The Council of the City of Saint Paul finds and determines that it is in the public interest to allow authorized emergency vehicies, which are not owned or operated by the City, and as defined in Minn. Stat. § 169.01, subd. 5, to use the City's Traffic Signal Preemption System when such non-City vehicles are responding to an emergency. (� � Emergency Vehicle. The term "Emergency Vehicle" shall mean and include those vehicles as defined under Minnesota Statutes § 169.01, subd. 5. (t� � Person. The term "person" shall mean and include any person, firm, corporation, or other entity or association, together with the officers, agents and employees of such firms, corporations or entities. The term "Traffic Signal Preemption System" shall mean a system designed for use by Emergency Vehicles to improve traffic movement by temporarily controlling signalized intersections. The Preemption system is comprised of the following components: an emitter, a detector and a phase selector. The emitter (a tugh intensity light source) is attached to the Emergency Vehicle and functions like a strobe light, pulsating at a frequency in excess of 10 "beats" per second. Prohibitions. (a) It shall be unlawful for a person to use or interfere with the Traffic Signal Preemption System, unless: (i) either such person has entered into a contract with the City which allows such use, or the person is an employee of the City of St. Paul who is using the System pursuant to such employment; and (ii) an emergency e�usts and there is a threat of immediate danger to life or property which reasonably requires the use of the System in order to protect the life, safety, health, or property of one or more persons. - '- - . _ (�j �b It shall be unlawful for a person, having entered into a contract with the City authorizing the use of the Systems, to use or interfere with the Systems in violation of the terms and conditions of that co�tract or in violation of any of the rules and regulations promulgated by the Director of Public Works for the use of such Systems. �l l��M (�} �c This section shall not apply to persons who are perfornung inspection, maintenance or repair work on the System with the express prior authorizarion by the Director. Sec. 152.04.4. Authority to Promulgate Rules and Regulations. The Director is hereby authorized to promulgate and, from time to time amend, rules and regulations for the use of the Systems. In doing so, the Director shall seek the advice and recommendations of the Department of Fire and Safety Services and the Department of Police. Such rules and regulations shall when promulgated be filed in the Office of the City Clerk, and there kept available for public inspection, and additionally shall be available in the Department of Public Works. Copies shall also be sem to the Department of F'ue and Safety Services and the Department of Police. Such rules and regulations shall have the force and effect of law, and shall be promulgated in accordance with the following standards and guidelines: (a) Such rules and regulations shall not be inconsistem with any of the terms or conditions of this ordinance. �.�yt('� 1 (b) Such rules and regulations shall promote the public health, safety and welfare. �l �"�� ` 2 3 (c) All vehicles using the Systems shall haue proper equipment to safely use such Systems. 4 5 (d) All drivers of vehicles using the Systems shall be properiy licensed and trained in the 6 safe use of such Systems, and shall at all times follow applicable driving rules, including 7 those goveming Bmergency Vehicle�es. 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 (e) Such rules and regulations shall take into account, in allowing the use of the Systems, the safety of the driver and passengers of the emergency vehicle, the drivers and passengers of other vetricles and pedestrians, and the protection of personal and real property, both public and private. ( fl The rules and regulations may provide that use of the Systems by non-City users is subordinate to the City's use, and in the event of any conflict, that the City's use shall take precedence. This includes the City's use of the systems for inspection, maintenance or repair purposes. � - - '- - - - �tr} � The rules and regulations may require that non-City users of the system pay a fee to allow the City to recover its costs and expenses. (�j � The rules and regulations sha11 contain the model form of agreement authorized by Section 154.04.5. {}� ji� The rules and regulations may provide for the inspection, maintenance and repair of the Systems. Sec. 152.04.5. Authority to Enter into Contracts. Such provisions shall include, but are not limited to, a requirement that the City and its officers, agents and employees be indemnified and that such obligation of indemnification shall be insured (unless the contracting party is another governmental body which is under state law self-insured); and that such contract sha11 be ternrinated in the event of a breach of its terms and conditions, or in the event of a violation of the rules and regulations promulgated hereunder by the Director. The Council additionally finds that the control and regulation of such use is best served by having the Director ofPublic Works promulgate rules and regulations for the access and use of such System under standazds and guidelines set forth in this ordinance. As the motor vehicle approaches an intersection 7 controlled by this system, this emitter's pulsating light is received by a detector that is 8 located at or near the traffic signai. The detector then relays the coded message to the 9 phase selector, located in the uaffic light control box, wiuch then either holds the e�sting 10 green light in favor of the approaching motor vehicle for a set period of time or 11 accelerates the normal cycle of a signal change to provide an eazlier green light for the 12 vehicle. Traffic Signal Priority does not take control of an intersection and will not 13 remove a signal from normal coordinated operation. (d) This section sha11 not apply to persons who aze perfomung inspection, maintenance or repair work on the System with the e�ress prior authorization by the Director. Sec. 152.04.4. Declaration of Policy. (a) Traffic Sienal Preem.ption System. The Council 14 of the City of Saint Paul finds and determines that it is in the public interest to allow 15 authorized emergency vehicles, which are not owned or operated by the City, and as 16 defined in Minn. Stat, § 169.01, subd. 5, to use the City's Traffic Signal Preemption 17 System when such non-City vetricles are responding to an emergency. In order to control 18 and regulate the use of such System for that purpose, the Council finds that public safety 19 and welfare would best be served by having the Director of Public Warks promulgate 20 rules and regulations for the access and use of such System under standards and guidelines 21 set forth in this ordinance. 22 23 24 25 26 27 28 29 30 (b) Traffic Signal Priority S s� tem. The Council of the City of 5aint Paui further finds and detemvnes that it is also in the public interest to allow the operators of public transit service buses to use the City's Traffic Signal Priority System under circumstances and conditions that would serve public safety and welfare by facilitating the provision of mass transit services in a safer, more efficiern and more tunely mannet. The Council additionally finds that the control and regulation of such use is best served by having the Director ofPublic Works promulgate rules and regulations for the access and use of such System under standazds and guidelines set forth in this ordinance. ORDINANCE CITY OF SAINT PAUL, MINNESOTA Sec. 152.04.2. Defznitions. aq - 13G 3 (a) Public Transit Service Bus. The term "public transit service bus" shall mean and 4 include a motor vehicle designed for caz more than 15 passengers and used for the 5 public transportation of persons, that is engaged in regular route transit as defined in 6 Minn. Stat. § 17422, subd. 8, and that is in service and actually transporting passengers. (b) Director. The term "D'uector" shall mean the Director of the Department of Public Works, and lus or her designee or designees. 10 11 (c) Emergency, The term "emergenc�' shall mean and include an unforeseen event, 12 condition, or combination of circumstances which requires immediate action or remedy to 13 protect an individual's or community's health, safety, welfare, peace or property. 14 15 (d) Emereency Vehicle. The term "Emergency Vehicle" shall mean and include those 16 vehicles as defined under Minnesota Statutes § 169.01, subd. 5. 17 18 (e) Person. The term "person" shall mean and include any person, firm, corporation, or 19 other entity or association, together with the officers, agents and employees of such firms, 20 corporations or entities. The term shall include both the individual operator of a vehicle as 21 well as, where applicabie, the entity which employs or contracts for the operator's 22 services, or which contracts with the City for the use of the Systems. 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 ( fl Svstem or S, stY ems. The terms "System" or "Systems" shall refer collectively to either or both the Traffic Signal Preemption System and the Traffic Signai Priority System. (g) Traffic Signal Preemption System. The term "Traffic Signal Preemption System" shall mean a system designed for use by Emergency Vehicles to improve traffic movement by temporarily controlling signalized intersections. The Preemption system is comprised of the following components; an emitter, a detector and a phase selector. The emitter (a high intensity light source) is attached to the Emergency Vehicle and functions like a strobe light, pulsating at a frequency in excess of 1Q "beats" per second. As an Emergency Vehicle approaches an intersection controlled by this system, the emitter's pulsating light is received by a detector that is located at or near the traffic signaL The detector then relays the coded message to the phase selector, located in the traffic light control box, which then either holds an eacisting green light in favor of the approaching Emergency Vehicle or accelerates the normal cycle of a signal change to provide a green light for the Emergency Vehicle before the vehicle enters the intersection. 1 (h) Traffic Si�al Priority S, s� tem. The term "Traffic Signal Priority System" shall mean a Q� ri 3 ` 2 system designed for use by vehicles such as public transit service buses to improve traffic 3 movement by temporarily modifying the signal timing of signalized intersections. The 4 priority system is comprised of the following components: an emitter, a detector and a 5 phase selector. The emitter (a high intensity light source) is attached to the motor velucle 6 and functions like a strobe light. As the motor vehicle approaches an intersection 7 controlled by this system, this emitter's pulsating light is received by a detector that is 8 located at or near the traffic signai. The detector then relays the coded message to the 9 phase selector, located in the uaffic light control box, wiuch then either holds the e�sting 10 green light in favor of the approaching motor vehicle for a set period of time or 11 accelerates the normal cycle of a signal change to provide an eazlier green light for the 12 vehicle. Traffic Signal Priority does not take control of an intersection and will not 13 remove a signal from normal coordinated operation. Prohibitions (a) It sha11 be uniawful for a person to use or interFere with the Traffic Signal Preemption System, unless: (i) either such person has entered into a contract with the City which allows such use, or the person is an employee of the City of St. Paul who is using the System pursuant to such employment; and (ii) an emergency exists and there is a threat of immediate danger to life or property which reasonably requires the use of the System in order to protect the life, safety, health, ar property of one or more persons. (b) It shall be unlawful for a person to use or interfere with the Traffic Signal Priority System, unless such person is either: (i) actually transporting passengers while operating a public transit service bus, and has entered into a contract with the City which allows such use; or (ii) an employee of the City of St. Paui who is using the System pursuant to such employment. (c) It shall be unlawful for a person, having entered into a contract with the City authorizing the use of the Systems, to use or interfere with the Systems in violation of the terms and conditions of that contract or in violation of any of the rules and regulations promulgated by the Director of Public Works for the use of such Systems. (d) This section sha11 not apply to persons who aze perfomung inspection, maintenance or repair work on the System with the e�ress prior authorization by the Director. Sec. 152.04.4. Authority to Promulgate Rules und Regulations. The Director is hereby authorized to promulgate and, from time to time amend, rules and regulations for the use of the Systems. In doing so, the Director shall seek the advice and recommendations of the Department of Fire and Safety Services and the Department of Police. Such rules and regulations shall when promulgated be filed in the Office of the City Clerk, and there kept available for public inspection, and additionally sha11 be available in the Department of Public Works. Copies shall also be sent to the Department ofFire and Safety Services and the Department of Police. Such rules and regulations shall have the force and effect of law, and shall be promulgated in accordance with the following standards and guidelines: (a) Such rules and regulations shall not be inconsistent with any of the terms or conditions of this ordinance. (g) Use of the Traffic Signal Priority System by buses shall be limited to use by authorized public transit service buses which are in service along the system of inetropolitan regular route transit and which are transporting passengers. (h) The rules and regulations may require that non-City users of the system pay a fee to allow the City to recover its costs and expenses. (i) The rules and regulations shall contain the model form of agreement authorized by Section 154.04.5. (j) The rules and regulations may provide for the inspection, maintenance and repair of the Systems. Sec. 152.04.5. Authorzty to Enter into Contracts.
