha�e been assigned to perform policy development,
long range planning, and other administrative activities under the confidential direerion ofthe Police
or Fire Cluef. In the Fire Department, the unclassified positions are the Administrative Assistant to
the Fire Chie� the three Assistant Fire Chiefs, and the three Deputy Fire Chiefs. The Emergency
Paramedical Services Chief is at the same level as the three deputies ifl the command structure.
Recommendation
- It is recommended that the position be placed in the unclassified service and be appointed by the
Fire Chief.

CITY CHARTER
625. Terms shall be six (6) yeazs, eacept that one
of the three (3) members first appointed shall serve
for a term of two (2) years and one for a term of
four (4) yeazs. All appointments shall be from
among the qual�ed voters of the city who aze in
known sympathy with the application of inerit
prineiples to public employment. No member may
hold any office or employment under the city. A
member shall cease to be a member of the com-
mission upon becoming a candidate for elective
city office. The council may, by administrative
ordinance, provide compensation and reimbursement
of e%penses for the commissioners and establish a
procedure for the appointment of altemates. Any
member may be removed by the council for cause
after a hearing. Proceedings for removal may be
initiated by the mayor, the council or the board of
education.

Sec. 12.03. Classified and unclassified.
Sec. 12.03.1. Civil service divisions.
The civil service of the City of Saint Paul shall
consist o£the classified and unclassi£ed service.
Sec. 12.032. Unclassified service.
The unclassified service shall comprise:
(A) Elected o�cials.
B) Heads of executive departments.
(C) A secretary to the mayor.
(D) The city attomey and deputy and assistant
city attomeys, subject to Section 5.03.
(E) The fire chief, and police chief, and per-
sonnel director.
(F) The city clerk.
(G) Members of boards and commissions.
(I� Such additional positions as shall be assigned
by ordinance to the unclass�ed service,
with Lhe consent of the civil service com-
mi�sion.

The classified service shall include ali other

class�ed employees shall enjoy the benefits and
protection and be subject to the civil service rules
and no permanent employee in the classified ser-
vice shall be discharged eacept for cause and upon
such hearing as the civil service rules or other
law prescribe.
Sec. 12.04. Duties of the civil service commis-
sion.
Sec. 12.04.1. Hearing of grievances.
The civil service rules shall include provisions
establishing a formal procedure for the review of
employee grievances not covered under labor agree-
ments. After exhausting the formal grievance proce-
dure, the complaining employee may petition the
civil service commission for a hearing and the
commission shall, within a reasonable time, con-
duct a hearing at which all parties to the griev-
ance or their representiatives may be heard. The
commission shal] have the power to issue sub-
poenas and to administer oaths and to compel the
attendance and testimony of witnesses and the
production of books and papers relevant to the
grievance. The commission may make complaint
to the district court of disobedience of its sub-
pcena or orders under this section. Following the
hearing, the commission shall promptly rule on
the grievance petition. Its decision shall have such
binding effect as the civil service rules prescribe.

Sec. 12.04.2. Studies.

council may prescribe by adm;n;.cfrative ordinance.
Sec. 12.04.4. Investigations.
Any person who believes that there has been a
violation of Sections 12.01, 12.11, 12.11.1, 12.112,
12.11.3, or 12.11.4 of the Charter which directly
aggrieves such person may apply to the commis-
sion to investigate the matter. The commission
shall conduct such investigation when in its judg-
ment, the matter is oF substantial merit with
respect to the applicant or other persons similarly
situated. The wmmission may require any offi-
cial or employee to provide data or testimony to
assist in such investigation and shall file a report
of its findings and recommendations with the mayor
and the city council and the board of education oF
independent school distriot aumber 625.
Sec. 12.05. Director of personnel—Duties.
The director of personnel shall manage the per-
sonnei system of the city in a manner consistent
with the provisions of Section 12.01 of the Chaz-
ter. The director shall be subject to the control
and supervision of the mayor.
Sec. 12.06. Civ1 service rules and amendments.
At the direction of the mayor, or on his or her
own initiative, the director of personnel shall pre-
pare personnel rules for review and adoption by
the council. The rules shall deal vrith all matters
necessary to the administration of the city per-
sonnel system on a merit basis. The eouncil may
by resolution adopt any or all of such rales with
or without amendment or they may initiate their
own proposed rules. Such rules or amendments
which are approved by the council shall be sub-
mitted within five (5? days of their passage to the
civil service commission for their approval or re-
jection. Within ten (10) business days the civil
service commission shall either approve and sign
the measure or shall return it to the council with
a communication in writ.ing stating their disap-
proval and the reason therefor. If the commission
neither signs nor vetoes the measure within ten

(10) business days, it shall be deemed approved.
Any such measure which is vetoed by the civil
service commission may be reconsidered by the
council and shall become law if passed by an af-
firmative vote of at least five (5) members of the
council within thirty (30) days of the veto. Any
such measure which has been reconsidered by the
council and repassed shall be deemed approved.

Sec. 12.07. Status of employees and officers.
5ec. 12.07.1. Retention of positions.
Every person holding a probationary or regular
appointment to a position in the classified service
at the time this Charter takes effect shall retain
his or her position until discharged, promoted or
transferred in accordance with the provisions of
this Charter and the personnel rules. Probation-
ary employees shall acquire such protection at
the completion of their probationary period in the
same manner as if this Charter had not been
adopted.
Sec. 12.072. Employees' rights and salaries.
Allowances for vacation, sick �eaves, pension
and retirement, and other rights of employees
accrued when this Charter takes effect, shall not
be afFeeted by the adoption of this Charter. No
salary of any current employee shall be reduced
as a result of the adoption of a Charter amendment.
Sec. 12.07.3. Protection of employees in newly
unciassified positions.
When a position in the unclass�ed service is
created under terms of this Charter, any person
who has served satisfactorily in the affected posi-
tion for at least five (5) continuous years prior to
the position change shall be entitled to retain, for
two (2) years or until transferred into a classified
job, whichever is the shorter period, ali rights
and privileges to which that person would have
been entitled in a class�ed job.

In August of 2000, the Office of Human Resources received a request from the Fire Chief to place
the Emergency Paramedical Services Chief position in the unclassified service. The Chief
indicated that this change was critical to the operations of the department's responsive services.
As a division manager, this position reports directly to the Fire Chief requiring greater
confidentiality due to the influence on policy decisions. The Chief also indicated that in 1996 the
Emergency Paramedical Services Chiefwas upgraded to the levei ofDeputy Fire Chief. Positions
in the Deputy Fire Chief class aze in the unclassified service. The Cluef Further indicated that
the incumbent was retiring and now was the best time for implementing the change. Section
12.03.1 o€the City Charter establishes the Ciuil Service.divisions o£Yhe City of Saint Paul.. _
Section 12.032 states that the unclassified service shall consist of Elecfed Officials, Department
Heads, Secretary to the Mayor, the City Attomey, Deputy City Attomeys, and Assistant City
Attorneys, the Fue Clue� the Police Chie� the Human Resources Director, the City Clerk,
members of boards and cominissions, and such additional positions as shall be assigned by

Comparison to Other Positions
The duties that have been assigned to the position in question aze consistent with those of other
s�tnilaz positions in the unclassified service. Tliere are no specific criteria for determining whether
positions should or shouidn't be placed in the unclassified service in accordance with the provisions
of the City Charter. Positions that have been placed in the unclassified service have either reported
directly to the Mayor or the City Cauncil, had responsibility for carrying out the initiatives of the
Mayor's Administration or the Ciry Council, or reported directly to a department head as either a
confidential assistant or division manager. In pazamilitary organizarions like the Fire and Police
Departments the unclassified positions have been administrative assistants and managers at a high
level in the chain of command. Such positions ha�e been assigned to perform policy development,
long range planning, and other administrative activities under the confidential direerion ofthe Police
or Fire Cluef. In the Fire Department, the unclassified positions are the Administrative Assistant to
the Fire Chie� the three Assistant Fire Chiefs, and the three Deputy Fire Chiefs. The Emergency
Paramedical Services Chief is at the same level as the three deputies ifl the command structure.
Recommendation
- It is recommended that the position be placed in the unclassified service and be appointed by the
Fire Chief.
