An ordinance amending Sections 60.201, 60.218, 60.412, 60.542, 60.544, 60.612, 61.104, 62.103,
and 63107 of the Saint Paul Legislative Code pertainnig to zoning.
The Council of the City of Saint Paul does ordain:
Section 1
That the following defmition in Section 60201.A. of the Saint Paul Legislafive Code be and is
hereby amended to read as follows:
Sec. 60.201. A.
Accessory use ar accessory. A use which is clearly incidental to, customarily found in connestion
with, and (except as provided in section 62.104) located on the same zoning lot as, the principal use to
which it is related.
When "accessary" is used in the tea�t, it sha11 haue the same meaning as "accessory use."
An accessory use includes, but is not limited to, the following:
(1) Residential accommodafions for servants or cazetakers.
(2) Swimming pools for the use of the occupants of a residence or their guests.

Domestic storage in a barn, shed, tool room or similar accessory building or other structures
including the storage of antique and classic automobiles within accessory structures.

use, unless such storage is excluded in the applicable district regulations.
Storage of goods used in ar produced by industrial uses or related activities, unless such
storage is excluded in the applicable district regulations.
Accessory off-street parking spaces, open or enclosed, subject to the accessory off-street
parking regulations for the district in which the zoning lot is located.

That the following defuution in Section 60.218.R. of the Saint Paul Legislative Code be and is
hereby amended to read as follows:
Sec. 60.218. R.
Roominghouse:
(1) Any residential structure or dwelling unit, supervised or not, which provides living and
sleeping arrangements far more than four (4) unrelated indivlduals for periods of one week
or longer=;':i�i

Any residential structure or dwelling unit which provides single room occupancy (SRO)
housing as defined in CFR Section 882.102 to more than four (4) unrelated individuals.-j_�r
Any building housing more than four (4) unrelated individuals which has any of the

That Section 6Q.412(15) of the Saint Paul Legislative Code be and is hereby amended to read as
follows:
Sec. 60.412. Principal uses permitted.
(15) Bed and breakfast residences subject to the following conditions:

Only one guest room may be established in a one-family detached dwelling.
The zoning lot must meet the minimum lot size for single-family dwellings in the
district in which it is located.

That Section 60.542(1) of the Saint Paul Legislative Code be and is hereby amended to read as
follows:

(1) All principal uses permitted and uses pernutted subject to special conditions and as regulated
in OS-1, B-i, and B-2 Districts, except auto service stations, aut�:epriv�rii��s�� t�i�r���-azitzi

That Section 61104 NOTES TO INDUSTRIAL DISTRICTS of the Saint Paul Legislative Code be
and is hereby amended to read as follows:
SEC.61.104 NOTES TO 61104 INDUSTRIAL DISTRICTS:
(a) The height regulation shall not apply to those portions of any building ar structure which are
set back from any exterior property line of the pazcel, on which such building or structure is
constructed, a distance equal to the height which said structure exceeds the masimum height
of building allowed in said district.
(b) On those lots or pazcels, or portions of lots or pazcels, which are located directly across a
street or abut a side or rear lot line in any use district, other than an I-1, I-2, I-3, or P-1
District, the required setbacks from said abutting districts shall be equal to a minimum of
one and one-half (1 1/2) times the height of the buildings, except as noted in section 63103.
(c) VJhere the frontage of any block is divided into two (2) or more zoning districts, the front
yard requirements of the district with the lazgest front yazd depth shall be applied to the
entire block frontage.
(d) Nonrequired front yazds and all required and nonrequired side and rear yards shall be
permitted to be used for off-street pazking. Loading and unloading shall izz�i;be pernutted in
�iy �erxequired ffziu��:side:t�s � rear yazds.
(e) On those lots or pazcels, or portions of lots or parcels, which adjoin a right-of-way line of a
pazkway, the required setbacks from the parkway right-of-way line shall be equal to that

required for residential uses in effect along the pazkway right-of-�ay or twenty-five (25)
feet, whichever is greater.
Those pazkways and portions of parkways listed below are excluded from the setback
requirements established in subsection (e) above:
Ford Pazkway (northem side from Mount Curve Boulevazd to Mississippi River
Boulevazd).
Le�ngton Pazkway (from Pierce Butler Route to the nearest Burlington Northern
Railroad tracks).

That Section 62.103(d) of the Saint Paul Legislative Code be and is hereby amended to read as
follows:
Sec. 62.103. Parking requirements.
(d) Change in use within a structure. When any uses which exist within a structure change to a new
use, the following rules shall apply:
(1) Change in use requiring additional parking.

��hen any existing uses change to new uses which require six (6) or more additional off-
street pazking spaces than the existing uses, the six (6) or more additional spaces shall be
provided along with the spaces already provided by the existing uses. New uses which
require five (5) or fewer spaces than the existing uses shall be exempt from providing
additional spaces. However, this exemption provlsion shall be calculated cumulatively so that
no property receives a total exemprion of more than five (5) spaces since the adoption of the
provislon on January 3, 1994.
(2) Change in use requiring less parking. When any existing uses change to new uses which
require fewer off-street pazking spaces than the e�sting uses, the new uses requiring fewer
off-street parking spaces sha11 be considered as the existing uses when determining any
subsequent change in use requiring additional off-street parking spaces in (1) above.
(3) Vacant structures. When a structure, or part of a structure, is vacant, the zoning
administrator shall determine the previous existing use for purposes of calculating pazking
requirements using city records, land use surveys or directories.

That Section 63.107. of the Saint Paul Legislative Code be and is hereby amended to read as
follows:
Sec. 63.107. Projections into yards.
(a) Except as otherwise provided for in section 62.146(2), overhangs, decorative details and bay
windows may project into a required yard sixteen (16) inches plus two (2) inches for each foot of width
of the required side yard.
(b) Open, unenclosed, uncovered steps or platforms not exceeding two (2) feet in height may project
three (3) feet into a required yazd.
(c) Ramps for the handicapped are exempted and may project into required yards.
(d) Cliinuieys and fireplaces may project one foot into a required yard.
(e) Attached vestibules and greenhouses not exceeding twenty (20) square feet in area may project
into a required front or rear yazd.
