Exterior structure. 13 as follows: 14 The owner of any premises shall comply with the foliow' g requirements: 15 16 (]) Foundations, walls, roof and other exterior s aces. Every foundation, exterior wall, roof and all other 17 exterior surfaces shall be maintained in a pr fessional state of maintenance and repair. 18 19 a. The foundation elements shall a quately support the building at all points. 20 21 b. Every exterior wall shall be ee of holes, breaks, loose or rotting boards or timbers and any other 22 conditions which might a it dampness to the interior portions of the wall or to the interior spaces 23 of structures. 24 25 c. All exterior surfaces, ther than decay-resistant woods, shall be protected from the elements and 26 decay by paint whic is not lead-based paint or by other protective covering or treatment. 27 28 d. Exterior surface of residential structures or accessory thereto shall not have exposed accumulative 29 paint or other face-covering material containing lead equal to or g�eater than one-half of one 30 percent (0.5° ) by weight or in excess of one (1) milligram per square centimeter of surface area if 31 such paint r surface-covering material is blistered, cracked, flaked, scaled or chalked away. 32 33 e. The supporting shuctural members sha be maintained structurally sound, showing no 22 evidence of deterioration and capable of bearing unposed 1 ads in accordance with the provisions of the 23 building code or in accardance with the building code un er which it was originally constructed. 24 25 (2) Stairs: 26 27 a. Every inside stair shall be constructed safe and shall be capable of supporting a load as determined 28 in the building code, ar in accordance wi the Uniform Building Code under which it was originally 29 constructed, and shall be kept in sound ondition and good repair. 30 31 Every stairway, porch, deck or step hich is more than thirty (30) inches above grade or floor level 32 shall have guazdrails or intermedi e rails less than tmte-(-�) ���� inches apart and in accordance 33 with the building code or in acc dance with the Uniform Building Code under which it was 34 originally constructed. 35 36 b. Every toilet oom and bathroom floor surface shall be constructed and maintained 40 substantially impervious to ater to pernut such floor to be easily kept in a clean and sanitary condition. 41 42 (4) Sanitation. The interiar all be maintained free of accumulation of refuse or garbage which constitutes an 43 unsanitary, unsafe, nu' ance or hazardous condifion. 44 45 (5) Insect and rodent arborage. Every owner of a structure shall be responsible for the extermination of 46 insects, rodent�, vermin or other pests wherever infestation exists. 47 � 48 (6) Interior walls, etc. Interior walls, floars and ceilings must be maintained in a sound condition and in a � 99-���! 1 gazage shall be substantially secure from illegal entry and shall be provided with a one-inch throw 2 deadbolt lock as defined in secfion 34.07. Existing five-eighths-inch deadbolts will be allowed on 3 solid core wood doors, metal doors and three-fourths-inch panel doors with a six-inch extended 4 strikeplate for wood-frame doors. Doors replaced shall be replaced with solid core, solid wood, 5 three-fourths-inch panel or metal door and frame. Hinges must be placed on the inside of the solid 6 door. Occupancy. 23 24 The owner of any premises shall comply with the follow� g requirements: 25 26 (1) 27 28 29 30 (2) 31 32 33 34 (3) 35 36 37 38 39 Minimum ceiling height. In calculating the fl r area of habitable rooms, only those portions of the floor area of a room having a clear ceiling heigh n excess of five (5) feet may be included. At least half of the floor area of any habitable room shall hav a clear ceiling height of seven (7) feet or more. Required space in dwelling untts. Ev dwelling unit shall contain a minimum gross floor area of at least one hundred fifty (150) square feet r the first occupant, at least one hundred (100) square feet for each occupant thereafter, the floor area o be calculated on the basis of the total habitable room area. Required space in sleeping ro s. In every dwelling unit, every room occupied for sleeping purposes by one (1) occupant shall have minimum gross floor area of at least seventy (70) square feet. In every dwelling unit, every room ccupied for sleeping purposes by two (2) or mare occupants shall have a minimum gross floor ar of fifty (50) square feet per occupant thereof. Rooming units shall comply with section 34.1?(2) of thi Code. 40 (4) Escape window. A east one (1) window in every room used for sleeping purposes must be openable from 41 the inside, with inimum overall net glazed area of five and seven-tenths (5.?) square feet; the minimum 42 net clear ope ' g height dimension shall be twenty-four (24) inches, the minixnuxn net clear opening width 43 dimension s all be twenty (20) inches, and it shall have a minimum finished sill height of not more than 44 �i;�%�� :�� inches above the floor. Should the window, or any part of it, be below grade, 45 an exca arion shall be made, on the exterior side of the window, that extends at least to the depth of the 46 wind sill. The excauarion shall continue for at least three (3) feet perpendicular to the window and at least 47 on (1) foot cleaz width behind the pivot or hinge side of the window. Date: 3/22/99 11:42am Subject: Withdrawal of Council File 99-228 I respectfully request the withdrawal of Councii File number 99-228 regarding changes to chapter 34 of the Legislative Code. This item (Number 28) appeared as the second reading on March 17th. It is not scheduled for public hearing this week, but we assume that it will be scheduled April 7th, as there is no Council meeting on the 31st of March because it is the 5th Wednesday of the month (correct?). This ordinance change was proposed by LIEP and was intended to clarify certain requirements of the Building Code. In discussing the proposed changes with other departments we found that there is a difference in interpretation between staff on the applicability of the requirements. Therefore we would like to withdraw the change at this time and discuss the matter further to see what, if any, changes are appropriate to propose at a later date. Thanks for your understanding and assistance on this matter, please let me know if you have any questions, and whether I should appear at Council on the 7th to explain this at the public hearing.
