City Councilmembers,
Section 2 of the Saint Paul City Charter identifies the role the City Council and
Mayor have in filling a councilmember vacancy; I have displayed the relevant
language in the navy blue text below.
The City Council may act to fill the Ward 5 vacancy within 30 days of Jim Reiter's death, by
Thursday November 6, 2003. If the City Council takes no action by 11-6-03,the Mayor must
(shall) make an appointment within 10 days of the Council's deadline date, meaning Mayor Kelly
must fill the vacancy by Monday Nov. 17 .
If the City Council desires to appoint whomever wins the Nov. 4, 2003 election for Ward 5 (for the
years 2004 to 2007) to also fill the interim Ward 5 vacancy for the balance of this year,this is the
election approval timing information I obtained from Joe Mansky, supervisor of Ramsey County
Elections:
a) Saint Paul voters cast their ballots on Tuesday Nov. 4
b) Ramsey County Elections staff will present their official Elections Canvas Report (declaring a
winner) to the City Council on Wed. Nov. 5 for their acceptance and approval at the Nov. 5 City
Council Meeting.
(Sec. 7.10. of the City Charter states: Within seven (7) days after the election, the city council shall
canvass the returns and declare the results of the election.
c) If a losing Ward 5 candidate wishes to ask for a RECOUNT on Wednesday Nov. 5, Ramsey
County Elections staff could have the recount completed by Friday Nov. 7, 2003. Then the City
Council would have to approve and accept a REVISED ELECTIONS CANVAS REPORT at their Nov. 12
City Council meeting.
d) The deadline for a losing candidate to CONTEST the election results via a lawsuit in District
Court is Wed. Nov. 12, 2003. If that were to happen,a judge would probably not make a decision
on the lawsuit until the end of November. (And, if there was a RECOUNT, then the deadline to
CONTEST the results based on the REVISED ELECTIONS CANVAS,would become Wed. Nov. 19,
2003, and a judge would probably not make a decision on the lawsuit until early December)
e) The earliest Ramsey County Elections can issue an ELECTION CERTIFICATE (certifying that a
candidate won a councilmembers seat to serve a ward for 2004 through 2007) is Thursday Nov.13
if the election is not contested in court, or later after a judge's ruling on any filed lawsuit. (And, if
their was a RECOUNT, then the earliest Ramsey County Elections can issue an ELECTION
CERTIFICATE is Thursday Nov. 20, 2003.)
An ELECTION CERTIFICATE is not needed for filing an interim vacancy,
thus there is no need for the Council to wait to take action after Nov. 13,

2003. (The Election Certificate only pertains to the election period from
Jan. 2004 to Dec. 2007.) Ramsey County Elections is of the opinion that
after the City Council accepts and approves the Canvas Report for the
Nov. 4 Elections on Wednesday Nov. 5, the Council could then appoint on
Wed. Nov 5. whomever won the Ward 5 election, per the official Elections
Canvas Report, to fill the balance of the 2003 term for Ward 5. If a
losing candidate asking for a recount were to win the election after the
recount, the Council could then reconsider their interim appointment
action of Nov. 5 at their Nov. 12 Council meeting, as the recount results
would be known by then and the City Council would have to take action
to approve a REVISED ELECTION CANVAS REPORT.
Item #38 on the Nov. 5 Council agenda is the consideration and approval
of the Election Canvas Report, and item # 39 is the consideration of a
person to fill the Ward 5 vacancy for the balance of 2003. Marcia
Moermond is preparing a fill-in the blank resolution for item #39, for Dan
Bostrom's introduction under suspension on Nov. 5. I would recommend
that the "filling the vacancy resolution" have an effective appointment
date that would begin after Nov. 5 (or Nov. 12 if a recount is
requested), so that proper orientation can be given to the appointed
interim councilmember.
Sec. 2.04. Vacancy.
An elective office becomes vacant when the incumbent dies, resigns by a writing filed with the city clerk, is
convicted of a felony, ceases to reside in the city, or is adjudged incompetent by a court of competent
jurisdiction, or when a councilmember ceases to reside within the council district from which elected.
Sec. 2.05. Filling vacancies.
(A) Interim appointee.The council may within thirty (30) days of a council vacancy elect a qualified voter of the
city to fill the vacancy as an interim appointee until such time as a successor is elected as set forth below or for
the remainder of the unexpired term if the council vacancy occurs after the last day for the filing of affidavits of
candidacy for United States Representative. If a tie vote occurs in the filling of a vacancy in the office of
councilman, the mayor shall break the tie.
In the event that the council does not fill the council vacancy within thirty (30) days, the mayor shall within ten
(10) days thereafter appoint a qualified voter of the city to fill the vacancy as an interim appointee until such

Background
The City Council has initiated zoning code amendments pertaining to concrete, asphalt and rock
crushing facilities, and transmitted the draft amendments to the Planning Commission for study
and report. After the public hearing, the Planning Commission will report their findings and
recommendations on the proposed amendments to the Mayor and City Council. The City
Council will also hold a public hearing on the amendments before final adoption.
A recent conditional use permit application that was appealed to the City Council (Semple case)
revealed ambiguity in the zoning code pertaining to concrete, asphalt and rock crushing facilities.
The code allows both recycling processing centers and uses that service,process or manufacture
outside of a completely enclosed building as conditional uses in the 12 zoning district,but first
allows crushing of rock,asphalt and concrete in the I3 district. There are some operations that
seem to meet both definitions, giving rise to the City Council's interest in addressing this issue.
There is a chronic shortage of aggregate available for the construction industry; the cost of
extraction and distance traveled to get it has driven up the cost. Contractors are interested in
recycling this material at locations where travel distance does not add a lot of cost and fuel use.
This would be a good thing for construction in St. Paul. Current zoning regulations for concrete,
asphalt and rock crushing limit this use to the I3 zoning district. Since there is now very little I3-
zoned property available, this essentially rules out such uses in the city. However, the use is
similar to other uses allowed in the I2 district, and might reasonably be allowed as a conditional
use in the 12 district if there are appropriate conditions.
Draft Zoning Code Amendment
The draft Zoning Code amendment adds concrete, asphalt and rock crushing facility as a
conditional use in the 12 district, with a consent petition requirement in the I2 district, and adds a
number of more specific conditions to control the environmental impact of such facilities in any
district. It also adds language to the definition of general industrial uses to avoid ambiguity in
the zoning code about what regulations pertain to crushing and grinding of concrete, asphalt and
rock.

PUBLIC HEARING PURPOSE:
To Hear Concerns and Comments From the General Public and Interested Organizations and Groups
Regarding the City's, the Public Library Agency's and the H.R.A.'s 2004 Budgets, Service Levels,
and Tax Increment Financing Plans For Development Activities.
This year the Saint Paul City Council will be holding a comprehensive Public Hearing to hear
concerns and comments regarding all aspects of the City's proposed 2004 budgets. A person can
come to this one meeting and comment on Right-Of-Way Maintenance Assessments,Sewer Service
Charges, and Water Service Rates, as well as the spending and service delivery plans for all City
departments and offices,the Public Library Agency,the Housing and Redevelopment Authority,the
Saint Paul Regional Water Utility and the RiverCentre Authority.
The Public Hearing has been set for Wednesday, November 5, 2003 at 5:30 p.m. in the Council
Chambers.
Comments and questions are welcomed for operating budgets,debt service budgets, capital
improvements, re-development projects and tax increment financing plans. With valuable input
from interested citizens, organizations and groups,the City Council / H.R.A. Board hopes to be able
to consider additional options for being responsive to the service needs of Saint Paul residents and
taxpayers.
On September 10, 2003, the City Council set the maximum amount of property taxes it can levy for
the 2004 services governed by the Saint Paul Mayor and City Council. That amount was the same
amount as levied last year for 2003 services. Thus, if any new or higher level services are to be
approved for 2004,the added cost would most likely have to be offset by reduction in other
existing City services.

Increment Plans

PUBLIC HEARING PURPOSE:
To Hear Concerns and Comments From the General Public and Interested Organizations and Groups
Regarding the City's, the Public Library Agency's and the H.R.A.'s 2004 Budgets, Service Levels,
and Tax Increment Financing Plans For Development Activities.
This year the Saint Paul City Council will be holding a comprehensive Public Hearing to hear
concerns and comments regarding all aspects of the City's proposed 2004 budgets. A person can
come to this one meeting and comment on Right-Of-Way Maintenance Assessments,Sewer Service
Charges, and Water Service Rates, as well as the spending and service delivery plans for all City
departments and offices,the Public Library Agency,the Housing and Redevelopment Authority, the
Saint Paul Regional Water Utility and the RiverCentre Authority.
The Public Hearing has been set for Wednesday, November 5, 2003 at 5:30 p.m. in the Council
Chambers.
Comments and questions are welcomed for operating budgets, debt service budgets,capital
improvements, re-development projects and tax increment financing plans. With valuable input
from interested citizens, organizations and groups, the City Council / H.R.A. Board hopes to be able
to consider additional options for being responsive to the service needs of Saint Paul residents and
taxpayers.
On September 10, 2003, the City Council set the maximum amount of property taxes it can levy for
the 2004 services governed by the Saint Paul Mayor and City Council. That amount was the same
amount as levied last year for 2003 services. Thus, if any new or higher level services are to be
approved for 2004, the added cost would most likely have to be offset by reduction in other
existing City services.
