Letter from the Real Estate Division announcing a public hearing before the City Council on January 22, 2003, to consider the petition of the Salvation Army to vacate that part of Forbes Avenue lying northwesterly of West Seventh Street and Easterly of Smith Street to accommodate development of a parking area and green space. 5. Administrative Orders: D002223 Approving changes to Saint Paul Administrative Code Section 33.02 relating to rules and regulations governing the procedures for automobile reimbursement. D002224 Approving extension of time of Contract 418751 with Meisinger Construction Company for the Hill Street Plaza, Kellogg Street and Fifth Street sidewalks. Noted as on file in the City Clerk's Office FOR ACTION 6. Resolution - 03 -1 - Approving the appointment, by Mayor Kelly, of Maychoua Anne Lo to Our Fair Carousel Board. Adopted Yeas - 5 Nays - 0 7. Resolution - 03 -2- Memorializing City Council action taken September 4, 2002, granting the appeal of Jeff Wallis, Scenic Minnesota, et al. (9 co- applicants) and denying the appeal of Clear Channel Outdoor to a decision of the Planning Commission pertaining to five (5) new billboard locations along Kellogg Bridge, Rice Street, E. Seventh Street and Lafayette Road, and Como Avenue. Adopted Yeas - 5 Nays - 0 FOR DISCUSSION 8. Consideration of the application of Royal Crest Properties, Inc. to rezone property from R -4 (One - Family Residential) to RM -1 (Multiple - Family Residential) to construct two, four -unit townhouse structures (8 units total) at the southeast corner of Cottage Avenue and Farrington Street. (Public hearing held and laid over from December 18) Councilmember Reiter said the parties have met and the problems have been solved. Councilmember Reiter moved approval. No Ordinances (Blakey arrived) Suspension Items: Councilmember Lantry moved suspension of the rules for first reading of the following ordinance: First Reading - 03 -3 - An ordinance establishing the minimum qualifications for the vacancy for the position of Fire Chief pursuant to the provisions of Section 9.01 (a) of the Administrative Code and Section 12.12.1 of the Saint Paul City Charter. Introduced and laid over to January 8 for second reading Yeas - 6 Nays - 0 Councilmember Lantry moved suspension of the rules for first reading of the following ordinance. First Reading - 03 -4 - An ordinance establishing an Examining Committee for the position of Fire Chief pursuant to the provisions of Section 12.12.1 of the Saint Paul City Charter. Councilmember Lantry asked how the individuals were chosen for the examining committee. Council President Bostrom responded that the Administration said some of the people were on the last screening committee for the Fire Chief and they have tried to be broad -based in the people they have selected. Councilmember Blakey asked if there is a requirement that the fire chief must be a resident of St. Paul. Council President Bostrom said he thought that is an issue that becomes negotiable at the time someone is selected for the position and that they do not specify that they have to be a resident. Councilmember Lantry said it was her understanding there was a State Legislative change that directors are not required to live in St. Paul. Councilmember Blakey asked Manuel Cervantes, City Attorney, to provided information on the residency requirement. Blakey said he feels it's important that the fire chief is a resident of the city. Introduced and laid over to January 8 for second reading Yeas - 6 Nays - 0 Councilmember Blakey requested a report from the City Attorney's Office on the legal status of the State of Minnesota vs. Krinkie & Snelling Company case at the City Council Meeting on January 8, 2003. Councilmember Harris requested a report from the Office of License, Inspections and Environmental Protection regarding their inspection policies and controls at the City Council Meeting on January 8, 2003. Councilmember Lantry requested a review report from Council Research regarding the Office of License, Inspections and Environmental Protection's Performance Audit as it relates to fileJ /C:ADOCUME— l \LFSUPP —1 \LOCALS —l\ Temp \ELF20101215_154001\Approved ... 12/15/2010 Page 4 of 4 inspections /correction notices at the City Council Meeting on January 8, 2003.
