The Saint Paul P12uning Commission s initiated a study for the possible adoption of amendments to the City of Saint Paul's Co rehensive Plan and Zoning Code regulating the densiry, type and character of industrial, c ercial and residential development within the azea beginning at a point where Shepard Roa Mississippi River Boulevazd and West Seventh Street intersect, northeasterly along West Sev th Street to Edgecuxnbe Avenue, north on Edgecumbe Avenue to St. Paul Avenue, east alon St. Paul Avenue to West Seventh Street northeasterly atong West Seventh Street to ] southwesterly along Shepazd I Shepard Road - Davern Street Street, southeasterly along Homer Street to Shepard Road, > the point of beg3nning and commonly known as the Pending the completion of studies and recommendations by the Saint Paul Planning Comm' sion and the adoption of any amendments to the Ciry of Saint Paul's Comprehensive Plan d Zoning Code by the Council of the City of Saint Paul and for the purpose of protecting the C' 's planning process, a moratorium of limited duration is hereby enacted for the purpose of rohibiting development that is inconsistent with City and community development objectives r this pivotal area of the City. Stat. § 462.355, Sub (4), the following shali be prohibited for a period of time not to exceed twelve (12) months om the effective date of this ordinauce: the issuance of building pernuts, plat approvals d lot splits for I-1 zoning districts as weli as rewning to B-5 and B-4 zoning dishicts. owever, this moratorium does not apply to building pernuts for work on �isting struc es which will not increase the area of the structure and pernuts to work on state Highway No. est 7�' Street to I-35E "Gateway Project" as approved in Council File No. 97-322 and funded under 1997 Minn. Laws, Chapter 200, Art. l; q� -� a�� Section 3. The restrictions enacted herein may be eactended by the Council of the City of S' for additional periods not to exceed an additional eighteen (18) months in the event th st and recommendations of the Plam�ing Commission and the deliberations of the S' au Council require such e�tensions. That the only activities performed at the site will be car maintenance, limited caz rentals (i.e. customers will not come directly to the site, but will only arrive in I3ertz shuttles from the airport, also that this is a temporary use until space is availabie at the airport); limited caz sales (with the understanding that this is an auxiliary site with Hertz presently looking for an additional location for caz sales). 2. That The Hertz Corporation agrees to work with HACC and by November 14, 1497 have an agreement in place regazding rezoning ihe property to B-3. 3. The only signage on the properry will be 1) on the buiiding itseif "Hertz", in lettering no more than 3 feet high; and 2j a monument sign no lazger than 2%z feet x 5 feet and no higher than 5 feet to be located along Davem: 4. Additional landscaping (trees, shrubbery, vines & sod) will be installed so as to provide 100% screening of the lot from view along West SevenYh, Davern and Stewart. The final landscaping plan is subject to approval by the HACC. Further, The Hertz Corporation agrees to maintain all landscaping and facilities including but not limited to mowing, weeding, pruning, trash pick-up, etc. on a daily basis. 5. Any additional lighting will be of the lantern style, to be approved by HACC. 6. The hours of operation for car rentai will be: ? am untii i fl PM; hours of operarion for car sales to be 8 am to 8 PM; the maintanance facility operates 24 hours per day (or those hours as provided by zoning or other ordinance} however the main hours of operation will be between 7 am and IQ PM. Deliveries to be between 8 am and 5 pm; 7. All activities of this facility, including deliveries will only be done on the properry itself and not on the public streets or right of way; further, that no dey�ery vehicles will be allowed to idle for more than five minutes at a time outside of the hours af 8 am and 5 PM. 8 The Hertz Corgoration employees will use West Seventh, Shepard or Davem to reach the property and their vehicles will be parked on the site. 9. If gasoline storage is anything other than in above ground tanks Hertz will comply with all federal, state or local requirements to assure there wiil be no detrimental environmental impact due to fuel storage. They further agree to provide HACC with documentation stafing that they have complied wiTh any such requirements. The canopy shall be painted forest green or a neutral color so as to biend in with the screening of the lot. 0. The building will be a one story building constructed of red brick or masonry with a design in keeging with he Fort Road Plan. }. If a structure is visibie from Shepard, Davern or West Seventh, iYs roof wili be of a neutral color or forest �een, so as to blend in with the screening. .
