Anderson to a decision of the Planning Commission to attach a condition to a Nonconforming Use Permit for a duplex at 885 West California Avenue that the permit is valid only so long as the property is owned and occupied by Samuel S. Anderson or his spouse. Motion of Intent - Appeal granted and denied the issuance of a non - conforming use permit. The Council finds that there was an error in one or more of the findings of the Planning Commission in that under 62102(e), the structure is non - conforming with a conforming use, and with the condition being part of the motion that this should only be used as a single - family dwelling. The Council finds that there was an error in one or more findings by the Board of Zoning Appeals in that the application does meet the applications of the Code and that the property cannot be put to a reasonable use under the strict conditions of the Code without the variances and with the condition that the number of units be reduced from 101 to 93 units.
