(Requested by ty, Council on April 22) A report was presented by Peter Hames, Department of Technology and Management Services. The Council requested that the Mayor's Administration, after consultation with the City Attorney's Office, report back on May 27 regarding legal options relative to the payroll system. The Council, by motion, expressed approval of the Administration's plan to go forward with the payroll system as presented. Yeas - 7 Nays - 0 41. Report by the Office of License, Inspections and Environmental Protection on the development of a system to review permit holder actions and take appropriate adverse action against the permit holder. (Requested by C.F. 98-221 adopted March 25, 1998) A report was presented by Robert Kessler, Director, Office of License, Inspections and Environmental Protection. He said a resolution will be introduced in the near future on this issue. ORDINANCES 2. (ID #19980000376) • Bob Kessler, Director, Office of License, Inspections and Environmental Protection, appeared and stated that the applicant signed the conditions that were imposed on the license. Councilmember Harris moved the substitute and approval. Substitute introduced and adopted Yeas - 6 Nays - 0 3. Resolution - 98-377 - Approving a Housing Replacement District Plan. No one appeared in opposition; Councilmember Blakey moved approval. Adopted Yeas - 6 Nays - 0 44. Resolution - 98-378 - Approving the decision of the Legislative Hearing Officer on Property Code Enforcement Appeals for property located at: 503 Cleveland Avenue North, 118 Litchfield Street, 1320, 1326, 1336 Mississippi Street, and 56 Cook Avenue West. Brian Alton, attorney with McClay-Alton PLLP, 951 Grand Avenue, representing Republic Management, appeared on the Mississippi Street properties. Gerry Strathman, Legislative Hearing Officer, reported that no one appeared at the Legislative Hearing. He received a call from Robert McClay, asking for the hearing to be rescheduled. Mr. Strathman declined the request because there have been between 250 to 300 violations. Mr. Strathman had another conversation with Mr. McClay asking that the Council hearing be rescheduled because Mr. McClay was going to be out of the country. May 6, 1998 City Council Summary Minutes Page 8 S Mr. Alton stated he is a partner of Bob McClay. Mr. Alton asked that this matter be rescheduled before the legislative hearing officer saying that Republic Management takes this matter very /seriously and they want to have an opportunity to be heard. The purpose of asking this to be laid over is so Republic Management can make the repairs in an orderly manner. They are committed to taking care of the problems and there are some issues with some of the items on the repair list. Pat Fish, Fire Prevention, appeared and stated she was at the property on this date and met with the manager. They were not prepared to do the reinspection because they did not get the message from Bob McClay that the inspection was to go ahead. There are six buildings in this complex, three on Westminster and three on Mississippi. The list involves a lot of deferred maintenance over a long period of time. The management is attempting to do all the repairs with two maintenance persons. The tenants living there are unsafe, Ms. Fish said. In addition, there are structural problems. Councilmember Harris asked what the opportunity is for them to clear the violation if the appeal was denied. Pat Fish responded a letter was sent on March 31 allowing the owners until May 1, 1998 to make the corrections on the Mississippi properties. They cannot do all six buildings in 30 days, but with a schedule the properties could be completed in 90 days. Councilmember Lantry moved to deny the appeal stating that ample time has been given. Adopted Yeas - 6 Nays - 0 Illt,-25. Resolution - 98-379 - Ordering the owner to remove or repair the building at 780 Charles Avenue within five (5) days from adoption of resolution. (Legislative Hearing Officer recommends allowing the owner six months to complete rehabilitation provided that a code compliance inspection is done, the $200 vacant building fee is paid, and a $2,000 bond is posted by noon May 6) Gerry Strathman, Legislative Hearing Officer, stated that all conditions have been met. (Legislative Hearing Officer recommends laying over to the May 19 Legislative Hearing and the May 27 City Council meeting) Gerry Strathman, Legislative Hearing Officer, stated there is an active buyer for this property, but the buyer needed more time to fmalize the sale. William Manley, 1792 Portland Avenue, appeared and stated he has had the vehicle in question for 20 years and it is a properly licensed vehicle. Pauly Seely from Code Enforcement asked for his site plan and Mr. Manley told him that he had not submitted it, was in the process of selling the bus, and will send it in. A police officer showed up at his property and the vehicle was towed last July. Mr. Manley spoke to Jim Prill in Code Enforcement who had ordered the vehicle towed. Mr. Prill said he sent a letter, but Mr. Manley stated he never received it. Councilmember Harris moved to close the public hearing. Yeas - 6 Nays - 0 • Gerry Strathman stated the bus is improperly stored and this has been known for a long time. A site plan was submitted but was denied. Posting by the U.S. Mail is legally sufficient notification. All evidence indicates William Manley was notified. In response to a question of Councilmember Reiter, Mr. Manley said it had been three or four years since the bus was driven. Councilmember Benanav moved to deny the appeal and approve the assessment.. Adopted as amended Yeas - 6 Nays - 0 50. Appeal of James Swick to a Summary Abatement Appeal for property at 752 Laurel Avenue. Kady Dadlez, Department of Planning and Economic Development (PED), appeared and stated this property was platted into 8 lots, 6 of which are now being considered by replatting into 16 residential lots. All the requirements have been met and PED recommended approval. • Councilmember Lantry requested that language be added to reflect that this is a replatting for 16 lots with 16 homes on the parcel. Donna Drummond, Department of Planning and Economic Development, (PED), appeared and stated that staff recommended approval. Also, District 6 supports the rezoning. There was one letter received in opposition. No one appeared in opposition; Councilmember Reiter moved to close the public hearing and approval of the application.
